No. They should not give you visa and start treating visitor or resident as petty criminal. Migration is every country bound. You don't wanna know the amount of foreigner coming to work in or visit Nigeria. So it is not a one way street. They make money from visa fees, their operating air carrier makes business and foreigners pay tax too. If you wanna give test. State it clearly in the visa application process and don't delay the person in am empty room to psychologically break him/her down.

I guess you know this is not a first time visitor. He is a resident. Had probably visited the US for more than 50 times. He is a CEO and the co-founder of Tech company. What make you think CEO would pass a technical test. The higher you go, your job becomes talent recognition and management. This guy has been paying tax.
