As someone said, maths is your friend. They should sell the land and share the proceeds according to the proportion each person contributed. The guy who paid 70k will get 23% Of the 100milla, I.e 23million naira while brother J will get 77 million. 7 Likes |

Dyt:1.Going by the post, the senior brother claims that the money( the younger brother's contribution) was part of the money he borrowed to him. 2. Knowing on all terms he is at disadvantage(in terms of contribution, name on documents and all), he should have looked for more subtle ways to go about it rather that opting for an outright land dispute. |

Greed on both sides! Well, since each of the two agreed on the money each contributed to it, regardless of names on the document, I think they should share the land according to their input percentage. Whoever can build a house on his, let him. Whoever can build a shop on his, let him. These people are brothers bikonu, they could just sell and share the proceed based on percentage contributions. From a legal perspective the elder brother may be awarded full ownership of the land if he does a change of name to 'JOHN IKENNA EZE'. Secondly, there is no joint signatory in the land documents (the elder brother is the sole signatory). I also believe the documents did not state that the land belongs to both brothers otherwise both brothers should have signed. My advise: The younger brother should persuade the older one to sale the land since it has appreciated over 33,000% over time and share the money in the initial contribution ratio. Question: Who is in possession of the land documents and does the other person have a copy? The person in possession may falsify the documents to favour him before the court case (if taken to court). |
