Now they ask women or family applicants if you intend to give birth or see a doctor or if it purely for visit and I think that response is recorded somewhere and can be revisited at renewal or POE. That I have heard often that the record is and can be pulled out . So i think your comment is based on not understanding the process now at the US embassy in Nigeria for women who go return with a baby. If you understand it trust me your comment will be different .
Lawyer maybe you are adjusting status or something but lawyer for visiting b1b2 .... even the lawyer won't answer you . Visiting visa is at a VO discretion .
From the statement she was pregnant when she applied, probably even visible. ...from the second visit I gathered that the question was asked explicitly the first time .. although it doesn't say purposely lie so I give that to you. It wasn't hinted That's the whole point of all my comments. There's no proof that they lied. The whole judge, jury and executioner responses so far is a little overreaction. In fact, as a defense, they could say if they were really up to tricks, they wouldn't go back to Nigeria. They'd remain here illegally and keep abusing their visa terms. Saying to visit a lawyer now is for legal advise and how to go about things not for lawyer to follow them to the interview in Nigeria because like you said, it's not allowed for b1/b2 and all that. VOs and IOs are trained and excellent at their jobs but I promise you they aren't gods. They make mistakes too and they don't know everything. Many IO's decisions have been overturned after a Lawyer challenged their decision. Finally, laws/rules are written in a technical way. You'll see things like "applicant who at the time of the interview, knowingly and deliberately tells the interviewer something untrue" or something along those lies. Can anybody here prove that the above happened? I can't. Unless they are inadmissible, for things like visa overstay, misrepresentation and the likes, their case is not that bad. Just a quick reminder, OP never said his sister was asked whether she was pregnant or not which would have been an issue if she lied about being pregnant. Let's assume the pregnancy was obvious and they told VO they wouldn't be visiting a doctor here, nobody here can say with authority when the decision to visit a doctor in the US and have their baby here was made by the couple. It could be anytime. If the law says they should inform authorities of change of plans, then you're right. They should have (again, everything has a defense). The law says people should inform immigration, dmv, etc. Of address change within 10 days of moving. Many people don't even do that. Thanks for the healthy exchange of opinions. I hope OP is learning from back and forth dialogue and the right decision is made. 1 Like |

Congratulations bro. Can I send a private message. I am interested in pursing my masters in software engineering Lawrence2291: Finally, collected my passport today. I thank God for making this new adventure possible despite my lack of faith. Also, a BIG THANK YOU to every person here that responded to my worries after my interview and to all who took out time to provide people with all they need to know towards a high visa issuance success.
I had two interview
First Interview: June 30th 2018 - Denied I was interviewed by one young white lady that never sits down in Abuja
Here is my transcript
VO: Your passport and i-20 ( She can't even greet like I'm her mate) ME: Passed the document VO: **Starts typing** what's your intent? ME: Pardon VO: What's your intent? ME: Pardon ( I started thinking if I was deaf or my village people remembered me that day) VO: What's your intent? ME: I plan to pursue my masters in computer and information science with a specialization in (cuts me off) VO: How many schools did you apply to? ME: 4 VO: Name them? ME: Mentioned all 4. VO: Who is sponsoring this program? ME: My Uncle. VO: Hand me the pink paper saying Sorry, you are not eligible for the nonimmigrant visa to which you applied. The paper contains the reason for denial and you can reapply at any time after your circumstance has changed blah blah blah
Second Interview: July 25th 2018 - Approved I was interviewed by one white guy in Abuja
Here is my transcript
VO: Your passport ME: Passed it VO: Your student visa application ME: (Confused what he means and stared at him while waiting for possible clarity) VO: Give me your i-20 ( In my mind i was like, is i-20 that hard to pronounce? Why complicate things) ME: Passed the document VO: You were denied visa to Canada few years ago, what happened? **Sets his hands for typing** ME: (I dreaded this question being asked.. Was banned and rendered inadmissible to Canada) Yes, I was denied study visa because ( cuts me off while nodding his head ) VO: **waits for a long while while typing** Where did you do your undergraduate studies? ME: **So So** University India VO: How much did it cost you? ME: 5000usd yearly exclusive of living expenses. VO: Who paid for it? ME: My Uncle VO: **waits for a long while while typing** what are you going for now? ME: I AM going for my masters study in Computer and information science with a concentration in information technology at etsu VO: I see you got scholarship, who is paying for your living expenses ME : My uncle VO: oh same Uncle that paid for your undergraduate study? Me: Yes ( At this point I felt a positive vibe of visa being approved) VO: What does he do? ME: He own a company where he deals with computer support and sale of computers and office equipments. VO: **waits for a long while while typing** how long is this program? ME: Roughly 2 years VO: **waits for a long while while typing** what is your plan after graduation? ME: After my studies, I plan to return home and with my updated knowledge on the latest practices of software engineering and network and information security apply for senior level position in my current company or seek for research intensive IT position in government agency like NITDA ( I expanded it). I plan to work for maximum of 5 years in this position while setting a stage to running my own IT company where I'd be dealing with creation of new generation secure and dependable enterprise systems to power most businesses in Nigeria while offering employment opportunities to Nigerians who wants to make a career in the field. I believe my program would help me achieve this goal. VO: **waits for a long while while typing** What proof do you have that your living expenses would be taken care of? ME: I have my sponsors personal and business statement of account. VO: Give me his personal statement of account. ME: I passed it VO: I will be approving your visa. ( Passes two white papers). Paper contains how you will get back your passport and what you need to know before travel. But I'd hold on to your statement to run a thorough check. If found fraudulent, you will be deported even if you are in the states. Should I proceed with it? ME: Sure no problem. VO: Once again congratulation and have a great time in your Masters study. ME: Thanks I appreciate. Bye Went out dumbfounded and unable to contain the possibility of getting my visa despite my Canadian ban. But God made it happen anyway.
To the travel hopefuls Nothing is impossible. Prepare well and be very confident till the very end. Whatever will be will be 1 Like |

Congratulations Anahi: Visa approved on the 4th of august 2018 after first denial, really grateful to God and everyone that has contributed on this thread.
For my first interview, I honestly wasn’t as prepared as I thought, I actually felt like it was going to be very easy to get.
Worst thing after the denial was when I tried to book an appointment and it just seemed impossible. The frustration was not here at all! Imagine the number of times I called them and they kept saying the same thing. My account was even frozen multiple times due to constant checking but thank God that’s all history now.
First interview transcript on the 23rd of may, 2018 VO- Why are you going to the US . Me : I'm going for my masters in Industrial Engineering at texas A&M - Kingsville VO : Why Industrial Engineering Me : - (I think i said a lot of rubbish here) While working as a research assistant at **** and undertaking engineering projects, I realized that optimization would be required to reduce wastages and bla bla.. (i didn't make any sense, trust me) VO : What kind of research do you do Me : We research on Manufacturing systems, sustainability...(vo cuts in) VO : How many schools Me : 4 schools VO : Name them Me : Texas A&M, Purdue, Penn State, Stevens’s institute VO : Why Tamuk Me : Tamuk offers a specialization in sustainable manufacturing which is in line with my career interests and I was also awarded a graduate scholarship which made it more affordable for me VO : Did you take GRE? Me : Yes i did VO : Can I see your report? Me : I don't have it there with me VO : But you know you should have it with you, Me : I'm sorry i actually didn't know... VO : Any relatives in the US ? Me : Yes, My parents and sis, VO : What are your parents doing in the US? Me : My parents are permanent residents (lol, my mistake, i was tensed at this point, that was obviously not an answer to her question) That was it! She said the usual then said the reason is not because I forgot my GRE report but she feels I have too many ties to the US
2ND interview on 4th August 2018
Interviewed by a very friendly white man at Walter Carrington, Lagos VO – Good morning how are you doing? Me: (Smiles) Good morning, I’m doing great, Thanks VO – Can I have your passport and I-20 (Passes them) VO - What school are you going to Me - Texas A & M Kingsville VO- And what course? Me - Industrial Engineering VO - Oh. What was your undergraduate degree and which school? Me - I studied Electrical and Electronics Engineering at Covenant University VO- (Smiles) Great! I think Covenant is one of the tops schools here, they have very good reviews (I just kept on smiling and nodding). How was your stay there, did you enjoy it? Me - Yes I did VO - Even with rules and regulations? Me - Oh that wasn’t a problem for me at all. VO - (Just laughing and typing stuff) What do your parents do for a living Me - My dad is a medical doctor, he works with ***** and my mum runs her own business, she has a farm and – (cuts me off) VO - You said you were going for mechanical engineering? Me - No it’s industrial engineering VO - Okay. I can see from your past transcript that your parents are legal permanent residents but I really don’t care about all of that Me - (finally relieved cos that was my greatest fear), thank you VO - Does your dad live in the us? Me - No he doesn’t , he’s a medical doctor here in Nigeria, he only goes for holidays VO - What are your plans after masters? Me - I’ll come back to Nigeria to start my career as an industrial engineer and hopefully work in companies like General Electric, P and G.. (VO Cuts in) VO - (Keeps smiling) How did your parents get their green card? Me - I really don’t have all the info on that. VO - (Laughs) Look, I will be issuing you your visa anyways I just want to know that’s all Me - I’m really not so sure VO -Did anyone file for them Me - Probably my sis VO - (smiles) Oh I see she’s a citizen. Me - Yes she is VO -(chuckles) Alright before I issue your visa, why did your parents leave you here, I mean they could have filed for you too Me - It really wasn’t priority for me then and I didn’t think I would be going to the us VO - Do you have statements? (Passes them) VO - (points at the bank logo) – whose account is this? Me – It my Mums VO - She lives in the us ? Me - Yes. VO - Oh what does she do? Me - Sorry, I meant to say no, she’s there for holiday currently, She is still running her business here in Nigeria VO - Oh she’s the one with the company Me - Yes (looks through statement for a while) Me - (I was a bit tensed so I shouted) – I got a graduate scholarship so I would-( vo cuts in) VO -(laughing) No need to stress I’ve already approved your visa just checking for something Me - (Smiling) Okay thank you VO - (picks up white paper) will you be living with your sis? Me - At all, she stays in a different state VO - Let me explain how this is done, you are to have your passport, I-20 and sevis payment, make sure they are together, makes sure you study hard cos it’s not always so easy, enjoy your stay in Texas. (passes white paper) pick up in 3 working days. That was it people!! God showed me undeserved favor Special thanks to tolatof, Mackynaija, monoemeks and everyone that contributed in one way or the other.
Lesson learned: There is nothing wrong with overpreparation lol. Whatever you can do to boost your confidence please do, also don’t be over confident. Pray also for God's favour. It’ll be well for all of us.

I'm not sure you read his post before replying because you seems to be playing along with some sort of theory as if you are creating your own narrative.
One of the VOs here has written at length about this type of situation I even copied and attached it to this thread https://www.nairaland.com/4250945/give-birth-usa-cost-procedures.
This is a very common situation with many Nigerians traveling to US for child birth.

While I'm not a lawyer or expert in cases like this, I just wanna give you my 2 cents. This may be a very unpopular opinion but hey, it's just an advise, so feel free to ignore it.
The law is not a black or white thing. This is why for cases you're not sure of, the advise is primarily to consult a lawyer. You'd be surprised how easy it is to get through situations that look super complex to the ordinary eye.
That being said, IMO, there is absolutely NO beyond-reasonable-doubt proof that your sister or her husband lied to the VO during their first visa interview. It's not like they have proof of a conversation they had to support a preconceived plan to do the above. People change their minds all the time. People come here just to visit for a week, meet a girl with asss so fat, decide they're not going home again, marry the girl and apply for GC, say their plans changed after they got here. Oga mi Sir, they get their GC.
In your case, maybe your sister and her husband honestly had no intention of having their baby here or visit the doctor. Suppose I were in her shoes, and I woke up one day with blood coming out of me, you think I will risk my life and die because I told one VO that I won't be seeing Doctor? No sir, I will call 911 if needed and get the best treatment and that's not a crime.
This case is not as impossible as it looks, and also you didn't tell the whole story. If they paid all bills out of pocket or whatever the case is, tell them to take all relevant documents along on their next visit to the embassy. He also has to state clearly that "No Sir, we didn't misinform the previous VO. Things happened that way because..."
If the matter pass you, your sister abi her husband, consult immigration lawyer. Better one o, not 200 Naira lawyers under bridge in Ikeja. But if I were you, I'd handle this myself sha. It's not a big deal.
Disclaimer: This is not legal advice. Please consult a lawyer for legal matters. Please do I need to pay another sevis fee if my visa was denied and I want to reapply ? |

Sorry to be harsh but it all this that makes it difficult for others... if she knew she was pregnant why did she lie during the visa time . Almost everybody know the embassy keeps record so the next visit your history can be flagged up . It a technology age so there is no point lying at any time.
To be honest nobody has the answer to bold above.... the mistake has been made and it really up to the VO at the time of interview . The best he can do is show all the evidence that the hospital was paid and hope for the best Please do I need to pay another sevis fee if my visa was denied and I want to reapply ? |

AusterHeights: After two denials, finally got approved by Window 21 today. Thanks to everyone who took out time to respond to my enquiries. This is one of the finest communities on the internet.
My advice to anyone who has been denied in the past:
1. Never give up. Just think of each obstacle as a temporary setback. 2. My average GPA and extra year didn't stop me from getting a partial scholarship - took GRE and TOEFL though. 3. Pay close attention to your financial documentation 4. Don't try to be 'too' perfect. "Too many lies spoils the soup". Not having to lie would probably give you peace of mind to sound confident. 5. F1 interview is just a conversation really. Don't cram stuff. No VO wants to interview a 'robot'. 6. I think there are no rules to this thing, work hard towards what you want and just leave luck to heaven. Congrats, Please do I need to pay another sevis fee if my visa was denied and I want to reapply ? |

Please do I need to pay another sevis fee if my visa was denied and I want to reapply ? No... You don't need to pay another sevis fee as far as the one you paid is not up to 365days |
