The federal government itself withdrew charges against Kanu at a lower court, submitting to the court a decision to pursue the case at a higher court. As such Nnamdi Kanu was discharged by the judge because the government had no case against him anymore before that court.

Or can an accused be discharged even before the examination of evidences and interrogation of witnesses?

The same government prosecution that withdrew the case,then filed the charges at a higher court, and Kanu was granted bail having filed for one. The federal government simply tabled more charges and he was retained under arrest till he finally got bail for the current charges against him.

Kanu's actual trial is yet to begin under any court, hence could not have been acquitted of charges that are still pending before the judge.

The federal government is not prosecuting Kanu in ECOWAS court, as such ECOWAS court cannot grant bail to an accused that was never brought before it for justice by the prosecution.
