The President still has powers to retain Magu in Acting capacity ,in accordance with the constitution which is superior to the EFCC act.: 171. (1) Power to appoint persons to hold or act in the offices to which this section applies and to remove persons so appointed from any such office shall vest in the President. (2) The offices to which this section applies are, namely - (a) Secretary to the Government of the Federation; (b) Head of the Civil Service of the Federation; (c) Ambassador, High Commissioner or other Principal Representative of Nigeria abroad; (d) Permanent Secretary in any Ministry or Head of any Extra-Ministerial Department of the Government of the Federation howsoever designated; and 1 Like |

This is just politics+legalities. This is not a case the FHC can handle, the best any party(executive or legislator) that wants the true legal opinion of the court can do is to seek for constitutional interpretation of the powers of the president in nominating/appointing for offices not listed in the constitution for nass confirmation at the supreme court. Any other thing na noise, the president will continue to keep magu, the nass will continue to reject, and none can hold the other, they are all doing their job in their own view. 2 Likes |

deomelllo: Since you are talking about the constitution, it does not also states the timeline a presidential appointment must take before confirmation, since the president can keep sending same name, they can also leave the names unattended to till the last day of the assembly.. Everybody get their own power. So the president should not even waste his time sending names for confirmation, the country will be on standstill... Afterall, they even claimed they don't need senate confirmation after their name has been rejected... The senate under the leadership of Bukola Saraki is the best thing to ever happen to Nigeria politically since 2015, if not buhari and his cabal would have turn Nigeria to a banana Republic.. Ordinarily Law is law and should be obeyed, legislators is there to check excesses of the executives, the biggest thieves are in the presidency and not senate. This magu that you are shouting, how many cases has he won? How many of those senators has he jailed? Is DSS, the agency that wrote report against him too under the Senate, or their DG is under probe by magu. DSS and efcc are under presidency, president nominates and an agency under it blocks the nomination and you are blaming the senate... Oga, drink water... 2 Likes |

Wone quesion abeg, is there any EFCC head that has not been haunted? Especially by looters in this case led by Saraki. Where else in the whole wide world would somebody of his character even have a say, not to mention him as the leader of the Senate. |

Lifestone: 1. The president via the Nigerian constitution to nominate candidates 2. The Senate gets to approve or reject candidates nominated by the president 3. The with his or her power to nominate candidates, he or she can keep renominating the same candidate since there is no law that says the president can not renominate. 4. The Senators know quite well that based on the Nigerian constitution, they can not prevent the president from renominating the same candidate. 5. The lawmakers have to go back to the drawing board and amend the constitution and EFCC act to insert a clear reference that says the president can not renominate until they do just that, they are just wasting their time and the president can keep renominating. 6. The president is renominating the best man for the job based on his rights to do so, but the Senate led a senate president and members with criminal cases at the efcc are trying to take away that right based on faulty and bogus reasons. You and I know the reason why they are rejecting Magu and the reasons are corrupt, self-serving and frivolous. 1 Like |

Furthermore, is there any law barring the President from using "acting" chairman for EFCC. Magu is "acting" for now & can continue in that capacity as long as the law permits. The president of animals kingdom, will never understand the rule of law. I pray comes 2019, let the successive incoming government to go deep with no friendly and families sympathy and probe this corrupt till the dust of their feet and bring them to justice. Enough of Buhari's corrupt family members and friends turning Nigeria into a zoo/animals kingdom. I can't believe some Nigerians think politicians obey laws. Murderous tribalist buhari will just ignore the ruling. Why can't they appoint an Igbo to head the EFCC? Because they know an Igbo man will actually do the job well. The real reason northern thieves don't want an Igbo man there is because he will arrest most of them. 90% of corruption in this country is perpetrated by the north!
