Or how can a sovereign society dictate to another sovereign society how to make their government. excanny: They do because the victim is in the United States. Ex, if a US citizen was the victim of torture abroad, the US courts has to somehow redress the issue to protect it's citizens. I don't know how they'll enforce their judgment if the defendant has no interests/property in the US. Google the "Torture Victims Protection Act" and "Alien Tort Claims Act" 5 Likes |

abbey621: Not entirely true. The Alien Tort claim act offers some sort of relief to individuals in incidents that happened outside U.S soil; think the case of Ken-Saro Wiwa's descendants v Shell. However, the circumstances have to be "exceptional". Besides, the requirements to be met before relief can be granted are exceptionally high. On the face of it, this seems to me like a waste of the court's time. 2 Likes |
