Thank you Justwise for your reply. I had wanted and still want to reapply (priority this time around) but i need to retrieve the Tb and english proficiency certificates back because without them i can not reapply. My wife was told that she needs to present the TB certificate (which was valid at the time of submission and now has expired because of the long wait of the appeal) to get a new one at the clinic specified by the Homeoffice.
No i have not used their email services but that is not a problem to get to use it.
My wife is writing them a letter today, asking what is delaying the appeal. We feel also we should write them to suspend the appeal and for them to return the documents. Hope these are in order? Awaiting your response. Thank you.quote author=justwise post=68913668]

Honestly i feel your pain, this is the frustrating thing about tribunal cases because there is no timeline and the waiting is endless sometimes.

How about reapplying and deal with the reason(s) of previous refusal?

Regarding those documents you just have to keep emailing and calling them, have you paid for their email services before?

Damn, I can't even imagine how frustrating the wait will be without any meaningful update from the tribunal/home-office.

But on a side note:
1. Is the applicant in possession of his/her passport?
2. If the previous TB certificate (6 months validity) has expired, why not just go get another test done and get a new certificate.
3. (caveat) I did not write the English test but is there no way to get another copy of the certificate? I saw this somewhere online:
Candidates who wish to use their IELTS result for immigration purposes
If you wish to use your IELTS test result to apply to Citizenship and Immigration Canada (CIC) or United Kingdom Visa and Immigration (UKVI) you can request one additional copy of your TRF from your centre (two in total). Proof of your application to CIC or UKVI will need to be provided.

My guess is, if you have these three documents then you should be able to reapply while waiting for the tribunal.

Please @justwise and others in the house, I need your help urgently.... I'm married to a U.K. Citizen and we did the marriage here in Nigeria at ikoyi wedding registry... it's now time for me to apply for settlement visa.. but the problem is that my wife work as a personal instructor in the gym and also for private clients but as self employed and no p60 but she pay her taxes and also declare her yearly income too... please my questions are ...1. What type of documents can she summit instead of p60? Or can she get p60 as a self employed?
And another issue is that I stop school for my business here in Nigeria and never get the chance to complete my uni...just want to know of that will be a problem or I'm good to go...the third question is that.... she no get payslip but she can get her statement of account and also sometimes she collect cash from her clients..please what can we do?

Ask her to contact HM Revenue & Customs for her p60 or any document that will state clearly her gross annual income.

Normally you receive that after April 5 of every year.

Another you need to do is to google UK spouse visa financial requirement and read Self Assessment section of that document, it tells you everything you need to know.

I don’t think they care about whether or not you have a degree certificate. They just want two things from you:

1) to prove that you will be able to get a job here so you don’t have to touch public fund.

2) that you speak and understand English well. I’ll just believe that you typed in a hurry, if not, you might want to work on your writing skill (that is if Writing is part of the English exam you will need to write).

I can’t answer about self-employment but to make the gurus answer faster, you should write how much she earns per year.

Thanks @Aphrodite007 I'm really sorry about my write up. Was in a rush to put that on here. Please what document do I need to show,to make them believe that I will be able to get a job when I get there?

If I recall correctly, you will have to fill out PART 3C of the Appendix2 form, either category F or G whichever applies to your sponsor. Read through the financial requirement document APPENDIX FM-SE to get all the information you need on how to present your financial information using self-employment option.

But reading through your message it seems like some of her income aren't documented (guessing). If yes, even though you can still put everything together nicely it might be advisable to consider waiting for say 6 months to 1 year before applying. This gives her the opportunity to sort her Tax clearance (if you are self-employed I do not think you get a p60 rather you have to do self assessment tax return. YOU SHOULD RESEARCH THIS HOWEVER) and also start to document all her income/receivable by ensuring she deposits in the bank whenever she gets paid for at least 6-months before application (although 1 year might be appropriate for self-employment). I KNOW THIS IS ASKING FOR TOO MUCH but this option is only useful if she cannot adequately proof all her income at this stage and it will help save you from wasting visa fee.

Side note, your education shouldn't be an issue but it might help your application if you have a way to proof your employability or entrepreneurship.

I will let the guru's respond however.

Sincerely I do not think you should worry much about yourself (not to say you shouldn't...lol),but most of the scrutiny is on your sponsor. All you (the applicant) need to do is to just complete the application form adequately, there is a question about your employment where you can put in information about your self-employment.

Do you think running an unregistered/unregulated shop, is an illegal activity?

If you think it is an illegal activity, how can you provide details from an illegal activity to support a legal application?

The long and short of this matter.... Tell her to put her financials in order.....

Payment of cash in receipt of services, is an illegal activity....

If she is still self employed, as my Oga's have eluded to. She needs one year to organise all her documents and apply on the 13th month (for reference)......

Did she issue a VAT receipt?
Did she issue a receipt after receiving cash?
Did she declare the cash payments?

The legislation does not implicitly make it illegal, but loads of factors to satisfy to make it legal....

Good day everyone.
I just did my biometrics, but they didnt take the full application form, just the first 2 pages of it and my passport.
Do I have to DHL the signed application to hubby? Or I can just scan it?
Confused.

DHL it to him or to Sheffield (whichever way both of you planned to do it) with all other supporting documents with you.

Yes, you should DHL every single supporting document including the signed application form and applicant's introduction letter to the Sponsor for onward transmittal to Home Office. (Scanning might work but since you are sending other documents such as TB and Test certificates to her, why not send the original copies to prevent unnecessary hiccup)

Remember to use a checklist to confirm all your submissions, see sample below of the one we used. All the best.

Hi oxygyne.

Thank you for your reply and the checklist, very helpful.
He has ALL the supporting documents including TB and english language cert. Its just the supporting letter and application form(thought it will be taken from me in VFS center) he doesn't have. Was just wondering if someone on here has scanned before and it was fine. As its weekend the courier companies wont deliver till Tuesday.

Not giving any guarantees, but here are the alternatives that might work:
1. I filled out my form on my computer (using Adobe Acrobat Pro) and inserted my signature electronically and sent same to UK for printing.
2. I also have a high-resolution scanner that makes it almost impossible to detect the difference between the original and the scanned copy.

I think any of these two options should work but hopefully, someone who submitted a scanned copy will respond soon.

For the supporting letter, you can scan that no issues I believe but make sure for the application form you get a clean and clear scan.

Seeing as you don’t have a degree, there’s no document to show this. You just have to explain your handiwork or business you own. I believe you are working in Nigeria, yeah? If you work in an office, your work experience will suffice but if you own your business just get your papers (everything about your business together and submit to them). If you are an artisan, that will be excellent cos they actually like artisans here, you will only need to boast about your years of experience.

It’s kind of like a tough area seeing as there’s no degree, but these people don’t care too much about degrees, they just want to know you can work and are willing to work when you get here. So package a letter/portfolio to show your skills to them.

Hi everyone,
I got to the UK yesterday and the immigration officer asked quite a number of questions. He asked me when and where I got married, how I met my husband,if I had resigned from work in Nigeria and if I planned to work in the UK,if I already had a job offer here, where my husband works and what he does there, then he asked me where his office was located. Well,I knew where he worked but didn't know the location and I told him so. He didn't seem too pleased that I didn't have that info. He then told me to try and get to Southampton by Monday to pick up my BRP. Na so I run leave am o,before he'd look for something out of the blues to ask.

It doesn't matter what qualification or no qualification the applicant has. HO only cares about the sponsor. They don't care if the applicant doesn't work as long as the sponsor meets the financial requirements. All this talk of portfolio or business papers are irrelevant and I am talking from experience. You only need a portfolio when you get to the UK and are applying for jobs or looking for clients.

Except you are applying for a Tier 1 visa.

Bro don't worry about company documents or what not. Just worry about your sponsors documents, your English result, TB certificate and relationship evidence. You can include your 6 or 12 months bank statement if you want but not relevant. I had a registered business in Nigeria with accounts and everything but I only submitted my personal account statement which was also outdated by a few months before my application and was successful last year August 2017. The Home Office is only concerned about your sponsor and if they can still take care of you even if you don't get a job in the UK. The Home Office doesn't care if you don't have a degree. That is only relevant when you are looking for work in the UK.
