I do not think so. Even USCIS website stated clearly that B2 visa can be changed to f1 provided the conditions are met.....
Besides, I wonder why she will stress herself coming back to Nigeria with a baby for the sake of changing a visa to f1, something that can be done right in the US, provided all conditions are satisfied.
Check very well on USCIS website, u will see where it is stated that a visitor visa can be changed to student visa right there in the US.
However, my wife wasn't travelling to the US for the first time. It was her third trip now, and she never over stayed in any of her trips.
I also know thousands of illegal immigrants who are in the US for years, a lot of illegal immigrants families without papers, and they are living averagely much better than us in Nigeria. They drive around right in the US, they work ( even without papers) and their kids even attends schools. They even rent houses from private home owners while some shares apartment.
US are not that keen on looking for who are legal or illegal immigrants. So far u stay out of trouble.
Even, the VO"s that are issuing visas knows many people /families who are issued visas won't come back to nigeria. I have a friend who relocated to the US few months ago in Texas and he earns 10$/hour tax free. So this thing is not as hard as people are taking it here. Many of you that are contributing here went to the US to study, and knowing within u that even after your studies, u won't return home, many of u will look for a way to manouver and change status and eventually acquire the GreenCard, otherwise, why don't u all stay back home and do your Masters programme here in Nigeria. We got good universities here too.
In summary, US is a land of opportunities, and u can be sure that even if u re there, u might not be rich, but u will be comfortable, u can rent a house, drive a car (in some states) and earn as little as 500 dollars a week.
Above is my view......let's not see US as if its heaven where one cant find its ways.

It is very possible to do that. All you need to do is go to the Admission Department of the University to fill application for admission and talk to the Admission Counsellor/Advisor. The admission Counsellor/Advisor should be able to give you acceptance letter if you demonstrate you have the financial ability to pay for your education. After proving your financial capabilty to pay your tuition, the Admission Counsellor will issue what is call Form I-20 which will then be forwarded to Homeland Security/Customs, Enforcement and Immigration Services for change of Status from your B1/B2 Visa to F1 Students Visa. It takes only 21 days to process.

This has been done by a lot of Nigerians while I was in school. I have seen it done many times. I have seen Nigerian in their 40s did this just to remain in U.S because it is the easiest ways for many people to study or remain in the U.S.[/quote]

Wow, splendid! That's a whole lot of research you have done there as deduced from your other posts, quotes and references here on this thread. Thanks for at least confirming my suspicions. You probably are already on US soil with your family having put Nigeria behind, which of course will cost you lots. Just in case you are yet in Naija while your family are already there and your visas are linked in any way, forget renewing.
A piece of advice though: Sit down to calculate the implications of a failed status change/adjustment, which likely will be the case as that act is frowned at these days or falling out of status. In essence, renewal of B1/B2 becomes difficult for your wife subsequently if she comes back home. If she doesn't, you will keep paying for that in the form of Renewal Refusals. I know of a person whose wife even proceeded to Canada and he was still discovered at the POE easily and sent back home with a ban because he attempted to conceal this info when asked where his wife was. Do the right thing, let her come home and apply if she has all it takes to become a student in the US.

NOTA BENE: Any idea what happens to family members of people who played a fast one on the USCIS via naturalization (e.g from B1/B2 to LPR/citizenship on the long run by marriage) whenever they are invited by these "Citizens" to come visiting? They most times keep paying in terms of refusals for wrongs they didn't even commit, both parties are barely aware anyways.

Now guys let me tell us why it is very difficult now to adjust to student status while in u.s even though yes in their website (uscis) there is a provision for that.

1. There are now technical questions that where not in place before that needs honest answers and will be checked in the background

A) what did you say that was your reasons to obtain a tourist visa
B) do you have intentions of studying while obtaining your tourist visa
C) what did you tell the CBP officer at point of entry
D) why did you not apply for student visa while in your country

And many other relating questions that will be cross checked. Now when you get your admission and you apply for change of status (also depends o quick responds) you may have been out of status with your tourist visa.

There are other serious proves that has to be met such as financial status. Now you deal with new cbn rules in nigeria with commercial banks eg remitting money from your bank in nigeria. Unless you have starched funds here in u.s with a bank ready for use.

Most cases if not 90%, adjustment to student status are denied now with uscis. They always tell you to go back. Yes in the past it was easy.

Infact from the moment I indicated interest in going over, she was super excited because she can add more work to her schedule while I babysit her kids. Her husband was MIA for the 5 months I was there. He would come in, shower, nap for a bit and out again, 3 jobs NA WETIN!!!

Now imagine being an illegal immigrant, the suffer will be too much jare. Have you considered the bills? I was just pitying them. They worked that hard to keep up with the bills.

When I will jst chill in my 9 to 5 work, month end collect my salary and enjoy my life here. My house rent per annum is what they pay a month. Nepa bill is a joke, compared to what they are paying. I can't even imagine that US rat race...

Truth b told, relocating even to Ghana ll not b easy unless u have ppl dere to show u d robes nd have money too. Am in America for vacation and I ll b back by month end, like I said relocating I neva easy but those stressing America is difficult place to live in, let's face it, being a citizen doesn't make life automatically easy for u.
D lady who said her cousin nd d husband work out dere ass to pay bills, it's cos de have to struggle cos of d level de re in in dat society, de re most probably working $10 an hour nd having to work so many house to meet up, dat can happen to anybody anywhere if u don't have a good job.
My sister is a lawyer here and d husband is an electrical engr, she works 9 to 5 week days only, d husband works for 12 hours for 5 days nd is off for anoda 5days. De live very comfortably nd own dere house nd bliv me don't stress to pay dere bills or live d American dream.
U can't expect to relocate to anoda country where ur certificate is not recognised nd u have to do menial jobs nd want to live big, it doesn't add up, u ll work ur ass off to pay bills just like d menial workers in Nigeria ve to do too.
Some persons come here because de ll want d serene environment nd want to b in a place where d system works, while I don't blame dem, if u have to struggle to enjoy dat, just be informed Dats how it is until u can find ur feet, America is a beautiful place

Infact, you not getting my point or the preamble. We are basically saying the same thing, till you subtly rooted for illegally migrating.

Alhaji Wasiu wants his wife to relocate by overstaying, then went on to talk about illegal immigrants 'enjoying' life over there. I gave an example of my cousin and her husband who are both students and citizens (Nursing and Accounting) having to work long hours, adding studying to the mix.

Now imagine someone who is an illegal immigrant, having to work under the table to pay the same bills your lawyer and engineer husband have to pay without proper papers and certification. Is that not hardship?


And did you miss out my entire point about getting the right certificate, migrating properly and not having to work multiple jobs?

Number 1: The children are automatically citizens, they don't need visas. But if he didn't get their passports as soon as they were born... the process will be tough a bit. The wife will have to go through a process to get her passports. More information can be found here

As per the MOG, i pray God favour him oooo. I had previously advised him to wait until he tie the knot b4 he embark on the journey but he wouldn't take me serious.

I'm tired of this Naija and it has always been my plan to be a US citizen or GC holder and I want to be resident in USA.I was marries before but I'm now single because the person claimed to me my wife is unserious with me
I wish to be a greencard holder, and I don't know if its best I go through a school/masters programme or I marry a US citizen. All I care is to have a GC but I don't know if I can use Masters/school routes or marry a US citizen to get into this system. I believe when I get to USA I should be able to see an american babe I can marry to get my papers. Pls advice me. I don't want to slump and make a mistake
