Awwww. Let me make matters clear to you. You may arrest, interrogate, or invite a person accused of a crime. However, you haven't any right to detain him for more than 48hrs. Hence it is imperative that you have your evidence before arresting with a view to detention

The US is an example. Guantanamo bay inmates are referred to as detainees and not prisoners because they are supposedly security threats and not because they've committed any crime.
