momsomyy, I think you should take note of what TheLeakyTribe said in the last post, also you are 30 weeks gone already if you want to reapply do that in time as I hear now that appointment dates are now like 1 month ahead of when you book, I don't know how true that is, just stick to the advice you have gotten from here, gather yourself and be prepared for whichever outcome, I pray you find favour.

I mentioned using an immigration lawyer, I think they are the ones that can get your banned or not banned status from the embassy. If you haven't been banned, you can go ahead to build a defence. If you have been banned, I heard Canada is pretty nice in summer and Brazil also gives citizenship grin

This is the most logical comment on this matter. Exactly what i am also wondering because even if you have nothing to do, why just stay there like that? When i had my last baby in 2013, i was unemployed then. I didn't over stay my welcome and i renewed last year by dropbox and was re-issued another 2 years which is what i'm going to be using in August to birth my baby.

You can't convince a VO that your initial decision to stay and have a baby was unplanned and still prove you have ties back home.

If you have a job for example, how do you suddenly just decide you're not going back to work you'd rather stay for months in the US to have a baby? It doesn't seem logical. I'm not sure there's anyway you can truly explain how you could just decide based on a 6 month stamp in that everything in Nigeria could wait and you would just stay to have a baby in the US. Please consider this before you tell a VO again that it wasn't planned.

My SIL also over stayed. Hers was for almost one year. Her baby had serious health issues so she had a valid reason for staying. She paid all her bills but she has been denied twice this year even after changing location. She had her interview in Lagos, was denied. Switched to Abj, was also denied. I hope you get this sorted out.

Hello house, great work you all are doing here I must say. Please I have an issue that requires a quick intervention. I applied for a b1/b2 visa to attend a 2weeks event and come back, and was given a b1 1 month visa (annotation) 2014 after been denied in 2013 for the same event (its yearly), got to ATL Poe and I was stamped in for 6 months as against the 2weeks I initially put in my application to stay since I was pregnant as at then (6months and VO was not aware) and was stamped in for 6months, I decided to stay back and have the baby there after the said event. I paid all my bills in full got my zero balances to show. Got back to Nig, waited for a year and now reapplied last week hoping to renew my visa b1/b2 visit visa. Getting to the interview the VO asked couple of questions which to the best of my knowledge I answered truthfully (no current pregnancy related questions, although I am currently pregnant and plan to birth the baby there) after the interview I was denied 214b. Now I urgently want to reapply because I want to birth my second baby there. How do I go about it please? Also my child has been really sick, sheduled an appointment with his pediatrician successfully. Should I just reapply saying I am taking him for medical reason or just apply saying I want to go birth my second baby? (Hoping the change in travel intent does not disqualify me) Or just reapply and stick to the same travel intent I was just denied of? Please house help as I don't want to be denied again please and also don't want to appear so desperate to the VO (considering I was just denied last week). Thank you house. Quick response please because I am currently 30weeks gone (with a small bump tho) grin

Thank U and God bless. U have set out the point I was trying to make out. When people discard logic for sentiments, it beats me. This is a support group but all the same, one that should state the hard facts to help both the person in present trouble, the silent readers and future readers.
@momsomy let me do what I'm trained to do. Bring out the weakness in your application so u can be prepared during the interview. And have honest answersm
1. U said, your only issue will be the change of intent. No it may not be so keep an open mind.
2. Be Prepared to answer why u stayed 6 months on a single entry visa whereas u applied for a conference abi? Did u finally attend the primary reason for that ist visa?
3.And as Leaky said, what happened to your job , who's to say u won't stay for one year now?
4. Assuming but not conceeding that u had no plans to birth the ist time hence u didn't declare it, why didn't u declare it the 2nd time?
I believe it won't even be wise for you to say 'because I wasn't asked'. That would piss off the VO.
5. Be prepared to answer Why you must birth in the usa.
6. Finally, I don't know if u have filled the form. There's a column for 'have u tried to enter the us by fraud or misrepresentation?' It is my opinion that u should state yes and that would give u a chance to plead your case before u go In. Clearly, your intention was childbirth and u said vacation only. So get it out there. This may be hard to do but even if u don't gettit now, u will be making the path easier next time.
Oh finally finally, please don't mention that u need to see a pediatrician.I think The former posters are right. Don't rub it in their face that the first visa was used to get an american baby without their consent.

True at loosing it's salts. They changed mgt I think. When Dr Okeke G C E(co owner) was still in charge...it was so diff. and smooth, I only know they still have a very good consultant cardiologist till date. It is well.

It's like they are losing grip... am jst so sad! it's an avoidable death. And she's a regular visitor to US o! Now all we can say is if only...

They will call you don't worry, they called my brother on the eve of his travel date and they gave him 4k

197 I doubt? Even when the going was very good with dollars, Stanbic never gave at 197, they always did 207 now it's 217

pta to Dubai? I thought these banks used to say they are not selling pta for Dubai travellers very funny people, yes o when I called the contact centre in Feb they gave me one email sibtcbdcltd@stanbicibtc.com to forward the documents to that it's as same as applying at the branch

i went back to the branch and they assured me that they already sent my details to the H/O
i still went to the H/O and was asked not to to reapply

Ok back to that question I am actually the BOSS of my JOB!! And Operating my kind of work is just a few phone calls/emails from wherever I am. When you are in a boss position you can actually just decide on what you want without anyone permission and also leaving my business for 6months wasn't a bad idea compared to the benefit of having an unplanned birthing of my child in the US. So showing ties based on work is not even my problem + I have a great financial acct and also previous travelling experiences (other countries) which I never for once overstayed.

@asikiye thanks for your input but my case is different I never overstayed my POE stamp, guess my offence was birthing a baby on a B1 1month annotated issued visa from here (Nigeria)

Good morning lovely mothers n to be. I need your counsel on my situation. My family got a B1/B2 visa in Jan 2015 and travel to US in Dec 2015 and returned Jan 2016. Our visa was issued for holiday and we were not asked any question about pregnancy although we had no intention of any such at that time. Now I am pregnant and wish to give birth in the US in Oct this year. With this my situation, do I need to write notification or change of intent or what is my chance if I go without this letter and declare my purpose at POE? Please if I need to write this letter can someone help me with the format. I have searched the entire the entire thread n could not find one. I would also need to know if I would require to support the letter with any document? Also is the embassy going to respond to my letter to indicate approval? Please I need your advice on some of these issues. God bless you all.

I think the main cause of the refusal might be that she birthed in the US with a wrong visa,because B1 doesn't cover medical,But B2 did. So she can come clean by applying for the right visa and tell the whole truth about her previous travel with all her burden of proof and hope that the VO will be fair to her,with the help of God she will be fine since she paid all her bills on the former one.
@Austine2020 That's the same thing I think. I should have returned back after my2weeks event and reapply even though I was stamped in for 6month at POE (Unintentional Mistake) but honestly I was scared + just felt it's better to have the baby at once since I was far along gone and had enough time (POE STAMP)

But seriously, how does one get to rectify this kind of problem? Is it by going over and over again till you get a fair hearing? Lot's of people are in this category.

Ok so the thing is I was not faced with much questions or difficulties during my interview last week because all the VO asked was why do I want to go to the same state I went to previously and I said for Vacation, He now asked me duration of my last visit I said 6month which was the truth and he went ahead to ask what I was doing there for that long and I answered birth my child and immediately I brought out my zero balance to show him, he collected it went through it and started typing and handed me the section 214b refusal paper (that refusal is based on having no strong ties to ones country from what I have read) so now the issue is back to your no 1) suggestion I have a family I am to stay with and they have sent a letter which I used in filling the last week application and they are still willing for me to stay with them also, so I was thinking I should still maintain that contact so I don't contradict every part of my application, also to your no 3) I am married traditionally now with my baby dad but yet to do court n white (after this delivery we would do that) but while filling the form that got me denied last week I filled single because I didn't know if they accepted our traditional marriage or not. So now I want to state that I am married traditionally and take pictures with me to show. Will that be good enough ties? Or you advice I don't take my child with me? He's just 1yr+ and very glued to me

small time now this change of intent letter will carry paper weight, you have used the visa for vacation already and you want to born now right? So which one is change of intent letter again, I believe it's only when you didn't use first for the reason it was issued you should be thinking of drafting a change of intent letter

I think she should choose the option that says Other there's a space to explain there she can put customary marriage, the types of marriages recognised in Nigeria under the MA and MCA are islamic, marriage under the Act otherwise known as registry cheesy and customary law marriage. I think her own marriage falls under the Other option that is in the drop down

I stayed 5mths, had a job back home. Applied 3mths after I returned... they didn't refer to it. Was anticipating the question though. They were more interested in nailing my a$$ for staying 5mths

Dearie, I would say relax first. Thank God baby is alive and in good hands. I no d current dollar matter but d babys life ft irst then d dollars.
Had my baby last wk, cs & baby was full termed, big but later found out she had low sugar cos I was gestational diabetes. Baby was taken to Nicu. Day 1 & 2 I kept hearing she's not eating well (formula) so d sugar has not stabilize. As at this time no breast milk yet but I was using pump to stimulate (FTM). So I kept praying. By day 3 I asked them if I can be doing d feeding my self they say yes. I got colostrum that day took it there n fed mmy baby. I started going there every feeding time 3 hourly. Express breast milk, feed my baby myself in d midst of prayers o. U must eat, am ur mother, this is my milk, am a good eater, ur father eats well, were u wan learn am from not to eat etc. She ate, surpass their limits 4 her sometimes and d sugar test figures kept rising. I tire but I no gree cos no sleep since I had to go also in d night. All d nicu nurses were just amazed. I laugh, pikin wey I wait yrs for unna no no d power of a determined mother.
She spent total of 4 days & on d 5th day was discharged!
We are home & doing fine. I have also not seen nicu bill but I've pushed it behind to enjoy my vigils of motherhood. When it comes, God pass am!
So leave money matter and be strong for ur child n by Gods mercies she will come out well n fast from there! Am joining u in prayers. Much love n hugs dear.

I have read and re-read your comments. I have nagging questions.....
why do you keep insisting that your stay was unintentional? How do you stay for months in another man's country unintentionally?
Why do you also keep bringing up the "i was stamped in for 6 months?" Are you not aware that you were stamped in with B1? and that your visa was annotated for 1 month? did the cbp cancel the annotation at the point of entry? did s/he stamp you in as B2?
Are you not aware that it is illegal to access medical care (except in cases of dire emergency) in the united states on a B1 visa?
Okay, were you not already married by tradition as at your last interview? You chose single because it is a bit difficult to explain a marriage without a certificate. Understood. So why change to married or common law union for this next interview when the traditional marriage was not done in the time frame between both interviews?
Your insistence on your first child birth trip being "unintentional" and your stay being "legal" in your view because you were stamped in for 6 months would only infuriate any VO because it would come across as you thinking s/he must really be so foolish to not read between the lines.
I hope you are able to understand that your choices before now were wrong and illegal. Also, ignorance is no excuse.
Now, you know better. This is a faceless forum, you alone know all the facts.
Re-apply, it really does not cost anything but the visa fee. Answer ALL questions truthfully and be prepared for any response.
