Hi guys

Earlier in the thread I informed the house that my wife's application was refused citing authenticity of the marriage- no pictures etc which was due to VFS not accepting pictures with paper applications. I requested the GCMS notes and the first VO stated that the applicant qualifies for work permit. The last officer to check access the application refused citing the reason above. With the information from the GCMS notes i decided to reapply attaching as much pictures(someone suggested printing the pictures in an A4 paper) On the day of submission, the vfs officer refused to accept the pictures again until my wife caused a scene showing them a copy of the gcms notes where it clearly stated that the previous application was refused due to lack of evidence of the marriage. Eventually, they made her sign a waiver and accepted the pictures from her. To my utter dismay, exactly one month, the application was refused and this time the VO stated that she needed to show strong finances showing she will be able to take care of herself in Canada. Quite shocking. So i reapplied again, this time online and clearly stating and copying where the CIC website that states that for an open work permit, the spouse should present a valid work permit , with validity for at least 6 months- current letter of employment stating responsibilities and the job must be in Noc A O C and 3 recent pay slips. I carefully explained in my letter of explanation that i will be responsible for her upkeep and have attached my bank statement.

Applied online NOv 24, got an update yesterday requesting for passport and on mycic it shows application approved. Note medicals havent been done which is quite a surprise but anyways thats the good news.

I just received email from CIC stating that my application has been updated, then when i logged in to myCIC account just found this " We are reviewing the results of your medical exam".

But i have never done any medical yet. So, what do i do?

have determined that your application does not meet the requirements of the Immigration and
Refugee Protection Act (IRPA) and Immigration and Refugee Protection Regulations (IRPR). I
am refusing your application on the following grounds:

Eligibility for a work permit in this category only applies to the spouse or common-law
partner of a work permit holder who is doing work that is at a level that falls within National
Occupational Classification (NOC) skill levels 0, A or B.

You are welcome to reapply if you feel that you can respond to these concerns and can
demonstrate that your situation meets the requirements. All new applications must be
accompanied by a new processing fee.

We got married February this year and my wife went back a week later. It's straining I must say.

I'm sorry for the sad news. However, all hope is not lost.
Please give us more information. Does you wife has a study or work permit? Although, from the reply it looks like she has a work permit. Please check this link https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/express-entry/become-candidate/eligibility/find-national-occupation-code.html , you need to verify if her present work falls within the NOC O,A, or B.

She should apply for pnp. When she gets nominated, you could then apply. You could also apply for visitors visa

@ChrisBanksO suggestion is great if she qualify for such.

She can find job that falls within O, A and B or starts a graduate program.

Or you find a graduate or professional study too

I submitted my wife's application in July, biometric on 17th , no update yet. In addition, application processing week is now 18 weeks.

Hello House,

     I'm new on this platform. Kudos to everyone who has contributed to peoples journey in one or the other.

I want to share my own journey with you as I am confused on what to apply for right now. I need your contribution so I can get it right this time around. Many heads are better than one.

My wife studied in Canada and during the course of her study, she came home and we got married , she gave birth in Canada. Right after that,I applied for a Temporary Resident Visa (Visitors Visa) and I was refused.

My wife and my son came home afterwards and after so many consultation here and there,I applied for an Open Work Permit because she was still in school with a valid Study Permit.

After 7 months of waiting. We had to write them about the status of the application and to my surprise,I was REFUSED again after the third day we wrote them. You can imagine this.

We had to request for GCMS note and the reason for refusal was :
1. Personal Asset and Financial Status
2. Family Ties in Home Country and Canada

At the last page on the GCMS note, the officer stated that : I gave birth to a child in 2015 in Canada and this is a strong factor for me not to come back home after the permit expires. This is my reason for the refusal.

I also got to know on the GCMS note that my file was updated in July after submission in June and nothing happened till January again which is just 1month left for my wife's study permit to expire. I guess this is an intentional act from this people.

Now,my wife has gotten 3yrs Post Graduate Work Permit. So we've been thinking if we should reapply for the SOWP again or PR?

I know PR processing takes longer time and SOWP can be fast at times.

I need advice house on what best application I can apply for at this time. Living apart from family hurts so bad. May God grant us all our heart desires.

Sorry about all these issues with CIC... It happens quite a lot especially with TRVs...

My best advise is for you guys to start your express entry process for PR...In my case, it took me less than six months from creating my an express entry profile on June 24 2017 for my spouse to land in Canada on Dec 13 2017 - despite passport renewal and other medical issues in between.

Before the PR we had applied for visitor visa for my wife twice and SOWP twice and each of them took at least four months each and one took close to six months. I hired lawyers in between that filed an appeal/redress, one of the immigration lawyers reached out to the VOs in Accra and Lagos and even I personally wrote a letter to the Minister of Immigration or whatever to express our anger.

From the GCMS notes, I noticed that once you have been refused once or twice, your chances become slimmer with your subsequent applications. They will look for any reason to deny it - I have a feeling that they become risk averse until you present a solid case or hold your ground if you have time. Our fourth denial, the VO initially said that we did not include proof of relationship and that our marriage was fake. Subsequently after providing pictures and everything all over again, the VO came back and said that the pictures are not the same people on our passports. Bear in mind that all of these denials took over 2 years since 2015.

Except you want to risk the time and money wasted between the stupid back and forth with VOs who don't follow or just ignore rules, I will advise that you switch to EE. It is straightforward, easier and you jump straight to PR status as opposed to waiting for work permit.

PS: Someone replied from the office of the minister of immigration saying that they understand my situation and anger but there is nothing they can do about it. The VOs have the absolute power to accept or deny an application. The same person went ahead to congratulate me before hand that my express entry has been approved weeks before it showed up on my profile.

sorry about the refusals. I have also had two refusals. After the first refusal i aplied for gcms note and the vo thought the time my left on spouse study permit wasn't long enough which i didn't see as accurate considering he'll be gettng a PGWP. Applied second time with a study permit valid till 2020 and still got refused, didnt bother asking for notes again though.
I've switched to EE and I'll advise you do same. It's more expensive in terms of fees but as long as there isn't any misrepresentation or you're not inadmissible to Canada for any other reasons, you'd get it at the end of the day. Plus in instances where VO may be confused as regards your application, they will request for additional documents to clarify whatever doubts they may have regarding your application. Aometimes raising a CSE can reopen your application even if it is refused especially in cases where VO was wrong.
SOWP might have an official processing time of 18weeks but going by information on this thread it is taking several months to complete, and your EE might not take that long as applications are now being processed faster than before.

I just checked CIC website and it says 28weeks.
Hubby says online is better but I m confused with everything I have read here.

Did anyone get a mail from CIC requesting job description info about their spouse's employment? I know of three people who got the same mail on the same day(yesterday).
