CAC is basical registering ur companys name.
But what we do at ministry of trade mark is entirely different frm wat is done at CAA.
Trademark registeration deals with registaring the products u sale in ur company.
The name u use to register those products is what is refered to as trademark, wich is a unique destintive name or logo u claim fr ur products n no one else is allowed to use it except u.
For example coca cola is a companys name registered wit CAC, pepsi is a product of cocacola company registered as a trademark in ministry of trade and investment. The name pepsi n logo is registed to that company so no any other campany can use that name fr der products.

The registration of trademarks is in five main stages, viz: Name Availability Search, Acknowledgement, Acceptance, Publication and Certificate Issuance.


​1. Name Availability Search:

​Unlike the practice at CAC, proposed names/marks are not normally reserved as the Trademarks Registry does not have such facility. Rather, an availabilty search will be conducted ​to confirm that such a mark is available at the material time of that search. It then behoves the applicant to take immediate steps to register the name before any other applicant presents a similar name/mark for registration. Otherwise, such a name will remain open and available to any other more diligent applicant.


​2. ​Acknowledgement
If a name is deemed to be available, the applicant will be issued an ACKNOWLEDGEMENT upon the payment of the applicable registration fees. This means that the Trademarks office has received your application, for processing. This takes up to five business days.

3. Acceptance:
Upon completion of the registration, the applicant is issued the ACCEPTANCE indicative that the mark is registered. This process takes approximately four weeks.

The actual registration Certificate will however issue only after publication.

​4. ​Publication
The Trademarks Office publishes all ACCEPTED applications in its Trademarks Journal to enable members of the public react thereto within 30days.

​5. Certificate
The Certificate will be issued if there is no objection to that mark after 30 days of the publication in the Trademarks Journal.
The publication is meant to be done quarterly but in reality, it is done at the convenience of the Trademarks office. Owing to reasons of finance or other constraints, the journal is not published regularly and this may delay the issuance of the certificate for years.

The ACCEPTANCE​ is generally regarded as proof of registration of a trademark in Nigeria. Thus, most practitioners only commit to the ACCEPTANCE stage in order to avoid undue rancour with impatient Applicants over delayed certificates.

Processing to Acceptance costs 35k inclusive of all fees and courier expenses.

Publication and Certificate costs an additional 25k making it a total of 60k for registration in one class.

There are over 45 classifications of Trademarks being a convenient grouping of marks according to the nature of the products from water, electricals to tyres etc. We don't need the technical details here though.

I will therefore advise the OP to do the Acceptance for now owing to his lean purse.

The Trade Marks Act; Chapter 436; Laws of the Federation of Nigeria 1990 provides for Trademarks and Patents in Nigeria. A trademark is a symbol or a sign which differentiates the goods and services of one business from another one. You can register your trademark - a name, logo, slogan, domain name, shape, colour or sound with the Commercial Law department, Ministry of Trade and Investment in Nigeria. This can legally protect your trademark from use by a competitor. The trademark must be distinctive for the goods and services that you provide, not be deceptive, illegal or immoral and not be similar to existing trademarks.


A trademark provides protection to the owner of the mark by ensuring the exclusive right to use it to identify goods or services, or to authorize another to use it in return for payment. The period of protection varies, but a trademark can be renewed indefinitely beyond the time limit on payment of additional fees. Trademark protection is enforced by the courts, which in most systems have the authority to block trademark infringement.

In a larger sense, trademarks promote initiative and enterprise worldwide by rewarding the owners of trademarks with recognition and financial profit. Trademark protection also hinders the efforts of unfair competitors, such as counterfeiters, to use similar distinctive signs to market inferior or different products or services. The system enables people with skill and enterprise to produce and market goods and services in the fairest possible conditions, thereby facilitating international trade.

REQUIREMENTS FOR FILING NIGERIAN TRADE MARK APPLICATIONS

Applicant's details

The full name(s), nationality and physical address of the applicant (to be advised to local Agent/Attorney).

The trademark Information

The Representation must be clear and distinct. If to be filed online, soft copies are to be provided in jpeg format at a minimum of 1200 dpi.

A representation is preferred to have the following dimensions: 120px by 100px (length by breath)

Goods

The full range of goods covered or proposed to be covered by the trade mark. Nigeria presently follows the International Classification of Goods. A separate application is filed for each classification of goods for which the trade mark is to be registered.

Power of Attorney/Authorization of Agent

A Power of Attorney simply signed, with full particulars of name(s), address (es) and nationality of the applicant(s). Full name(s) and capacity of the signatory when applicant is a firm/company.
PROCEDURE FOR REGISTRATION OF TRADE MARKS

The usual market practice is to instruct a local Attorney/Agent in Nigeria, who would file and process applications at the Nigerian Registry of Trade Marks, Patents, Designs and Copyright. A Power of Attorney/Authorization of Agent Form would be completed in favor of such local Agent, as the enabling instrument to act for the principal/ Applicant. Thereafter, all official documents and forms would be submitted by the local Agent/Attorney. Until replaced or substituted by another local Agent, the local Agent remains responsible for processing registrations of the marks, defending Oppositions (if any), provides address for local service of documents, and maintains renewals of the marks. A local Agent/Attorney may be replaced or substituted by executing another Power of Attorney/Authorization of Agent Form in favor of the succeeding Agent. NO formal notices are necessary and the Agent with the more recent Authorization is deemed to be the one with powers to act thenceforth.

After filing the application for trade mark registration, the Registrar issues an official acknowledgement reflecting the official number and filing date of the application. A preliminary search is conducted as to distinctiveness from existing and pending registrations. The Registrar examines the application for registrability taking into consideration possible conflicts with prior registered or pending marks and or inherent

is it not better to keep quiet than tell anybody it will take a month to register a trade mark in Nigeria and that it will take 30-40k?.if you get it registered within 6months for 300k ,u are exceptionally lucky.

It depends on the product you wish to trademark.
The last time I trademark my branded car battery,
I paid N5000 for search, N17,500 for filings. I then tip a staff N5000 for speeding up the process. This happened in June 2016. You may need to pay more if the three names you initially submitted is taken or unavailable.

If this is it then I'd like to know how. I went to the Ministry of Commerce, Trade and Investment in Abuja only to be told that...

1. N1, 500 for name search
2. N50, 000 for trademark
The man I met said N15, 000 is official fees and I asked about the remaining N35, 000, he said it's processing fees. And the good part, it won't reflect in the receipt save the N15, 000.

Please help a brother.

That will be a lot cheaper for you.
As a lawyer, I will never charge less than 30k for Acceptance. So she appears your best bet considering​ your limited budget.

the truth is it takes about a month to get ur acceptance. and i will like to state that we do the following,
Trademarks, designs and patent registration. which are all different with diff pricing. for patent, there is local n foreign.
but the topic for discussion is TM and that is the pricing.

the payment is done in skye bank in the Ministry s account, but before payment you do the search which is also paid there. after u get the report n its free then you make an App ication and fill form 1, form 2 authorization form and bromide page if it has a logo.
