Just forget about that. You won't get any good judgment on that. Not now our justice system is already on the dieing end.

I was fired on Thursday and no reason was stated in the termination of appointment letter.

Should I go to industrial court to seek redress or write the management to ask the reason why my appointment was terminated, because throughout my 2 months stay in the company I did not receive any notice of warning neither was involved in any fraud case.

Please what should I do?

I was employed as a subordinate under the head of a department in November last year,meanwhile before resigning my appointment in my former place of work,I was the head of the same department.

Right from day one in the new workplace,she started making my work difficult, she did not give me proper orientation and failed to attach me to a trainer,as a matter of fact she said to me and I quote " you should learn how to use company software in two days, in short you should be on your own in three days"

Everyday she makes life horrible for me, she hauls insults at me as If I was a greenhorn in the field. infact there was a day she said I was looking like a slowpoke, that I am too slow for her liking.
A month and some weeks later in the employment,she said she has done her assessment and submitted,that I scored zero in every area,that the fresh graduates perform better than me.

At that point,I sensed she was seeing me as a threat and for peace to reign,I called and tried to pacify her,she said she does not have anything against me.

and being new in the system, I have to learn how to use the software and office procedures,but this madam does not have soft spot for me on small mistakes,she always say this' you don't know anything you better go back to your former place of work'.
I got fed up and reported the matter to the HR,I was told to be patient with her and asked if I wanted redeployment which I said yes.

She relegated me to the state of nonentity by attaching me to an intern( to be assisting an intern).

When my appointment was terminated on Thursday, I was told to go and do clearance, to my amazement when I took my clearance form to her, she was not sympathetic at all rather she said "so fast" and signed instantly.

I knew my sack was orchestrated by her and I want justice for her wicked act.

please how should I go about it?



One question bro, in ur employment terms was it stated any whr that the company has the right to terminate ur employment at its discretion? If thr is such then u really have no case I'm sorry. Pls guys always read the terms of ur employment before accepting any offer...

Sorry bro. Your type of employment is the type that is not protected by statute(a particular written law). However, if u have a letter of employment read it carefully to see if there are conditions/procedures spelt out by which you could be disengaged. If there are none, u have no cannot sue your employers for wrongful termination because an employer in tge private sector has the right to hire and fire any employee and he is not obligated to state his reasons for firing the employee. The law would never force a servant on an unwilling master and your employment is categorized under the law as that of master- servant. If u need more help on the above, just quote me. In the meantime, move on to the next big thing.

So sorry. Don't waste ur penny on court; just go back to searching for jobs. I'm sure your reporting to HR was the one that did you in. Next time report her to God and blast MFM type prayers on her head... Die, die, die, all my enemies fall down and die, confusion, confusion, confusionnnnnnnnnnn!

u can but it's most likely u will not see a headway in doing that. They will simply say they relieved u of your duty for "unethical conducts". And the term 'unethical' are broad to define. In short anything the company call unethical is what it is as prescribed in their employment contracts. so I'd advice u move on.

Please my dear op, just accept this in good fate and go search for a better job. In this present day Nigeria, you won't be that type of worker that sues his/her employer and expect me to recruit you in my own company. You could try that in France, US or Britain.
If you think you will like to work somewhere again, just swallow the issue maturedly and move on. So much injustices in the workplace but it shouldn't have to be you that would bear the brunt by blowing the whistle. My 1kobo

This all sounds like a one-man business where proper organisational processes are lacking.
Clearly, the woman had it in for you from the get-go and she did all she could to make you appear redundant.

I have learnt how necessary it is to research the organisational culture of the potential company which you intend to gain employment in and then make an informed decision before leaving your present company.
I think you can go ahead and sue if you have the time and resources but dont expect much to come out of it; Rather focus more on moving on to your next great job.
When I and my colleague were let go from our first job in 2009, my colleague fought it and refused to move on. As for me I left a day earlier than the termination date and left everything to God while improving my skills and writing other job applications.
Long story short, I landed another job with 5 times my previous pay 2 months later. I later found my way back into the company 2 years later as a superior to all the people who fired me (though in another department) while my colleague fought the company and lost 2 years in the process.

This could just be a blessing in disguise depending on how you react to it.

before u can talk of sueing them take ur time and look at the terms of service/employment. from the terms if u they are in favour u can think of litigation.if not look for another job and forge ahead.

OP, sorry for your horrible experience but I am afraid there is nothing you can do legally speaking. An employer has the right to terminate your employment without giving you any reason. What he has no right to do is to breach the terms of your contract of employment (COE) while terminating your employment.

For instance, if your COE provides for a notice period or salary in lieu of notice then these are what you can enforce. No court in the land will restore you to your former employment as the legal rule is that you can't force a willing employee on an unwilling employer and vice versa. (There are limited exceptions but they don't apply to your case so I won't digress).

Do not be in a hurry to take any job without looking at the terms of your COE on termination. If it's silent, specifically ask that notice provisions and salary in lieu of notice be inserted. Once it's silent on these, the presumption of law is that your appointment can be terminated on the spot without more.

In the meantime, did they remit your pension during your time there? If they didn't, ask them to do so or if you are feeling vindictive whistleblow them to PENCOM especially if they are in the habit of not remitting pension contributions.

Take care and dust yourself up and move on. Your light cannot be covered with a bushel.

Before you call a lawyer let me ask some critical questions; Is your employment status contract or permanent? Since you just resumed I suppose you were still under probabation. So, you need to know what your letter of employment says about termination of employment by both parties under such condition.

Answering these questions will really help you. However, if you are not ready to go through the long judicial process you can simply move on and forget about what has happened. Mind you, you could have saved yourself this crisis if only you had asked your creator if should take up the job or not. The place of God in the affairs of man can and should never be underestimated.

Funny enough, she may likely be in church right now lifting her "demonic" fingers singing hypocritical praises to a god different from the true God.

Head to the industrial court and ignore those trying to discourage you from seeking justice but check your contract terms sha.

I will just advise u to leave everytin to God. God is in control ryt nw some company are laying there staff off dis January. Just take heart who knnows u can pay time. 2 of the money if u take this cse to court

@OP, the bolded was your problem. You fired the first salvo, she fired back and you lost.
The unit manager wins most if not all cases taken to HR as it is essentially you vs the company. If you couldn't win at HR, do not expect to win in court. From experience, the first 2 months in new employment are the toughest but eventually they get off your case.

You should have endured but you're a fighter and just had to get a case in with HR less than 2 months into your employment. undecided

Check the contents of your employment letter very well!

Have u been confirmed?

Are you a contract staff?

These employers are very smart when it comes to cases like yours......be very sure you are in the right position to sue them, so u don't shoot yourself in the leg!

It happened to me before......my lawyer went thru my letter very well n told me to forget it! Reason: I was still a contract staff then, and my letter gave right for disengagement without reason, unless confirmed!

I doubt if you are confirmed, cos you don't get confirmed in just 2 months......it takes about 6 to 12 months before confirmation.

My advice: Just let it go and move on!

You terminated ur appointment by reporting ur supervisor to HR

They will tell u, they terminated your appointment due to ur incompetency!

Your are not yet 3months on the Job...

I am not sure you have been confirmed as a staff.. you may still be on probation.. I dont think you have the right to sue... if you are not a confirmed staff.

What does your employment letter say about termination during probation period ??

If you had gotten a better (DOUBLE PAY or more) job during this period how would you have reacted??

God bless you for this. Most unit head have their friends or mole in strategic positions e.g HR. Op I know this seems like medicine after death but this could help others or even show you where you probably lost it.

Were you proud? Where you singing with the fact that you were once in her position? Did you say this openly or to her face? Did you humble yourself to receive correction? Were you truly slow on the job?

So much to recall. Oh well just move on...

Op, please don't bother to sue your former employer for the reason below.
1. Starting from your offer letter, terms and conditions are key things. Things like employer" reserving the right to terminate your employment with or without notice on certain grounds" are key components of these terms and conditions.
2. You were still on probation, therefore, subject to confirmation, you do not possess those rights some contributors are encouraging you to exercise.
3. You posed a threat to your immediate LM. Female LM are the most difficult in this regards. Next time, humility is key.
4. If you sue and peradventure u are successful, you end up creating corporate negative profile for yourself. No organisation want that type of staff.
5. Pray, let her and the organisation go. Do not add the organisation to your resume, go out there and get something better. Trust God and not yourself to do it.
Finally, I believe you are not meant to stay too long in the company. So thank God and move on.

Dude sacked himself by going to HR. Inspite of all the lady had done, he should have gone the extra mile in making peace with her by even buying her lunch and if possible being submissive to a fault.

Working in a firm is not just the salary alone.Rest of mind is another factor that can make you love your job.If you are new in a company there is always one staff who will frustrate your life.You shouldn't have first resigned from your former job.Seek permission for a week leave and used those leave days to assess your new job with the former one to know which one is suitable.

what were the terms you were offered the emplotement? look at the terms of ur contract, you ought to be given sufficient notice, the power of hire and fire should not be abused, there is always a remedy for any wrong, just try and institute an action or better still get a lawyer to write them...as simple as ABC hehe
