I Don't Understand This Cabal In The Presidency.

Has Anyone Taken A Moment To Remind Sagay That The National Assembly Is Independent Of The Presidency And Not The Latter's Appendage?

Should The Senate Having Been Given Constitutional Mandate To Act Independently Be Haggled And Bullied By The Presidency Into Rubber-stamp Assembly?

Is Buhari Above The Laws Of Nigeria? Is There Any Remote Reason Why Buhari Will Not Obey One Single Law Of The Land, Effectively Enthroning Impunity?

How Did We Bring These Guys Upon Ourselves?

Nigeria is indeed finished because of people like Sagay. It is a big shame that a Professor of Law cannot advice his principal to obey Court judgements. It is equally embarrassing that a Senior Advocate of Nigeria does not understand the basic tenets of Democracy. Sagay, you cannot threaten the Nigerian Senate!
The Senate shouldn't have dignified this man by inviting him. Nigerian Democracy is under threat by this man.
Sagay, you are ambitious! Ambition is not a crime, but the way you are going about it is going to destroy you. You are an unpatriotic citizen! You are a threat to our Democracy!

You are totally wrong.

Sagay upheld his integrity for peanuts.

There is every pride in supporting Buhari. The fact that you do not support Buhari does not make you a man of integrity,talking only from your own perspective is mischief.

How on earth can a senate abandon its responsibilities to force a president to sack an executive?Very soon they would be passing resolution,forcing the president to sack certain ministers.They can as well take over the role of the president!

Separation of powers has giving the power of confirmation of a substantive chairman,to the senate,whilst the power to appoint an acting EFCC chairman for as long as feasible lies with the president. Section 171 of the constitution is very clear.

Receive some sense!

171. (1) Power to appoint persons to hold or act in the offices to which this section applies and to remove persons so appointed from any such office shall vest in the President.
(2) The offices to which this section applies are, namely -
(a) Secretary to the Government of the Federation;
(b) Head of the Civil Service of the Federation;
(c) Ambassador, High Commissioner or other Principal Representative of Nigeria abroad;
(d) Permanent Secretary in any Ministry or Head of any Extra-Ministerial Department of the Government of the Federation howsoever designated; and
(e) any office on the personal staff of the President.
(3) An appointment to the office of the Head of the Civil Service of the Federation shall not be made except from among Permanent Secretaries or equivalent rank in the civil service of the Federation or of a State.
(4) An appointment to the office of Ambassador, High Commissioner or other Principal Representative of Nigeria abroad shall not have effect unless the appointment is confirmed by the Senate.
(5) In exercising his powers of appointment under this section, the President shall have regard to the federal character of Nigeria and the need to promote national unity.

(6) Any appointment made pursuant to paragraphs (a) and (e) of subsection (2) of this section shall be at the pleasure of the President and shall cease when the President ceases to hold office;

Provided that where a person has been appointed from a public service of the Federation or a State, he shall be entitled to return to the public service of the Federation or of the State when the President ceases to hold office.

Is forcing a president to sack an executive part of Senate independence?Is that not actually a breach of executive independence ?Which law has Buhari not obeyed concerning this matter?

There is no case of rubber stamping here.The senate had exercised its right not to confirm MAGU. President Buhari is exercising his own right to retain MAGU as the acting EFCC chairman,in accordance with section 171 of the constitution.

The senate must first respect themselves. They have power to confirm or reject but could not force president to sack any appointee no matter how.

Rejecting an appointment is akin to saying the Nigerian people doesn't want the said appointee.

The president is answerable to the people as mandated in his over 15 million majority votes,not the senate.The Constitution empowers the senate to only make laws and carry out oversight functions,within the limits of the constitution.!!!!

Oversight function does not include forcing the president to sack an acting chairman of EFCC,(in breach of section 171 of the constitution), in whom he trusts to deliver his promises to the electorates!

The principles of representation should be applied in line with the constitution.The senate is representing the people,in respect of law making and oversight functions only,whilst the president is representing the people in respect of executive functions.

The so called DSS report is a hog wash!

The same presidency had investigated all the allegations contained therein and found them to be non-issue.I am taking you on an intellectual sojourn:

If you were Buhari,which of those allegations that had been debunked by documentary evidence would make you sack some one you trust to deliver on your mandate.

I personally,had digested the hog wash DSS report,the same being recycled many times, and I can authoritatively conclude that the agency should be overhauled and staffed with more professionally minded people.

1.How does Magu fail integrity test by living in a house rented by an agency of his employer(the cost is very irrelevant)

2.How would Magu become a liability ,by keeping official documents containing very sensitive investigative documents,at home,if he felt they could be stolen in the office?

3.How does flying a first class ticket in a personal capacity constitute a fail of integrity test,when no evidence was indicated that the monies so spent was a proceed of corruption.

Does flying a first class imply living beyond his means? NOOOOOOOOOOOOOOOOOOOOOOOOOO......

For God's sake ,read the biography of MAGU. A chartered accountant and ACP,can not afford first class ticket? The DSS must be full of clowns!

4.How does flying in a volunteered Jet ,to save cost,constitute a fail of integrity test? More so when the donor as at then was not under any criminal investigation?

Sometimes I ponder,was this really a security or vendetta report? No evidence of any criminal record,a major issue in any serious security report?

I pause..

The same constitution said the Senate must confirm certain appointees of the President.

must means that if the Senate doesn't confirm the appointee, then the appointment is null and void..

And moreover, when you consider that another appointee under the presidency [DSS Director] in lawful discharge of the duties of his office, said the appointee in question isn't fit for the role he's appointed to.

How can you accuse the Senate of complicity in such situation?

And I wonder where you got "force and commanding" from

Why will the Senate investigate the DSS Report? The Senate doesn't have the vast security expertise of the DSS. so why will it investigate DSS report?

And it's absurd for the presidency to investigate it too. It means the President doesn't trust the work of DSS, an agency under the Presidency. How Ironic?

The president trusts DSS when it indicts people in the opposition. When they indicted and raided Judges, the presidency trusted them. But when they indicted Magu, the presidency stopped trusting them and decided to investigate?

How Wonderful?

And for your last paragraph.. All I have to say is be careful what you wish for. Cos what you suggested in that paragraph is a total destruction of what's left of our democratic institutions.

and that's rather unfortunate
