When you join a record company as an unknown artist your bargaining power, knowledge of copyright law and power to retain legal representation is diminished. Mostly because of a lack in finances, knowledge of the industry and a capitalist record label that's out to milk you or at least make the most profit out of you. Same in other businesses. They give you a contract to sign with many appendages. They may tell you it's a 10million contract for 10 years. You've never earned a dime. 10million sounds like alot. Let's break that down. They give you a brand new car, clothes, bling and a new crib. That's 6million gone. They pay for your studio sessions, hotel bills and flights, then pay to promote your music. That's another 7 million gone. So before you get a hit, they'll tell you they've spent 13milliin on you. So technically you owe them out the door. So paying you 50k per month and still covering your current expenses will be presented to you as a favour. An overdraft so to say. A number of international Artistes went through this, Tupac, Kci and Jojo, Mariah Carey at the beginning of her career etc. The record company has made you sign over your earnings, copyrights & royalty and writing credits forever. It happened to Nina Simone. So if you want to go into any venture where someone else puts up the money but you bring your talent to the table, the first step is: 1. Get a good legal representation. Not just a cookie cutter Lawyer but one specialized in your kind of business (copyright, mergers & acquisition, oil & gas etc) 2. Request for any legal documents to be mailed over to you and your lawyers for a review. Never sign a deal there and then if you've not yet studied the fine print. No matter how juicy it sounds. Of course you should also not miss out on opportunities, so learn about the legal aspects of your business and find out what international best practices entail and look for them in your contract. For example always try to be a co-writer in every song you perform (even if it's just one line), keep a good portion of perpetual royalties for yourself, retain copyright to every work you create or co-create. An example is Michael Jackson buying the rights to the Beatles catalogue. He told Paul McCartney who thought it was a joke. Today his estate still enjoys the royalties even though he is gone. 3. Live frugally. Most times when you get a company credit card as part of your contract and you go splashing or popping champagne, all these gets deducted from your future earnings. Which might be negative and you end up owing your label even after having very visible hits 4. Try win-win negotiation tactics - You must show the record company or investor in any kind of business that they have something to benefit from you also. You can use staggered earnings. For example if my record does not become a hit we call it even. Or if I make above 10million which you've invested, we share earnings 70-30 etc. 5. Know your worth and give it a real monetary value. You must know that your talent on the table is as good as the cash the investor is bringing. So your 10million is not better than my talent, gift or business idea etc. For example Mark Zuckerberg was the idea, his room mate and the Winklevoss Twins bank rolled his idea. But he got to keep majority of the stakes. Always think in this light when negotiating. Don't short change yourself. Money is not the most important thing in the world, it is ideas that help you get that money. Even an inheritance is easilly frittered away with with no good ideas. 6. Don't mortgage yourself long term Try out a contract for 24 to 60months first. No matter how poor or desperate you may be at the time. As it progresses, your success can give you a renegotiating power or you can quit to pursue other things if it doesn't work out. If legally you signed a stiffling contract, the court will uphold it. But the court can also say it was done out of malice and you didn't get adequate representation and might excuse you from you obligations. OVA200: I've said it here a million times already how the labels hire cars and houses for them to flaunt but no one believed me. The labels assist the artists in perpetuating the myth of succcess so they could charge more for shows. |

almarthins: Wallade: We should be reasonable, he is crying foul now because of greed, if he wants his contract reviewed he should dialogue with his record label, when he started this journey there was no complaints about him being paid 30k, even when there was no hit he was paid every month, now him don see money wan bite the finger that fed him, he must have knelt down begging for that 30k initially, now they've made him and he's now bigger than G worldwide, same issue with harry song, when these celebs are hungry they tend to be very loyal but when small money start to set in na then you go see their real self, all I'm saying is he should review the contract not dump his label till the stipulated years or agreement is complete. |
