Please read again and this time slowly,

Clause 19 of the 20th February transmission States:

“Section 49 of the Principal Act is amended by substituting for subsections (1) and (2), new subsections “(1)” and “(2)” –

“(1) A person intending to vote in an election shall present himself with his voter’s card to the presiding officer for accreditation at the polling unit in the constituency in which his name is registered.

(2) The Presiding Officer shall use a Smart Card Reader or any other technological device that may be prescribed by the Commission, for the accreditation of Voters, to verify, confirm or authenticate the particulars of the voter in the manner prescribed by the Commission.”

Clause 17 of the 27th June transmission adds Paragraph 3 to the above which reads

"(3) where a smart card reader deployed for accreditation of voters fails to function in any unit and a fresh card reader is not deployed, the election in that unit shall be cancelled and another election shall be scheduled within 24 hours.”

Finally, it is the withholding of Assent by Mr. President to the latest transmission of August 3, 2018, which excluded the card reader provision that has now preserved the card reader and given opportunity and vent to the National Assembly to admit the card reader provision, when reconsidering the Bill, in her absolute legislative discretion.

Where is August transmission?
The Senate and House sent a bill to you in February and June and included Smart Card Reader and curiously in the August amendment, the card reader was allegedly omitted and you failed to tell us how the new section was drafted and you want us to believe that the reason you declined assenting it was because of card reader, somebody should explain please.

Press Release: Card Reader Not Included In Electoral (Amendment) Bill Transmitted On August 3, 2018.

Per the release I issued on September 3rd that Mr. President has withheld Assent to the above Bill forwarded on August 3, 2018 and praying that by convention the content of Presidential communication to the National Assembly should not be fully released until read on the floor, speculation has been raised that '' card reader'' provision is one of the issues that determined Mr. President's decision.

For the avoidance of doubt, I hereby state expressly that the card reader Provision addressed by section 49 of the Principal Act was Completely, Expressly And Unequivocally Excluded And Not In Anywise Part Of The Provisions Of The Bill Forwarded To Mr. President on August 3, 2018 and could therefore not form part of the consideration of Mr. President.

In the communication of Mr. President to the National Assembly on the Bill transmitted on February 20, 2018 and the 2nd one transmitted on June 27, 2018 to him for consideration, there was no mention of card reader as subject of infraction nor reservation in any manner whatsoever, although there was provision for card reader in these two previous Bills which were now expunged by the National Assembly in the August 3, Bill transmitted.

For further clarity, the Bill of 20th February had 43 Clauses, and the revised Bill of 27th June had 41 clauses. The current further revised Bill of 3rd August which now excludes the card reader has just 15 clauses in the absolute wisdom of the National Assembly and Mr. President has no constitutional or legal authority to add or remove any provision to or from what the National Assembly has transmitted to him.

APC n deceit, ifthe card reader is so important why did thethe president refused to sign the earlier bills with its provision?, the simple truth is APC/buhari are not interested in alterations to the electoral laws for now no matter it short comings, they view any alterations now to be against them n will always come up with all sort of excuses real or imaginary to avoid it,so all these explanations are balderdash.

Explanation is simple.

The senate or its representatives drafted the bill and not the presidency.

The bill is drafted in a certain format which the presidency did not demand for but was done solely at the discretion of those who drafted it.

The Presidency has said that the first 2 bills had the card readers included and the last one in August had it removed.

I believe those who drafted it thought they could fool the presidency since they had already included it the first 2 times which the presidency had seen so they felt they could mischievously remove it this third time with the hope that it would not be noticed . They were wrong.

The Presidency has denied the inclusion of the card reader in the latest bill sent and have kept their own copy of what was sent to them. It is now left to those who drafted the bill to prove otherwise by showing their own copy.

If the Presidency admitted to the card reader being there the first 2 times, why would they deny the 3rd time?

My conclusion is that those who drafted this wanted to pull the proverbial " the more you look, the less you see" on the Presidency. The omission of the card reader in this last bill is true and was deliberately done. QED.

If the card reader is not Included In Electoral (Amendment) Bill, what stop the Presidency from amending it and forward to the legislators if they are keen in improving on our electoral act. All this blame game and shifting the post won't help anyone.

The President can only suggest to the national assembly but can not alter bills or law emanating from National Assembly. in fact his best is to withhold is assent.

the FG dose not want to sign this bill hence coming out with all these excuses.

they are simply looking for ways to use the incident form by which they can massively rig the election.

Nigerians must rise up and pressurize the president to sign this bill into law such that we have a smooth and transparent election.


That excerpt was from the initial bill transmitted to the Executive in February. Read the report from the beginning, you will understand better.

If the electoral act under which the 2015 election was conducted and which allowed the usage of card reader has not been repelled since the one sent to the president as amended is yet to be assented to....it then holds that the electoral law under which the previous election was conducted still subsist since it has the provision for card readers....so what then is the controversy all about?

The presidency never claimed card reader presence/absence was the reason the bill was not given presidential assent.

This press release was just to clear the grounds on the rumours that it was because card reader was there that made PMB not to assent the bill. They are now telling us that the card reader provisions were not even there!

My brother the alarming rate with which the youths are loosing the culture of reading is disturbing. Even the few who read still find it hard to understand what they read and misplaced pride would not allow them ask for clarification before they start wailing.

I read with amazement how some people read and comment on this forum. One of them, called "Whitebeard" said the Nigerian army is backward when a Nigeria soldier's picture, carrying radio communication gadget, made front page here sometimes ago. He said the army should be using smart phones in Sambisa forest. You can imagine!

Besides, this is the 3rd time he is withholding his assent without making any input to it.

The reason adduced forvwithholding assent always state the reason which are the inputs you are talking about. This is not an oversight on the part of whoever drafted the Act but intentioned to cause chaos. But PMB always meticulously read before signing and with PYO to advise him.
