What does it entail to impeach a president?


The procedure for removing the president of Nigeria from office are enumerated in Section 143 of the Constitution of the Federal Republic of Nigeria 1999 (as amended). So far, there is no evidence that the impeachment clause has been activated by the National Assembly.


A Notice of Impeachment requires the signature(s) of at least one-third (1/3) of all the members of the National Assembly. There are 469 members in the National Assembly. A minimum of 157 members of the National Assembly must sign the notice to commence the process.


This must be followed by not less than 10 other steps which must be followed strictly.


Impeachment under the present constitutional regime is a Herculean task. It is not a matter of guts, threats or arrogance. It requires meticulous devotion and compliance to the rules. The procedure listed in Section 143 are in pari materia with Section 188 of the Constitution which provides for the removal of a governor and deputy governor from office.


I can say authoritativelythat over 80% of purported impeachment of governors and deputy governors that have been tested in our courts were decided against the legislature.


The notable impeachment that was sanctioned by the court in the history of our democracy was the case of Balarabe Musa V Auta Hamza (1983) 3 NCLR 229 which took place in the second republic under the 1979 Constitution whose impeachment provisions were substantially altered when the 1999 Constitution was drafted.


The Supreme Court in a number of cases has insisted that the procedure enshrined in the Constitution must be followed strictly. See for example the case of Dapialong v. Dariye (No.2) (2007) 1 All FWLR (pt.373) at 128
It is not easy to impeach the president of Nigeria. The purported moves by some wayward senators can best be described as brutum fulmen (empty threats).

It's funny how we take things at face value.
How did we get here?
A sensible leader looks to carry everyone along so that he can effectively carry out the required leadership objectives.
This coward that overthrew a democratic government but was kicked out of office without a single bullet is the reason for the hardship and confusion in the country today.
1. Only him is causing a rift between the three arms of government with his outright foolishness, threatnening our democracy.
2. Chasing all foreign investors out of the country with his hopeless policies.
3. Created numerous agitations all over the country (IPOB, NDA, etc).
4. A grand patron to fulani herdsmen
5. Chasing his personal and political enemies under the guise of "fighting corruption" - more funny is how some people are swallowing this deceit (the dolt has singlehandedly converted supposedly learned individuals to obvious dundees - or zombies)
6. Bringing back the days of militancy, bombings and kidnapping.
7. There will never be a more hypocritical president in Nigeria
8. Prices of everything we know has sky rocketed
9. Stable electricity has become a thing of the past
10. Unemployment and job losses at a world record high
11. We have never been more divided in the history of this country - we now hate each other's tribes so much!

Buhari even your zombies don't want you to fulfill any promise again. Just restore Nigeria to the way you met it! You are a curse to us!!!

It is IMPOSSIBLE to impeach the President of Nigeria. The provisions of Section 143 can NEVER be met by anybody. Even is 90% of NASS want the President out, they still won't be able to..

let me explain.... To impeach the President the following steps are needed to be followed;

1. Notice of allegation to be signed by at least 1/3 members of NASS S143(2).

2. The Senate President will forward same to the President, giving him 7 days to respond.

3. The President is given 14 days to respond to both chambers, upon receipt of his written response, members have to decide by voice vote whether or not to proceed with investigation.

4. 2/3 members of both Houses will have to vote a YES for the allegations to be investigated.

5. Should 2/3 members vote Yes, the Senate president shall within seven days cause the Chief Justice of Nigeria to appoint independent panel of seven people of high integrity that are not members of the Parliament or any public service.

6. The President shall appear in person or through a lawyer to defend himself before the panel.

7. The Panel shall within THREE months submit their report to both chambers of the Parliament.

8. Should the Panel give the President a Clean bill, The impeachment proceeding is stalled.

9. Should it indict the President, then a vote of not less than 2/3 of NASS members will be needed to impeach the President.

10. In reality, this is impossible.


WHY IS IT IMPOSSIBLE?
Assuming 100% of Legislators are bent on ousting the President, it only take the CJN to either IGNORE the request to setup seven man panel(as requested in 5) or appoint loyalists of the President that will give him clean bill and stall the Process in stage 8.

Assuming the CJN is not a loyalist of the President, the President will only need to 'FIRE'/Suspend the incumbent CJN and appoint his loyalist to stall the process.

The President could as well use soldiers and police to prevent parliamentarians from sitting to even consider it. REMEMBER JONATHAN DID IT TO REPS IN 2014.

In fact, it is IMPOSSIBLE

gud one bro, impeachment isn't pepper soup and pap.dat which is ill planned and exasperatedly executed is bound 2 fail.nigeria is not a banana republic.on d other hand let mr. president and his cabinet be sensitive 2 d plight ,yearnings & aspirations of d masses for it will only take one vote each frm nigerians in 2019 if mr president fail us.
