In June 2013, Goodluck Ebele Jonathan proscribed Boko Haram as a terrorist Organisation. This, he did, without any recourse to the High Court as most people would expect; and reasonably so.

There are two sections in the TPA act that may be deployed into making such declarations: Section 2 and; Section 9.



The TPA act makes provision for the declaration of a group as being a Terrorist group on a number of grounds.

It is very easy to refer to[b] Section 2 of the act[/b] which makes provision for a process that involves judicial processes, procedures and pronouncement. Most applicable to local terrorism.

However [b]Section 9 of the act[/b]makes express approval for the executive arm to immediately declare a group as a Terrorist group. This is specifically in relation to international affiliations and sponsorship.

In the case of IPOB, there is reliable Intel available to the Nigerian Army suggesting the foreign links and backings of IPOB to certain international terrorism networks.

The move by the Nigerian Govt. is therefore in order and can only be upturned by any aggrieved person who takes the matter to a court of competent jurisdiction. In the mean time, the declaration remains in full force and anybody (either physically or over the internet), found to be soliciting for a terrorist group may be found culpable.

The President of the Senate, Sen. Bukola Saraki in a press
release this morning addressed the recent crisis
orchestrated by
Operation Python Dance. In his 10 point statement I have
taken two to dwell on.
Those rejoicing that IPOB has been proscribed and declared
a "Terrorist Organisation" this is what Saraki, the chief
lawmaker of the Country had to say and I quote:
"I also wish to state that the announcement of the
proscription of the group known as Indigenous People of
Biafra (IPOB) by Governors of the South-east states and the
categorization of the group as a 'terrorist organisation' by
the Nigerian military are unconstitutional and does not
follow due process. Our laws make clear provisions for
taking such actions and without the due process being
followed, such declaration cannot have effect. I am sure the
President will do the needful by initiating the right process.
This will go a long way in demonstrating to the world at
large that we are a country that operate by laid down
process under every circumstance. So, those who have
been hammering on this point should maintain their cool".
IPOB has a nuisance value. Their agitation is moral and
their cause is legitimate. Though, their methods may be
questionable. The message is more important than the
messenger!
However, I am more interested in his promise to institute a
NASS investigation into the perfidy carried out by the
Nigerian Army.
Quote again:
"I want to also make it clear that the National Assembly
intends to embark on a fact-finding investigation aimed at
determining what actually happened during the period of the
military exercise in the South-east. We want to be able to
sift the facts from the fiction and determine who did what. It
is quite clear that all the facts are not yet known. We
assure Nigerians that there will be no cover up. We intend
to lay the facts bare".
If this is done and appropriate sanctions carried out to
whomever is found culpable by either the army and/or the
various state governments then justice will have been
served for those senseless killings.
However, I am aware here is Nigeria and as usual nothing
may be done to those found culpable.
But posterity awaits.
One day in the future their crimes will catch up with them.
Tomorrow is pregnant.

“Notice is hereby given that by the Order of the Federal High Court Abuja, in Suit No. FHC/ABJ/CS/ 368/2013 dated 24th May, 2013 as per the Schedule to this Notice, the Activities of ‘Jamaatu Ahlis-Sunna Liddaawati Wal Jihad and ‘Jama’atu Ansarul Muslimina Fi Biladis Sudan’ are declared to be terrorism and illegal and that the existence of Jamaatu Ahlis-Sunna Liddaawati Wal Jihad and ‘Jama’atu Ansarul Muslimina Fi Biladis Sudan’ are proscribed, pursuant to Section 2 of the Terrorism (Prevention) Act 2011 (As Amended).

Above was the proclamation made in 2013 by the Federal Government proscribing Boko Haram after it was designated as a terrorist organisation sequel to an order of the Federal High Court.

Today, people like Cacawa2 are telling us that due process and the rule of law was not followed under Jonathan's regime in the proscribing of Boko Haram as a terrorist organisation.

Tell me how does the activities of IPOB amount to act of terrorism? I wonder how a reasonable person in his right mind would compare IPOB with Boko haram. IPOB doesn't kill, they do not bomb, neither do they engage in the act of kidnapping nor destroy properties rather they embrace peace, negotiation... I wonder how seeking for equity, fairness and justice for your people becomes act of terrorism

The Section 2 you quoted is talking about Group while Section 9 talks about individual.
The declaration by Defence Headquaters is null and void
