If his lawyers can prove that where the vehicle broke down,there was nothing they could do to move it from there and also what if if the driver had put all the necessary C caution at a reasonable distance and had gone to get tow trucks to tow the tanker to a safe place or indeed if the driver had notified the authorities and was just waiting for help to arrive ??
Just thinking aloud cos I think the govt just wants to dish out news that is music to the ears of the people

If he has comprehensive insurance and the driver has valid licence, then his lawyers will blame it on mechanical fault.
I suspect they didn't get help from the govt agencies (LRU,LASTMA,FRSC and even the Police) who all incidentally are always stationed or moving around the vicinity of the accident

It stalled in the number 1 lane (where it should not be in the first instance). Lost air brakes and rolled backwards on an elevated structure.

Was the owner not provided with a certificate of road worthiness? Who issued the certificate when the vehicle was not road Worthy ? If there is anyone who is to be tried for crime, it is the government officials who issued certificate on a vehicle they never tested to see if it was actually road Worthy. If the owner can provide the certificate of road worthiness, he is as free as air.

Stop using sentiments. Yes on what ground. If VIO and FRSC that sees those trucks plying everyday without seizure due to lack of road worthiness, have not been disbanded, the owner of the truck has no business with prosecution.

Curse the government that is meant to make environment safe and yet failed. A country where there is little or no commitment to development.

That is , if he had used the vehicle when it had been declared not road Worthy by the government. However, if the government had issued a certificate of road worthiness and this thing happened, it will be judged a mere accident. Nothing more nothing less . Let the VIO always test vehicles before issuing certificate.

Providing a certificate of road worthiness won't set him free, it will only implicate the corrupt official that certified the vehicle as road worthy.

Exactly. Misplaced priority in fact the owner should sir them for bad road and expired vehicles(molue) on Lagos roads

I've been expecting a law suit against MOT, as they are presumed to have certified the road worthiness of that truck. They failed in their responsibilities and this is the result. The victims suffered as a result of the failure of MOT and the vehicle owner. Although, it would be difficult to establish a liability against the vehicle owner, under certain principles.

It stands in the court of law, This is where the directors or BOSs are responsible for anything that happened btw his/their company and MOP. if the court finds out that they bridge safety regulations and me n u know they did then they are in for it. However its the state V them, so nah heavy case. This is how society adjust everywhere, something happens and they get dealt with others learn from it, heard this line ** Lesson would be learnt***
PS as for all the IFs,all they need do is check and audit the vehicle inspection and safety check.

No one is disputing that but does it answer the question?

We have recorded uncountable road accidents in this country due to bad roads...has the government taken any drastic measures in mending them? In fact, it is on record that the drivers are always the culprits even in instances where the road was the cause.


The government is not proactive, they just wait until something terrible happens before taking 'some minutes' action and that is it.

If a vehicle is not road worthy, whose duty is it to keep them off road?

If the road is not car worthy, whose duty is It to mend it?


If a driver is not 'road and car worthy' whose duty is it to keep them off. In fact, we have more insane drivers than off road cars but yet they are licenced to drive...who gave them licence?

Am I the only one who sees how Lagos state has cleverly positioned itself to make money out of this disaster?

MOT from any state is valid all over Nigeria but now Lagos wants to monopolise the document and attached fees on all petroleum tankers nationwide. If nobody takes them to court over this scam, they will soon extend the brazen theft to all vehicles that ply Lagos roads.

i work in the downstream oil and gas industry, for an oil major. most of the majors have very strict regulations about the vehicles they use. there are internal investigations and remediatios when there are accidents.unfortunately, the wishy washy attitude of dpr, mot, etal means that it is an all comers affair with all sorts of dangerous vehicles that should be on the scrap heap

if this had been a total, forte, oando , mobil , bovas or some other vehicle, th same people making all these defenses would be calling for their heads. most of those companies invest significantly in safety so that things like this do not happen.

this incident should be a wakeup call to the need for serious regulation of commercial vehicles

The owner of the truck has to be held responsible because he hired the driver (which I am so sure is unlicenced to drive the truck in the first place) that caused the unnecessary death of so many.


Someone who survival the unfortunate incident said the truck driver was avoiding a commercial bus carrying passengers in a place that wasn't meant for that. If the bus driver was not in the way the accident wouldn't have happened. Such drivers are everywhere picking passengers randomly posing a threat to lives and property like that which happened recently
