It's non of your business, perhaps the students are aware of the implications of not attending the religious function. The school is a religious setup and runs with their beliefs and principles

the way the lawyers go loss the case like wrapper ehn. seriously the school has its rules and regulations, failure to abide by the rules comes with consequences. most people dont take time to go through the school's handbook, the rules there are evn more stringent that then ones they enforce. Now any aggrieved party seeking redress must first go through the school's handbook before deciding whether the case can be won in court or not

Africans really have a long way to go and religion is the major burden holding us back.

the point the lawyers are making is clear. the rules of the school are not ultimate, the Nigerian constitution is. so in the court of law, it becomes an issue of if the sch rules are wrong, even though the students are signatory to them. so if the lawyers argue in that direction, is going to be difficult for the sch

In as much as I am not happy about their suspension, I think they ought to understand the institution they are in. It is a religious one for crying out loud!!!! If they never wanted all these they wouldnt have applied in the first place. Its COMMON SENSE!! It is a religious school and should be respected and seen as one. You want secularism? Go to federal, State, or other private secular schools like APTI. Its just COMMON SENSE. They werent forced to enroll

A lawyer and President of the Committee for the Defence of Human Rights, Mr. Malachy Ugwumadu, also advised the students to sue the school if they were sure there was no express provision in the school’s rulebook that they could be suspended for up to a year if they didn’t attend the institution’s religious activities.


He said, If there is an express provision that the students can be suspended for a year because they fail to attend an activity, they might not be successful in the court of law.



A Senior Advocate of Nigeria, Chief Mike Ozekhome, appealed to the institution to temper justice with mercy and recall the suspended students, in line with the teachings of Jesus Christ, on whom the school was founded.

He said, “In Nigeria, there is freedom of religion, according to Section 38 of the Constitution. It provides that no citizen shall be discriminated against on the basis of their religion, sex and others. If, for instance, a Muslim was denied admission into Covenant University, they can sue the school.

But once you become a student, you are bound by the contract you have entered into to obey the school’s rules and regulations . The law is called “voluntaire non fit injurie,” which means no person can complain of any harm caused by a contract to which they agreed to.

This is why Nigerian can never progress socially technologically or economically, we treat university student like kindergarten students. Why does the students have to wait for their parents to sue the university, are they not of legal adult age?
I am surprised a SAN like mike Ozekhome can spew the rubbish attributed to him in the article, even though I am not s lawyer, common sense should tell you that you cannot sign your fundamental human rights away.

Section 38 (1) of the 1999 constitution and Article 18 of the Universal Declaration of Human Right states;
Every person shall be entitled to freedom of thought, conscience and religion, including freedom to change his religion or belief, and freedom (either alone or in community with others, and in public or in private) to manifest and propagate his religion or belief in worship, teaching, practice and observance.

And the constitution states that any law that is in conflict with the constitution is null and void, so no document that the student filled can take away their rights of freedom of worship.
Imagine the stupidity of the whole episode, you suspend students because they did not attend a religious program, what will they do if the student should backslide, change church or even change religion.

voluntaire non fit injurie does not apply here as the contract was null and void in the first place. You cannot sign a contract to allow Your head to be cut off. Likewise a contract to sell your children is null and void.

Despite the extreme religious doctrine Covenant university imposes, its graduates are no better than the graduates of other universities in moral uprightness. The reason for suspending the students is flimsy and puerile, though Bishop Oyedepo, chancellor of the university, slaps people at his own whims even in church.
