Read the write up very well. Attorney general never called efcc to withdraw the case rather efcc withdrew the case cos they can't produce witness to back up their claim.

Except we are both reading different reports, I'm not sure I understand your comment. The attorney general already sent a letter saying the so called missing funds ain't missing any more. Oh yes, the ICPC lawyer may have claimed that it wasn't the letter from the attorney general's office that INSTRUCTED them to withdraw the case, but what case exactly would they be prosecuting the man for if the attorney general has already said nothing is missing?

An Abuja High Court sitting at Apo, on Tuesday, struck out six-count charge the Independent Corrupt Practices and Other Related Offences Commission, ICPC, preferred against former Minister of Niger Delta Affairs, Elder Godsday Orubebe over his alleged complicity in a N1.97billion contract fraud.

Trial Justice Olukayode Adeniyi further discharged and acquitted the defendants, after the charge was withdrawn by the prosecution.

Th charge was withdrawn on a day the court earlier gave the anti-graft agency to produce its witnesses to establish that Orubebe, who served under ex-President Goodluck Jonathan, diverted funds meant for the compensation of owners of properties on Eket Urban section of the East-West Road in Eket, Akwa Ibom State.

Other defendants in the charge were an Assistant Director at the Ministry of Niger-Delta Affairs, Mr. Oludare Davis Alaba, and the Director of Contracts, Gitto Costruzioni Generali Nig. Ltd., Mr. Ephraim Towede Zari.

However, shortly after the defendants were arraigned, the Attorney General of the Federation and Minister of Justice, Mr. Abubakar Malami, SAN, in a letter to Chairman of the ICPC, with Ref No. DPPA/MNDA/345/16, confirmed that the N1,965,576,153.46, which Orubebe allegedly diverted, “has not been expended, but is awaiting further contract decisions and directives from the Ministry of Niger-Delta Affairs”.

According to the AGF in the letter that was signed by the Director of Public Prosecution and dated December 16, 2016: “In view of the above, the basis for the prosecution of the accused persons for misappropriation does not exist and thus, further prosecution cannot be justified”.

Though ICPC counsel, Mr. Ekoi Akpos, applied to withdraw the charge, he however insisted that the decision was not premised on the letter from the AGF.

Hater mumu it is an allegation that they pleaded not guilty to,does everyone that gets charged in a court of competent jurisdiction get convicted?. The rule of law has taken it's course,it is quite obvious the judiciary is independent. Nothing to appeal because it was the prosecutor that withdrew the case.

It could mean that they withdrew the case after both parties reached an agreement behind the scene.

It could mean they want to refile a fresh case.

It could mean they realised the man did not actually steal, or he has volunteered to return the money.

Shame to the justice minister who is a quota san. Shame to this lqackluster and incompetent administration. Shame to so many of us who believed this administration was on a total rescue mission. Never again can I cast my vote for a man who has gone past retirement age. I once again apologize publicly for convincing my friends and myself on this government. We now know better. May God keep us beyond 2019.

If out of the several cases EFCC has won- in form of looted funds and properties being recovered for example-, you only pick the Orubebe case to take a wipe at an administration ,I can only wish you good luck!

Your Buhari qualification & level of reasoning is not up to 5% out of 100% of that of Okonjo Iweala. The AGF is the Chief Law officer of the state with power to discontinue any matter before any court at any point before final judgment. No one including the EFCC has the right to appeal that decision by the AGF. The EFCC cannot also file fresh charges on the same matter once it has been discontinued by the AGF, it is by his authority that they prosecute cases in the first place.
