It was simply because the constitution made it clear only the most senior judge of the supreme court could be sworn in as acting CJN!!! Your dullard had no choice

Those unrepentant sadists who thought his name would be substituted for a Muslim Northerner would be disappointed. I'm very certain he would be confirmed and eventually made the substantive CJN of the Federation. I believe there's a reason he was sworn-in in acting capacity.
Of course there is a reason..........

What section of the constitution makes that provision? Truly, ignorance is a disease that can only be cured by seeking knowledge.
I have already posted the entire section of the constitution relating to that.Do read it up

All is now set for the inauguration of Cross River state
born Justice Walter Onnoghen as the acting Chief Justice
of Nigeria, CrossRiverWatch has learnt.
The inauguration willl be done by President
Muhammadu Buhari today, (Thursday) at 2pm inside the
Council Chambers of the Presidential Villa, Abuja.
Watchers had express worry that hours to the exit of the
incumbent CJN, Justice Mahmoud Mohammed who has
attained the mandatory retirement age of 70, the
President has not sent a replacement to the Senate for
confirmation, sparking fears that a vacuum will be
created in the judiciary.
The National Judicial Council had earlier forwarded the
name of Justice Onnoghen who is the most senior
Supreme Court Judge as well as those of Justice Tanko
Mohammed and Justice Suleiman Galadima to the
President to pick any of the three justices as the new
CJN.

There is no such provision in the constitution that stipulates that the most senior supreme court justice must take over, it is only a tradition that has been adhered to from the beginning. The constitution only mandates that the president appoints a CJN on recommendation from the NJC, and even at that he has the right to reject the nominee and demand for a new name. Guess who was in office 32years ago when the previous southern CJN was in post? Yes Buhari as military head of state.

It is a good move to appoint the new CJN in acting capacity, to see whether or not he is the right person to clean up the judiciary.

Nope, that is not the case in this matter. Buhari sought to abandon the said tradition, at the instigation of some jittery northern judges. Thankfully the outing CJN intervened and common sense won.

With just 11 days remaining to the end of his tenure as Acting CJN, with Buhari still in London till February 6th. We haven't heard anything about the acting president sending Justice Walter's name to the NASS, I wonder what is the government's plans towards this issue. This government loves controversy, someone wants to set a bad precedent
