i think sey na only naija dumb lawyers dey, so UK too get them plenty. Shell HQ isnt within UK jurisdiction, why take your suit to another subsidiary company host nation? I no just understand, the crime wasnt by the the UK company so will the UK court order Shell Nigeria to carry out the clean up or order Shell UK to accept liability. I hope they never pay that lawyer, abi e don see maga wey must pay? |

As a means of funding the war between 1967 to 1970, the federal government reached all kinds of agreements with foreign multi national oil companies that totally sold this countrys energy resources to the oil companies. Some of the agreements are so absurd that you start to wonder how a Nigerian could sign such papers. For instance, even as we speak, Nigerian governments depend on 'estimated quotations' to claim earnings from the oil companies. How do i mean? Simple; oil companies extract oil, load that into oil tankers and then write to the federal government to say that on so so and so date we sold so so and so amount of barrels of oil. Then in most cases based on the quoted number, the oil companies take up-to 60% as their operational charge while we then run our budget with the left over. Many foreign news media houses have characterized this as one of the biggest heist on going in the oil industry. There is no other major oil exporting country that is looted in this way. In-fact countries like Saudi Arabia and co have their oil sector dominated by state owned/indigenous firms. It is only in Nigeria that a state owned oil monopoly kept battling with bankruptcy for years. . What the Niger Delta communities don't know is that the oil companies don't really care about the host communities and their parent countries are in bed with Abuja. All the oil coys need do is to bankroll the campaign of one ruthless ex General who was privy to those agreements that allowed shell and co fund the war and who is ready to use maximum force to maintain peace in the Niger Delta and they are safe. This country has been raped blind. There was a reason why most of these big majors were disposing off their assets during the Jonathan years. The truth is they don't have jurisdiction over such a case. And, this is why they shouldn't have jurisdiction over Charles Taylor's case and all the other Africans being prosecuted at the international criminal court ICC- cum international criminal court for Africa. How about thousands of African soldiers that fought alongside British army in the first and second world war? Don't they also have jurisdiction to repatriate their gratuities and pension earnings? And they are keeping hundreds of artifacts stolen from Africa!!. What right of jurisdiction do they have to keep African artifacts in European museums? As I speak, hundreds of African artifacts are over there crying in British museum. How come they are keeping them; when clearly they have no right of jurisdiction to keep same?? 1 Like |

Truth234:All the aforementioned you listed committed financial fraud by acquiring properties illegally and also proved guilty of money laundering in the UK. So British Court had jurisdiction via location of crime. Not so with Shell. 1 Like |

Truth234:I know, being partly owned by UK and Holland. But its operation in Nigeria takes precedence over what laws exist in the UK. Multinational companies should be tried in international courts or at the municipality of deed. |

When we say, that the greatest problem we have in naija is greatest britain foreign policies, we ca never get justice, but iof it is Ibori, the former Governor of Delta state, they will have juridiction, if it is Okah, who is dieing in South African Prison, they will have juridictions, until the youths realize that we needed to stop the British by dividing the country , if nothing but to stop the age long slavery, people are dieing everyday, be it hausa, youroba and or Igbos, we must stand us to stop them, PMB once confess sometime that British goverment assist to install his goverment, believe it or not, let us stop the tribal sentiment, put our struggle together to move out of slavery quicker, do you know that we can never get justice against shell?, ofcourse, reason being that , another group will definitely spring up to ask for their right and shell, may likely go bankrupt just like Asbestors of US did........... they are smart and they will do anything to protect their own, we can as well kick them out of Nigeria without going to their uselkess court 1 Like |

Truth234:Flat out wrong. UK courts have no jurisdiction over any misdoings or acts occuring in Nigeria!!! All Multinationals are subject to the rules of their domestic countries not their country of origin. And it is Shell Nigeria, remember!!! The UK court knows it cannot enforce its decisions if it went around to try the case. That's the legal summary!!! |

Shell is not liable for those oil spill at all. The law is clear, the ogonis spend decades in a dutch court, they end up settling out of court with Shell without admission of guilt.!!! If the law stipulates that shell should not pay compensations for sabotage, to discourage it, I see no how any community will win such case against Shell in a sensible law court. 1 Like |
