Lightme: Bang on correct. When biological children is involved , the issue of sham marriage is never raised . I guess this is an ECO just having a bad day. If you have time to spare just appeal and it will be overturned. Base it on the fact that you have children together. Provide thier birth certificates, passports copies. If you haven't provided a lot more communication logs due to total size of the logs, state that . But then add about 2 day logs per month covering the period of relationship. Include all your travel tickets to visit him and also copies of entry and exit stamps that corresponds with those (not a biggie if you can't find all your tickets , the stamps will do). Also include the extra docs justwise mentioned. But if you have the money for another application , you can reapply . If not an appeal will be successful. Wish you luck 1 Like |

kenson4ever:What he means, in order to enter the UK and collect the BRP is this letter all we need? Cz on the letter as u can see its saying bring the visa along. Just being thorough and a teensy bit paranoid.

Justwise, Lexus, ibiza and all other gurus, I came across these cases Bk Turkey 2005 and Elham Goudey 2012, can someone pls read and advice if its anyway relevant to my case, which route should I go, is it to quote those case laws and say ECO was wrong or to just say here are my additional evidence in the appeal. We want to do this on our own, we realised from experience that solicitors are waste of time and money. |
Re: UK Spouse Visa/Appeal Process-part2 by Lexusgs430: 3:16pm On Apr 06, 2016 |
Lightme: You cannot use case precedents and citations, appealing has an individual. If you want to use Legal terminologies, seek and use Legal representation. NB: Personally, you can appeal by yourselves. Simply put a watertight case through. Do has earlier advised, and you are good to go. |

Re: UK Spouse Visa/Appeal Process-part2 by Portsmouth86(f): 6:17pm On Apr 06, 2016 |
Saratkum: Yes you just take it along with your Passport, however you will still able to collect the BRP without the letter, there have been a few people I know who had no decision letter when they collected the passport, and like the wording states " please also bring along this letter, as it will help Post office staff to locate your BRP quickly" so therefore its not mandatory, just that it speeds up the process |

Portsmouth86:Its not the letter tho.. its the passport stamp thats missing >.< Really bizzare Our lawyer said the passport should have been stamped with a 30days visa. Is this true?? |
Re: UK Spouse Visa/Appeal Process-part2 by justwise(m): 10:05pm On Apr 06, 2016 |
Lightme: You don't need to do any of that, add the new materials you have now and send in your appeal. |
Re: UK Spouse Visa/Appeal Process-part2 by blza: 10:11pm On Apr 06, 2016 |
kenson4ever: Huuu, sound like an error. Not aware of procedure change. Your passport should have been stamped with a visa that is valid for 30 days. This will enable you travel to UK . You will then pickup your BRP within 10 days of arrival in the uk from the post office as stated on the decision letter. Going to BHC is an option if someone will actually deal with your query there. You can call the premium support line. Also tell your partner in the UK to call the premium UKVI helpline 234 14406 203 or 44 1243 217 987. They should advice on the next step. You can also write to the same address where your application was processed (Sheffield) citing your VAF/GW numbers . It's advisable to send the letter by a recorded post. |
Re: UK Spouse Visa/Appeal Process-part2 by blza: 10:16pm On Apr 06, 2016 |
Saratkum: This is really a strange one considering Kenson4ever had similar experience . I doubt the procedure has changed. You should hv visa stamp in the passport which is valid for 30 days |

Re: UK Spouse Visa/Appeal Process-part2 by Portsmouth86(f): 12:09am On Apr 08, 2016 |
Lightme: I Know others have commented, and true this is where you went wrong, you have been together 6yrs however only supplied 6 months communication, you needed to have supplied communication from beginning, during and close to the date of application, with a few snippets of communication from each month would have been suffice. I was with my husband 11 months prior to marriage and submitted every piece of communication evidence, and on my interview I said I wasn't sure if I supplied enough communication evidence and the ECO said that as long as you provide relationship evidence especially communication, from as I said above from beginning during and prior to application, then also add flight itineraries/boarding passes/ photos from each visit and marriage then you should have no problems. Is whatsapp the only form of communication or do you communicate via other sources, i.e. Rebtel, Facebook, Viber, facetime, anything that you can extract logs from? I supplied Whatsapp, Facebook and itemised call logs from Rebtel. I would go ahead with appeal and gather as much evidence as possible, or if you can afford to do so then address the points of refusal then reapply, since appeals are currently taking in the region of 18 months. let us know if you have any further info/questions we will happily assist where we can 1 Like |
