I am not an APC groupie. Neither am I a PDP zombie. I have been a strong critic of the Buhari govt. I have opened threads to lambast the current APC government. However. The truth must be told. It is shameful that the supreme court will affirm elections that both the national and international communities have condemned for the mindless rigging that the marred the election. Two case studies are the Rivers and akwa ibom state governorship elections that were marred with electoral malpractices. both the tribunal and the court of appeal validated the fact thar bothe elections were rigged without an iota of conscience. yet the supreme court shamelessly validated those rigged elections to the surprise of Nigerians and the world at last. The supreme court judgement of late has become a national and international embarrassment. And our highest court in the land is beginning to lose their reputation. Hmmmmm anytime I hear about the Supreme Court just one saying flashes my mind first and which is that made by justice Oputa the Supreme Court Justice. "we are final not because we are infallible but we are infallible because we are final" This is always bound to occur where someone or an institution becomes the highest authority without a checkmate from another body. Though I'm not vast in legal matters to determine whether or not the cases they affirmed was right or wrong but I think the only way to avert any form of suspicion is to ensure that the body in charge of appointing supreme Court judges have credible individuals as members so as to appoint people of high credibility and avoid all these confusion arising from judgements been passed by the highest court in the land In my opinion also, I think when and where judgments are upturned by higher courts or same courts, the former presiding judge/s should be tried so as to serve as deterrent to others who might want to tow the path of boycotting justice for whatever gain they might get Long live the federal Republic of Nigeria Long live Ogun State at 40 33 Likes 1 Share |

kingphilip:that is not how jurisprudence works. You can't punish a Trial Judge because you do not agree with his opinion. If proof of bribery is substantiated, so be it. But to say because he felt party A was right, and you at the supreme court feel part B was right, so the juniour judge must be punished...what impetus. The only reason the Supreme court is arm twisted into making this sort of decision is because of the mistake it made in the Rivers case. In the Rivers case, they held that the use of Card reader was not a constitutional provision and so cannot be tendered as evidence as to whether or not an election truly held or didn't. That opinion was enough to make all riggers win their case. This opinion is against what the Tribunals and appeal Courts held, and although one may argue that truly the card reader was not mentioned in the electoral act or constitution, it is understandable that the act grants INEC the right to organise it's affairs. Hence, any method it deems fit for Identifying a registered voter should become Law and Binding. When I heard that Fmr Gov. Remember that supreme Court works with what is submitted before it and sometimes public opinion. BTW I love SC recent judgments, it will bring sanity to our electoral process, so that people will no longer cause kataka during election to still mandate from the court if they can just prove that the election has some level of violence. 7 Likes |

Op, I copied this for another tread, please read it before you condemn SC. updates (AKWA IBOM) : "The so called security reports alleging pockets of violence, were dumped at the tribunal and the makers of the exhibits were never invited to be cross examined in line with the Evidence Act. They didn’t call witnesses polling unit by polling unit. MY LORD FROM WHICHEVER WAY YOU LOOK AT IT , THEY HAVE FAILED AND WE URGE THEIR LORDSHIPS TO ALLOW THEM TO FAIL .” -Counsel to PDP "They (APC) also alleged that there was no voting, yet they tendered ballot papers as exhibits. Form EC8A(result sheets) used throughout the state was tendered by the petitioner (APC) yet he said there was no collation of results. No explanation was given for this contradiction. That “No voting” was used by the tribunal to nullify elections in 18 local governments while the appeal court ruled that there was over voting and nullified the elections in the entire state, relying on the information gathered through the card reader " -Counsel to PDP “The petitioner (APC) alleged that no accreditation took place in the Akwa Ibom governorship elections, but the judgement of the appeal court had it that there was over voting. It is illogical that over voting could be realise in an election where there was disenfranchisement ". -Lawyer to PDP "The court of Appeal refered to 448,307 As the number Of Accredited Voters and used that to declare that there was over voting. It did not refer In Its Judgement were It got that figure. No one knows the source. It was the evidence of a pw49. The tribunal had rejected the evidence of Pw49 and all the evidences tendered by him... The court of appeal overlooked the decision of the lower court. PW 49 did not prove that 448,307 represented the total number of accredited voters in the state. The court of appeal did a grave injustice to us by using a simple fraction of the total number of voters to nullify the result in the state. CACAWA: You are talking nonsense. The card reader is the biggest election rigging tool ever invented! The first and most effective way to rig an election in Nigeria today is to disenfranchise the voters through the card readers. That is one rigging you cannot even fight against. It was used perfectly in the last election. But guess what? Kano state had over two million votes cast but just about 400k voters were accredited by the card readers. So at the end, what Jega has done is that he has put the biggest rigging tool in the hands of inec and the executive. This will be used especially in the presidential elections.
