Let me take pains to lecture you about NAGAFF AND ANCLA, the two registered associations that regulate the operations of agents nationwide. I'm a registered member of ANCLA, an associate member and I ply my trade at apapa,seme and idiroko. So you can see that agents are not acting on the own voilition,we operate within the government rules... ANCLA was established in 1954,RC 6754 and it's recognized by agent bodies all around the world.. IT'S RECOGNISED BY THE CRFFN (COUNCIL FOR THE REGULATION OF FREIGHT FORWARDING IN NIGERIA) AND IFCBA (INTERNATIONAL FEDERATION OF CUSTOMS BROKERS ASSOCIATION),INFACT IFCBA'S LAST CONFERENCE WAS HELD IN SHANGAI, CHINA AFOUND 17 MAY, 2016. ABOUT ANLCA NATIONAL BODY The Association of Nigeria Customs Licensed Agents is the oldest and biggest body of clearing and forwarding practitioners in Nigeria. The primary role of the national executive body is to promote growth, unity and stability of the association. The national body also advocates and promotes member growth through the various chapters that make up the national body. They provide responsive leadership and guide the chapter executives through creating strategic policy guidelines. With overall guidance coming from the Board of Trustees, the national executives , operating through the various zonal and chapter executives promotes the activities of freight forwarders in Nigeria. ABOUT ANLCA APAPA PORT CHAPTER The Association is a non-profit organization governed by a constitution which provides for a board of trustees with a Chairperson, Vice Chairperson and five (5) other members. The trustees are highly experienced, seasoned entrepreneurs and managers from member customs brokers/freight forwarding companies, who are nominated and voted for by these members. Established in 1954, we are the first and the oldest licensed customs clearing agency in the country operating from the first and the oldest port in Nigeria. PURPOSE: We are the recognized voice for all the agents operating in and around Port complex where we represent over thousands of clearing agents and freight forwarders. It is imperative that a group with such large members should have a common voice to agitate for its growth. ANLCA liaises closely with many government agents and extra-ministerial departments, port terminal operators, inspection agents appointed by government, shipping agencies and shipping lines that are associated with our kind of jobs. Such include the Nigeria customs, NAFDAC, Produce department for export control of perishable products, cargo handling and security agencies. The Association serves to recommend practical and effective responses to the many challenges facing its members, the government main agent at the ports – customs, other members of the customs clearing industry and clients. This would be nearly impossible to achieve by individual companies. The Association helps members’ secure consistent and effective representation on forums which influence their businesses, such as the legislation of laws that positively affects them. Freight forwarding has an international character and as such we work closely with other freight forwarding associations in several countries around the world . OBJECTIVES: Objectives are: To unite the freight forwarding industry worldwide. To represent, promote and protect the interests of the industry by participating as advisors or experts in meetings of international bodies dealing with transportation. To familiarise trade and industry and the public at large with the services rendered by freight forwarders through the dissemination of information, distribution of publications, etc. To improve the quality of services rendered by freight forwarders by developing and promoting uniform forwarding documents, standard trading conditions, etc. To assist with vocational training for freight forwarders, liability insurance problems, tools for electronic commerce including electronic data interchange (EDI) and barcode and the new biometric registration exercise going on. AIMS AND OBJECTIVES OF ANLCA: The Association aims to achieve the following set objectives: Service Standards –To establish performance benchmarks and to create service delivery standards that must be adhered to by its members. Dispute Resolution - Development of a structured dispute resolution mechanism i.e. system of classification of offences, based on severity, frequency and corresponding sanctions. Interest Actions - Take such action as may be reasonable and achievable to advance the interests of members. Membership Value Delivered - Ensure that members of the Association receive value through membership. Industry Skill Development - Raise the level of industry skills development through regular training and mandatory training programs designed by the association for its members. Networking - Improve the level of networking at senior levels with Government, its agencies operating at the ports, port service providers, and other organisations which interface with the freight forwarding and customs clearing industry Negative Issues - Deal with issues which are adversely affecting Government's policy such as fraud, improper documentation, clearing delays etc . Relationship Building - Encourage more members to participate in the affairs of the Association and increase its membership so as to remain relevant in the National body. MEMBERSHIP CRITERIA Pursuance to section 4(1) of ANLCA constitution; Membership shall be limited to corporate bodies incorporated under the companies and Allied Matter Act 1990. Not withstanding subsection 4(1) A member will be admitted by making application in writing to the national headquarters or any National Committee set up for that purpose through the chapter executive council of his/her operational concerned and paid such fee(s) as may from time to time be approved by the NEC. No member shall be admitted if it does not carry on business in the shipping and/or freight forwarding business in Nigeria. If it is not licensed by Nigerian Customs Service as a custom broker with a current and valid operational license. If its representative(s) agent(s) or servants have been convicted of any criminal involving dishonesty or fraud. Incorporated and registered as a member with the Corporate Affairs Commission (CAC). Managing Director/CEO has 3 years experience in international freight forwarding and as a Nigerian Customs Licensed Agents. Company comprising of Nigerian citizens. Can contribute to the development of the Organization. Other rights and duties are general & procedural (to maintain unity, support of association) Minimum number of staff five (5) employees and a proper office. Minimum educational qualifications: completion of formal education. Minimum two (2) persons must have completed the basic course for forwarding from any designated institute. Association shall maintain a membership register which is updated yearly and the condition for retaining member status is by paying fees as at when due. ANLCA Membership Categories Full member: A company must carry on business in Nigeria within Nigerian Custom Secure Ports and its core business must be international freight forwarding and/or customs clearing. Associate member: Must be engaged in activities that are closely allied or related to freight forwarding. Honorary member: Honorary membership may be conferred on individuals in recognition of their services to the association. Associate and Honorary Members do not have voting rights within the Association. Organizations and companies qualifying for membership of ANLCA Apapa must pay all applicable dues, fees and subscription and must become a member of the ANLCA National and pay the applicable annual subscription. saintjoel: Can you please state the line within the constitution which establishes clearing agents as part of its operation. NURTW is a body with agents too. It the role of this body has changed from facilitating to that of inhibition then it has to be pointed out by those who see things clearly from the outside. A page was posted earlier with some numbers as duty rate but is this from the ministry of finance or as approved by the parliament or someone came up with this in the custom office. What's is the page on their site that states the duty? Why can't anyone use that web rate to make payment and pick up their goods. What is the flat rate an agent charges to clear goods? 5-10%? Agents was created by a group of people as a tool that liaise with customs to expedite clearing of goods based on the process it has to go through to clear customs imagine a shipment which has to go through NAFDAC, and SON here is where the agent makes things easy passing through agencies. Someone just said 90% of people clear their thing in Zimbabwe if 70% can't do it in Nigeria shouldn't that be considered a problem. I said a prayer once and I'll repeat saintjoel will by clearing shiploads and cargoes instead of cars. All these arguments be cause we are behind Zimbabwe 1 Like |

sultaan: That's why you need to be trained as an agent and if you care to know, the tariff is fixed when ministry of finance staff, custom officials and agents. KEMI ADEOSUN, the minister of finance was at the seme border last month to liase with agents and custom officials.The ministry of finance comes up with an assumed value for your frieght or vehicle and transfers to the valuation units of NCS where agents and agencies have to go in order to obtain bank charges, which means if you're not a trained agent,you can't obtain those values. If you feel that you want to know more, gather money and register an agency, go for the training and start operations... Seriously, I don't know your fixation with agents and what they do for a living, these are people that have been in existence since 1954 and have been running operations around ports and land borders. Part of what importers have gained from the agent body is the four year reduction policy, if you as an importer is told to pay for the actual year,do you think you'll be able to afford a luxury car, ship and pay duties,the problems we're having is just that some importers and agents are abusing this policy . If ANCLA is cancelled today as a body and importers are allowed to clear frieght themselves, so you SULTAAN believe that Nigerians won't cut corners or do you think Zimbabweans are saints when it comes to corruption even if they're still learners besides Nigerians. Instead of facing the larger society, you're trying to isolate agents as if we're wicked souls. Zimbabwe is a member of IFCBA cos they've SFAAZ (THE SHIPPING AND FORWARDING AGENTS ASSOCIATION OF ZIMBABWE) with Mr Nyaruwanga as its president with major frieght forwarders like BEACON, ARI-FRIEGHT, AVIOCEAN, LOKOMOTIVE LOGISTICS, SMART, MAPLE FRIEGHT ETC as major stakeholders.Even in republic of Benin, many nairalanders that have worked with me will know my representative at the Cotonou end, he's shown in the fourth pic representing us in the freight forwarders conference in Cotonou. Can you leave your work to shuffle papers for your import, shuffle through Nafdac,son,sss,bomb squad, quarantine, port health, customs. Can you stay days without going to work so that you can monitor your container at the port or trucks at land borders and also shuffle papers at the same time, can you stand the stress of late nights keeping watch over your vehicles and frieght even in transit,do you know how many we get beaten by soldiers,customs and even touts on the road while you, the importer is sleeping in your bed and you'll still raise hell when you wake up to discover some items are missing. I'm still on the road as I'm typing this just because I'm trying to monitor some trucks till they get to our warehouse at okokomaiko and when someone does all of these, you expect the person not to be paid abi? I don't have anything against you bro but as long as frieght moves across our ports and land borders, agents will always be at work, the onus lies on you to look for a reliable one.

So do we have a problem with the system in Nigeria? Yes Government dictates money to be collected, agents make payment on behalf of clients, clients register cars with government, now government is harassing clients all over the country claiming they didn't pay enough or nothing but yet the Government had registered the vehicle. So the problem here is the system created by the government and both agents and customs exploit it why not have duty checked at registration I can buy a car and not pay tax but will have to pay tax to register and get a plate. The idea that government made importation illegal is what makes this corruption flourish. We are backward because we penalize everything that make society flourish. Sometimes you have to see how successful systems operate before you understand why the one you are used to seem stagnant. Remember all these started not because agents are not doing their job but people being harassed for things that has been cleared through all the checks and the final check is registration |

sultaan: That's what you should have stated right from the onset, the system is warped and the corruption started from the larger NIGERIAN society. If people didn't exploit the opportunities they were given,NCS won't mount patrols on the highways and agents won't SHORTPAY . Customs are just using them to raise revenue for the government cos it pays them if you SHORTPAY cos if you're cut, you'll still pay extra with fine into the governemnt coffers,so who loses? In a Nigerian society where people don't even want to pay electricity bills, you now want to stop them from shortpaying customs duty... |

i understand that this post is like 3years old but your information has been helpful. however, i need to know the current duty cost for corolla 2009 and how do i confirm that the custom duty papers are original. I recently got a Toyota Corolla 2009 from seme. and The agent that brought the car to me handled all the paper stuff. Now i need to travel to Benin and i do not want to face any custom wahala. so my Question is 1) How do i confirm that my custom duty clearance is Orginal? 2) How do i confirm that my agent didn't underpay the duty charges? |

Hello good morning naira landers.....A colleague of mine got a 2002 Lexus es 300 from someone.......he got the custom papers verified....chasis no, port of entry, amount paid was found to be correct but the only issue is dat on d custom paper, the car is Lexus es 300 and on their system, it's Lexus es 330....I hope this won't be an issue with custom officials on d road and what can be done to correct this issue....thanks |
