unbundling the NNPC would be tatamount to repealing the NNPC Act. suchh actions require both the executive and the legislative, else it is unconstitutional. this is basically a major reason why enactment of laws in nigeria occur at snail-slow pace

Where is the PIB bill? It has spent close to 10 years in the house of reps and senate. Did they pass it or have you seen any effort to pass it yet.

We all know the outcome if the executive government goes through the senate and house of representatives on this matter. They will frustrate it.

I still stand with PMB on this matter.

Go back and read again. They aren't subsidiaries. They are new units. The NNPC have been unbundled. These new units are run by CEOs and not just Managers. They are going to operate independently. My friend, I would never support cutting corners in a democratic setting. President Buhari has to be a leader and also act as one.He is the president of Nigeria and by all means the most powerful and influential person in Nigeria.
You know why we still reverence obasanjo till tomorrow despite his obvious flaws? That's because he was a leader. not just by title but by deed. He had a unique and democratic way of getting the job done Buhari's party has the majority of both chambers, if Buhari cannot influence his party men to key into his policies and get his bills done ASAP, then we can agree that he is a failure already. All successful leaders in the world today have a way of going around uncooperative legislators. Even Obama had it worse, he contends with a Republican controlled chamber who are bent on making him fail yet he still somehow gets his Bills passed.
Obasanjo did it, Yar Adua did it, even the "worst president in our history", Goodluck did it. So what are we talking about?

That is what the shallow brains criticising the Senate fail to see. If it is not legal another government will just consider it null and void. The bane of our democracy is the continued degradation of our institutions.

Having said that I personally want to see the end, not the split of the NNPC. We should completely privatise the oil industry if we want to diversify the economy.

It is within the power of the presidency and NNPC as a corporation to create subsidiaries.


NNPC Act 2004 Pt 1. no. 6.

(1) The Corporation shall have powers to do anything which in its opinion is calculated to facilitate the carrying out of its duties under this Act including, without limiting the generality of the following, the power –

(d) to establish and maintain subsidiaries for the discharge of such functions as the Corporation may determine.


So what contravene's the law ? The PIB that they need to face squarely. What have they done with it in 6 years?

They didn't pass it till date and you are asking PMB to toe that line too knowing that the perverts, selfish and corrupt reps and senators will trade on it till infinity to enrich their pockets and frustrate the move.

I stand with PMB on this one. Sometimes he may need to exercise fiat in a bid to achieve expected results. I choose to treat this as an executive decision. Senate and reps can go to hell!

You too don't understand. No law means no law. It will be illegal and in sane societies no one will do business with an illegal entity whether local or foreign, whether banks or customers. And like I said, a new government can easily nullify and reverse it. The President is not a law or an institution unto himself. Its like you want to register a business and the CAC says come to us first and you ignore them. There are consequences.

If Buhari goes ahead to unilaterally unbundle the NNPC, what stops concerned individuals from suing the FG? A Federal High Court would easily rule in favor of the plaintiff(s), holding that the president's actions were illegal, null and void.
The president is backed by laws. He hasn't contravend anything.

Read up on the NNPC act of 2004. Clearly states the Corporation or Presidency has the right to create new subsidiaries, merge or modify existing ones unilaterally .

I definitely disagree with you on this one. First question you have to ask is how long has the PIB been before the Senate? The answer is 10 years!!!! It is pretty obvious that the senators are NOT interested in passing the PIB in any form.
For goodness sake have you ever heard of a bill that took 10 years to pass?
Since the senators are CLEARLY UNWILLING to do anything about the NNPC, Buhari has simply sidestepped them AND HE HAS MY FULL SUPPORT!!
As to legality or illegality of his actions, that would be up to the lawyers to decide. Nigeria DESPERATELY[/b]needs a leader with [b]AN IRON FIST because as we say in pidgin english "We no dey hear word"
