poseidon12: The US judiciary is independent of individuals, but their verdict can be predicted by their ideology. The judicial process may be slow and there are several layers of appeal in the US, the travel ban has not been killed, so any verdict by a lower court is not in itself a total victory to be celebrated. 2 Likes |

jumobi1: That is the only act that matters in terms of criminal charges but in terms of civil lawsuits then the tort act applies but will be dismissed because the plaintiffs did not meet the prerequisites! |

jumobi1: We are saying the same thing, both acts are civil suits but only one of them have ever been applied as a precursor to a criminal case brought before ICC. As a lawyer you should be quite aware of how the ATS is perceived in the international community. This is why I mentioned in my initial post that the district court won't get Biafrans what they really want and that is criminal prosecution. |

jumobi1: I work in the insurance industry and my mentor is a Judge, we also recently had 2 cases involving our international business partners and these acts. It's not that both can't be applied but they have different conditions which makes one easily applicable than the other. I keep telling them on this forum that it is even harder to apply them to a democratic government |

It is because you often digress by going off on an unrelated tangent, that is diametrically opposed to the topic under discussion. The issue being discussed is NOT how ethnic groups came together to form a nation. The issue is your ethnic group's desire for a referendum and their clamour for secession, as well as the way they keep expecting other ethnic groups to do their dirty jobs for them. You chaps want a referendum. No problem. But there is a stipulated process that you have to follow in order to get it. Let your SE senators, House of Reps elected members at federal and state level move the motion for a referendum in the legislature. Simple. That is how most countries have done it. And that is how Scotland did their own. I repeat: a Welsh or a British MP did NOT do so for the Scottish. Why is that so hard for you to understand? And why are you talking about how Scotland agreed to be part of the UK when they signed the 1707 Act Of Union? Was that the question you were asked? |

laudate: You were the one who used Scotland as an example of how to go about getting a referendum and all I did was explain to you why the Scottish example does not apply to Biafrans. Scotland formally agreed to be part of Britain in 1707. They agreed to a marriage. That is why they had to seek a political way out when they sought a divorce. Igbos on the hand never agreed to be part of the union of Nigeria, they never agreed to a marriage. So how can Igbos be asked to go through a divorce process when there was never any marriage? Nigeria is the illegal creation of the white man and unless you can show that Lugard went to a national assembly to create Nigeria via a democratic process, dont ask Igbos Biafrans or Igbos to do the same to get out of a union of Nigeria which they were forced into against their will 1 Like |

Instead, are are going to use civil disobedience, protest, non participation in elections and other peaceful and legal means to put pressure on this government to conduct a referendum in the lower Niger. 12Monkeys: And here we go again..... This country has almost 100 Federal Judicial Districts and each State/Territory had at least one District Court. Depending on the size of the State there can be as many as 3-5 separate District Courts in it. Take New York State for example, as small as the Boroughs are, there are District Courts in Manhattan, Brooklyn, and Whiteplains; and we haven't yet started talking about the ones upstate in places like Albany, Rochester, Buffalo etc. Then if we move over to bigger states like Texas, California etc You get the point now don't you? I think its a Nigerian thing to try and bamboozle people. Its just the same way your politicians seem to have succeeded in keeping your whole society in bondage. 1 Like 1 Share |

Ispiksdatroof20: As an AUSA, you are a criminal prosecutor. Claims under the TVPA and the ATCA are usually civil matters and don't involve federal prosecutors. I'm no expert here but I studied the TVPA hard in law school. |
