INEC Under APC is a Sham and Professor Mahamood is simply an APC Bingo with no credibility whatsoever .
Where on earth in our Laws can a Chairman or REC or returning officer unilaterally deduct votes already announced for a political party, that privilege belongs to the courts.


Osun Election INEC contradict itself over inconclusive.

In the last APC Lokoja /Kogi by-election won by APC the following happened
The Returning Officer, Prof. Rotimi Ajayi, who announced the results as follows said

APC 26, 860 votes.
PDP 14, 845 votes.
Votes different: 12,015
Canceled vote: 19,960 (17 polling units)
Valid votes : 48,165

The Candidate of APC Alhaji Haruna Isah, was declared winner of the Lokoja/Kogi House of Representatives by-election.

Today Osun State Election was declared inconclusive.

Difference between APC and PDP =353
Cancelled (4 Polling units votes) =3498

Election declared inconclusive!

Is INEC electoral guidelines is selective? The chairman and electoral commissioners are APC Bingos



ON INCONCLUSIVE ELECTION
The results of the just concluded election showed that APC polled 254,345 while PDP polled 254,698. This ipso facto means the candidate of the PDP polled the majority votes. The difference therefore is 353. INEC now says in as much as the difference between the cancelled votes which is over 3000 is more than the difference-353, then he cannot declare the candidate with highest number of votes as the winner.
Section 69 of the Electoral Act 2010. It provides;
"In an election to the office of the President or Governor whether or not contested and in any contested election to the other elective office, the result shall be ascertained by counting the votes cast by each candidate and subject to the provisions of sections 133, 134 and 179 of the Constitution, the candidate that receives the highest number of votes shall be declared elected by the appropriate Returning Officer."
Section 179 of the 1999 Constitution applicable to the instant case and the PDP candidate has satisfied the provision of 1/4 of all the votes cast in each of at least 2/3 of all the local government areas in the state.
Therefore the decision of the INEC is not grounded in law. They should as a matter of urgency declare the candidate with the highest number of votes elected.

In a bit to rig the APC component of INEC were ignorantly relying on their 2015 guidelines which appears contrary to Constitutional provisions on this matter. It may make sense if the votes involved are in relation to centers were elections were not held due to no fault of the voters.

However, were elections were held and votes are cancelled, they remain cancelled.

They ought not to form part of the counting process and should not influence the outcome of the elections for any reason whatsoever. In Oshiomhole vs Osunbor & ors, cancelled votes were added to PDP’s scores. All the courts held that cancelled votes had no role to play in an election. The votes were deducted and Oshomhole was declared winner of the election. Why is INEC giving so much priority to cancelled votes on this occasion.
Prof Mahamood is an APC dog that Must never be allowed to conduct the 2019 elections!!!!

2015 in Kogi, Abubakar Audu (APC) scored 240,867 while
PDP scored 199,514 votes.
There was a Margin of 41,353 votes in APC's favour.

However inec ruled the Result as Inconclusive.

Valid point raised here but i suspect that the news agency you quoted made mistakes.
Details of the election results are very few and there were a lot of inconsistencies in the figures.

LP – 90

MPN – 50

PDP – 14,845

SDP – 2,916

The numbers does not just addup...

What many do not understand is there is a big difference between canceled votes , that is, invalid votes cast and canceled elections . No matter how high the figures for invalid vote cast, it will never affect the outcome of election results but canceled elections from PUs or invalidated election results due to irregularities are critical to the electoral process and result announcements.

That is the same thing he saying about INEC chairman, because APC wanted Bello who didn't take part in that election they didn't announce the result so that Faleke will not take over after the death of Audu, instead inec chairman connived APC to bring Bello in from nowhere as candidate to run inconclusive election

What many do not understand is there is big difference between cancelled, that is, invalid votes casted and cancelled elections. No matter how high the figures for invalid vote casted, it will never affect the outcome of election results but cancelled elections from PUs or invalidated election results due to irregularities are critical to electoral process and result announcements.

Exactly and INEC already gave reasons for the rerun because there was no voting in one polling unit, manual voting in another, over voting on another etc. These are solid grounds to declare inconclusiveness of this election especially when there is such a small margin of leading votes given to Adeleke which is far less than the total vote counts of the places affected.

Osun State election have proven to the general public that INEC is not independent, they are the working tool of APC. Their plans to rig the election failed so they ended up saying it is inconclusive. Whether INEC and APC like they should cancel the election, Adeleke will still win the election in the re - run.
