Hmmm... Interesting. Aside from the fact that the Nigerian owner of faceKOBO.com allegedly made the mistake of stating that his site is an alternative to Facebook, it's unfair to attack him for choosing the domain name faceKOBO.com Why? 1) Face KOBO could mean many things especially "focus on the kobo" (i.e. focus on spending little). In fact, I wish the owner of the site can forget about making faceKOBO a social networking site and instead make it a site about financial advice from a Nigerian perspective. That way, Facebook will have absolutely no case against him as it'll be two different genres. 2) Our KOBO has been existing long before Mark Zuckerberg ever thought of Facebook. 7 Likes |

Hello, People like the OP are the reason why Nigeria has such a Bad name internationally. This is classic cybersquating, hijacking and attempting to reap where you did not sow. Will you have used face, if there was no facebook? why cant you come up with your own totally original name, eg olodo.com and work hard to build the brand? why will you have to attempt to use the facebook brand to build your own business, and then claim facebook is trying to bully you when they want to treat your fuckup....? Meet or look for a lawyer in the US to take the case to court and ask for $300Million for the domain transfer to them for life,even if they agree to pay 10% and you settle all legal fees,I see no way you would not get $2Million. I don't know much about IP. Nigeria is a large market for Facebook and they will consider any threat to it as serious. Domain names are labels and identities for web services therefore can be registered as a trademark. Trademark registration is territorially enforceable. A trademark registered in the US covers only US territory. And the IP owner has to register his trademark in every country he wants it enforced. However there are treaties which make a single registration valid for over 100 countries. Nigeria could be one of them. And if Nigeria is, they have a good ground to drag you to a Nigerian court and nail you, and you would pay a lot in damages. I can only give an opinion whether you infringed on Facebook's trademark. The pertinent questions are, whether Facekobo can easily be mistaken for Facebook? Both have same letters, supposedly delivering the same services. And Facebook is an international brand forged in the consciousness of millions of people worldwide. And there is an element of bad faith in trying to take advantage of Facebook's goodwill.
