Saratkum: Tmr is officially the end of our 12 week application period and we're yet to get a response. I'm frustrated and very tempted to request for an update of our application first thing tomorrow. |

obabola123:Hi dear the rule says you must have made 18600 in the last year so if spouse makes less than that ,but can still meet up the financial requirement through other means like overtime .then what you need is 12 months slip all must be stamped or on company letterhead also introduction letter from company or contract and you need p60 to show that as well you will qualify under category B of full time employment 1 Like |

@justwise . yes it was a spouse settlement visa application. the ECO refused and reasons been that i did not meet financial requirement which off course i did. the ECO did not take time to look at all the documents supplied as i am off sick and provided the last 6 payslips and bank statement corresponding to the period before i went off sick as requested in section (6.1) of the financial requirement. the ECO said they contacted HMRC who confirmed i was only paid £450 in January which is what i am receiving as statutory sick pay at the moment as i am off sick. the ECO therefore without taking into consideration that i was off sick concluded that she was not satisfied that i worked for the company i said i worked for as the salary does not correspond to what i declared. the ECO even went along to mention the name of a company that i do not even work for and that my husband did not pay for the Health Surcharge and he paid for this and even sent confirmation. the ECO said my husband had to pay £900 for Health Surcharge and i do know its £600 for spouse settlement visa. please advice me if that is the correct fee or may be we made a mistake during our application. please can you advice me if i should request for a review and also appeal as i am still off sick and there is no way i can make another application as i will still have to give the same payslips and bank statement. |

sister2007:I am not an expert, and u clearly n definitely need one! You need a lawyer to help you with how to go about this apeal process..as you rightly said that since u r not gonna present them with new docs u cant reapply. As with the health fee that doesnt make sense at all.. as u cant submit an application without paying it. Get a lawyer here in the UK, thats my advise x |

sister2007: This is not a difficult case if you can defend all refusal points with paper evidences. 1. Do you have your employment letter? 2. Do you have you payslips before, during and after your sick leave? 3. Can you get a letter from your company to support your employment and pay during sick leave? The health surcharge hasn't changed. |

yes i do have all the documents we presented with the application. everything was complete and even gave letter from employer confirming that i was off sick and receiving statutory sick pay. i also provided sick notes and letters from the doctor to confirm this. i am so surprised that they just ignored them and decided to refuse the application using some silly reason |

Portsmouth86: The applicant cover letter may not have been essential with regards to your application , but it was to ours. And infact it was exceptionally important and we wouldn't have had our application processed in 3 days without that, as there are concerns that needed explaining about the applicant. All what we do here as per stating docs provided and what and how we did ours should only act as guidance . Every applicant should tackle thier application in a way that best suits their situation. 1 Like |

Batba1: You can address to whom it may concern You can address to ENtry Clearnace Officer It doesn't matter. In my opinion, Letter from bank should be addressed to whom it may concern Employer can be addressed either way. Mine was addressed to ECO at Sheffield |
Re: UK Spouse Visa/Appeal Process-part2 by Batba1: 11:48pm On Mar 30, 2016 |
blza: Thanks a lot! Please one more question about the self addressed envelope...who needs this and what exactly is it for? |
Re: UK Spouse Visa/Appeal Process-part2 by blza: 12:26am On Mar 31, 2016 |
Batba1: If you are referring to prepaid return bag.. This is for the return of your supporting docs. This should be included in the package containing supporting docs that the sponsor will send to Sheffield. It will be addressed to the sponsor and postage cost paid . I will advise you check the envelope or mail bag can hold same amount of docs you are sending to sheffield and the amount paid enough to post parcel of that weight. All our supporting docs (sponsors and applicants) was returned including photocopies. |

sister2007: Then download an administrative review form, complete it and seen by post or email. You don't add any additional document just detailed explanation why you disagreed with ECO. Most importantly point out those mistakes made by the ECO. The ECM who is an independent eye will go through your files again to see if indeed the ECO made a mistake by denying you a visa. You will be called to submit your passport for visa if the decision goes your way. |

@Justwise and family please look into this: Sponsor has just the flight ticket confirmation and of course dated pictures for 5 visits to me altogether but no boarding passes or stamps on passport as she has both Nigerian and British passports... 1. Are we fine with just the ticket confirmations 2. Does she have to include bio data copy of both passports as well or just the British one? |
Re: UK Spouse Visa/Appeal Process-part2 by Lexusgs430: 3:27pm On Mar 31, 2016 |
Batba1: The Nigerian Passport would have been stamped on arrival and at departure. Biodata page of the British Passport 1 Like |

Batba1: Was his British passport stamped? Boarding pass is not really important they can verify his visit with the ticket |
Re: UK Spouse Visa/Appeal Process-part2 by Jeljay: 4:05pm On Mar 31, 2016 |
Can someone please tell me what that means. Today is officially the last day of my 12 week period. I emailed them to enquire about the status of my application, only to get the email below. When I checked the TLS website the decision made icon has not been ticked. Can anyone advice. Thanks Thank you for contacting the UK Visas and Immigration International Enquiry Service. We understand that you would like to know about the current status of your visa application. I have tracked the status (GWXXXXXXXXand date of birth XX/XX/19XX) and found that the application has been processed. Please note that your passport and documentation could still take some time to reach you whilst being sent back from the decision making centre and whilst other administrative formalities are completed. The visa application centre will be in contact with you regarding the collection or delivery. |
