2005 - I applied for a UK student visa but was refused due to insufficient funds and low WAEC grades. 2006 - Changed my name and DOB; got a new passport and applied for another student visa in 2007 and by this time, the UK had started taking biometrics as part of the application process. I was caught and presumably banned for 10 years. The passport used was not returned back to me as they believed that was not my true identity. All these I did as I was ignorant and just despirate to have a bright future, which I am already having without stepping out of Nigeria. All my siblings eventually left Nigeria in the struggle and live in US, Canada and France; I am the only one left here for now
Fast forward to 2018, I have since graduated from Uni and now working as an analyst for an Oil Company.
Now, I have a fiancee who is settled in the UK and who will eventually be a British citizen in 2019. We plan to get married next year and I am planning to apply for a spose visa. I will declare my previous applications, including the change of name and biometrics, which I believe would now have been deleted as it is over 10 years; however, I am sure there is a likelihood of a refusal under section 320 but I will appreciate if there's someone who has such experience and who can share what they did. I work full time and I earn a considerably huge amount of salary. I also have a business and few properties and can show a genuine bank account with good cash flow and a balance of over N40m; my fiancee also earns over £30k yearly, so finance is not an issue. I am confident that I would normally meet the requirements if not for the refusals and ban which happened over 12 years ago.
Going by your experience guys, what do you suggest? You believe your application history would be deleted? Show me a flying pig, I would show you a pink elephant.......... I was saying that my biometric data might have been deleted but I know the details of both applications would be retained and I will be as honest as possible. I am informed and now a high profile professional so I won't make that stupid mistake again. Are you 100% sure that my spouse visa application will overrule section 320(11)? |

Going by your experience guys, what do you suggest? Lexus is very very correct. A few people here got bans but still scaled through and are with their partners right now. So you have nothing to worry about, just ensure you don't lie about anything this time around and include your refusals, heck you can even include the touching story of wanting to find greener pastures if you want to emotionally blackmail the case officer However, I am curious, are you sure you want to leave that wonderful job of yours to join wifey? cos you make it sound like you are stresslessly earning more than a mill per month, trust me, you will work for that mill here! So think well cos its not easy to have a husband that will be too upset/proud to work in care or retail while waiting for his oil job.. Wish you the best in your application. Going by your experience guys, what do you suggest? I suggest you stay back there in Nigeria and continue with your successful job and business. You can always visit Uk and go back home. Allow your wife to get the passport and she can relocate to another country where both of u can get married easily. With such amount of pay in naija, UK will not smell my leg... 1 Like |

Spouse visa overriding previous immigration crime is not 100% true. Right to Family life cannot be denied (within reason)..... We have seen applicants on this thread with similar issues and spousal visa was still issued (at either 1st attempt or upon appeal)...... All he needs to do is open his book, confess, plead and promise to be of good behaviour, going forward......... So what do you suggest? His wife resides in the UK, while he sticks to residency in Nigeria (wife running over, when catarrh is almost blocking his nostrils)? 2 Likes |

You know that means close to nothing, right to family life makes sense on paper but realistically people still get deported leaving wife/gf and kid in the UK. He should apply and own up to his previous immigration issues but what i'm saying is that the idea that spouse visa forgives all previous offenses is largely untrue, there are consequences for such crime and we should not give people false hopes. 1 Like |

I know they took the passport back , but I wanted to clarify that the new passport he is using has genuine date of birth . As long as he is using genuine details and puts on his application why he was denied earlier I don't see why not he wont get a spouse visa. I would prefer he tries a normal visiting visa first as that we be a good test and you know the result within weeks . Minnienellie24:

I was on this platform and contributing but got discouraged when my questions weren't getting answered, moreso I was and still sad and depressed. they were refused cos the ECO felt they weren't my kids despite all evidences submitted. Donnurudeen: Good morning house. My spouse a British citizen receive 17,590.00 annually. She has a child from a former relationship and she recently claim child maintenance to commence April 2018. Please with child maintenance of 250 pounds monthly plus her gross put together, can we apply for the spouse visa after six(6) month of receiving it. Alternatively, can you please tell me how long she needs to receive child maintenance to be use for the application with her annual salary as a permanent employee. Thank you Have you read the rule regarding those on benefit and spouse visa application? |

We applied for settlement visa. I provided pictures from birth, naming, birthdays, baptism in the church, infact all pictures, birth certificates, school receipts from when they started school, school reports, graduations pic,awards etc. ECO actually made an error in the refusal letter that we made the application in the Gambia instead of typing nigeria and said he/she isn't sure am their mum cos I didn't register their birth with census immediately after birth meanwhile I didn't register immediately too for the 3rd girl and she was granted, she is 4 years old while the others are 10 and 8years old. Immediately we got the refusal, I went for Immigration purpose DNA be4 coming to the UK so I have that on ground. justwise:

That is the right cause of action you have taken, i can't really see anything wrong with your application considering what you submitted Reapply with the DNA result. |
