Read here on Nairaland a few days ago that one fake prophet (some sentimental Nairalanders believe he is the real nigger) foretold that Omisore would win Osun governorship.

In 2015, the Late Abubakar Audu of Kogi State was leading by 240, 867 votes to PDP 199,514 votes, the margin of 41,353 favoured APC but it was declared inconclusive.

Rerun was fixed because 49,953 canceled votes was higher than the 41,353 despite the fact that APC was leading with what is called a giant margin! Nobody shouts rather we waited patiently for the re-run date!. I hereby employ PDP to do the same for democracy to work perfectly in Nigeria.

Coalition here, alliance there... and everyone seems to have forgotten APC is the incumbent government at the state in question.

It would have been better for PDP to win outrightly at the first opportunity.... but for anyone to think APC will miss this golden second chance I don't think it will be possible.
This election will be tougher than the whole state election held on Saturday

The only trend and influence in these Osun elections is money. Most comfy zones were dismantled. My won local govt used to be highly pro PDP, but APC won it marginally. The 'see and buy' was the reason Adeleke polled so much. He 'basterdized' money, according to some agents.

I wont be surprised if each voter got as much as 10k to vote in this rerun. Poverty has battered some Nigerians to submission.

Unfortunately,apc won in all the ife lgas except in ife central where omisore's influence is great.the over 1000 voters in ife south and not may not be omisore's fans.it can both go to any side.orolu is an apc stronghold ordinarily,pdp won there due to largescale vote buying.since yusuf lasun lost there,he will want to make it up to apc and win it.osogbo is also mostly apc.what is making pdp to be ahead is the bloc votes from ede.
In any way,apc can win by 200 margin in osogbo,100,in ife south,100 in ife north and share orolu with pdp.pdp can also do same,its very open.lets wait and see

Will make this as brief as I can while ensuring facts are not traded in exchange.


What's the actual position of the law?

Pursuant to pages 22 – 23, Paragraph 4, Section N 2015 INEC Guidelines issued pursuant to Section 153 of the Electoral Act, 2010 (as amended), INEC is empowered to declare election inconclusive where the margin of victory is less than the number of registered voters in cancelled Polling Units.

This power of INEC to declare an election inconclusive under the above provision has been upheld by the Supreme court in the case of Hon James Abiodun Faleke v Independent National Electoral Commission & Anor with the appeal no: SC. 648/2016 delivered in September 2016.

One of the issues for determination was whether the court below was right when it held that the 1st respondent acted correctly in applying the guidelines in the Manual for Electoral Officers (updated version) to resolve the conundrum that had arisen on the 21st of November 2015 and in holding that the announcement of the election as inconclusive is not contrary to Sections 179(2) and 181(1) of the 1999 Constitution.

The supreme held to wit:

“The Constitution in Section 153(1)(f) & (i) provides for the establishment of the Independent National Electoral Commission (INEC), which, pursuant to paragraph 15 of Part 1 of the Third Schedule thereto, has power inter alia to “(a) organize, undertake and supervise all elections to the offices of the President and Vice President, the Governor and Deputy Governor of a State and the membership of the Senate, the House of Representatives and the House- of Assembly of each State of the Federation; and(i) to carry out such other functions as be conferred upon it by an Act of the National Assembly.” Pursuant to Section 160(1) of the Constitution, INEC has the power, by rules or otherwise to regulate its own procedure or confer powers and impose duties on any officer or authority for the purpose of discharging its function.” PER K. M.O.KEKERE-EKUN, J.S.C

Flowing from the above decision of the supreme court, it is very crystal clear INEC is empowered to declare an election inconclusive pursuant to the relevant provisions of the INEC guidelines. The exercise of this power was seen in both Kogi Gubernatorial election and that of Imo State gubernatorial election where INEC declared the elections inconclusive. Note that APC in both states were winning and had infact won before INEC declared it inconclusive for the same margin reasons. Imo election was conducted during the administration of PDP(Good luck Jonathan) while Kogi was conducted after APC won the presidential election and had taken over lower.

For Saraki, a seasoned law maker, Senate president and presidential aspirant to have said INEC had no such power leaves much to be desired and it tells a lot about the dubious and ignorant nature of Saraki.

So is Inec electoral act superior to the constitution. If the framers of the constitution wanted Inec electoral act to guide declaration of the winner of both gubernatorial and presidential election they wouldn't have stipulated the guidelines for announcing a winner and also conducting a rerun.

The fact is any law not in tandem with the constitution is null and void of the part in conflict.
The supreme court judges erred in their judgement in those cases decided and this understandable considering it's an electoral case.
Amechi case against PDP comes to mind where after giving judgement, they stated the case must be used as precedent.

The Kogi case was used to deny faleke of his victory after Audu's death. If I may ask why has Inec not declared Kogi senatorial by election inconceivable considering that the number of cancelled votes is more than victory margin.

I believe it's time to test the constitution again at the supreme court. Inec guidelines can only work for senatorial, representative and states of assembly not gubernatorial and presidential elections.
