Hi guys,

I am a K1 Visa applicant. I had to create this thread because I couldn't find a thread that's specially dedicated to Fiancee (K1) Visa Application. My motivation for the creation of this thread is the USA Visit Visa Thread which have been really helpful to lots of nairalanders and guests (shout out to LadyGuinivere and Co).

K1 Visa is unique because it has both non-immigrant and immigrant features hence the need to have a dedicated thread where issues can be thrashed out.

My hope is that both successful, delayed and intending K1 Visa applicants will be active on this thread so we can all learn from each other. Also I hope we can get the Visa Officers to offer their professional comments once in a while.

So I'll provide a brief guide on how to proceed with the K1 Visa application. Please correct me in the places where I'm wrong so I can effect the changes.

The first step in the visa application is the filling of a petition using the form I-129F by your US citizen fiancee whom you must have met in person. The filled form is submitted to USCIS at their US address. If the petition is approved, it is sent to the NVC who in turn sends it to the US Embassy here in Lagos.

Once the US Embassy receives your casefile, you can now proceed with the second step which is to fill the DS-160 form and schedule an Interview.

After the interview, you will be issued a K1 Visa if you were successful which allows you entry into the States. You must marry your fiancee within 90 days of entry.

Let me start by listing out some observable differences between the K1 Visa and other immigrant visas.

First off, the US citizen files the petition via the form I-129F. Other types of Immigrant visa application involves filling the petition via other form types.

Another noticeable difference is the cost. It's relatively more expensive following the K1 Visa route.

Thirdly, there is a short wait time of the K1 Visa at the NVC. The USCIS sends the approved petition to the NVC who forwards it immediately to the US Embassy. However for other immigrant application, there is a delay at the NVC. This is because there are some forms and payments that needs to be made before NVC can forward the casefile to the embassy and schedule an interview date. I'm told there are six steps required. The full details can be gotten from their website.

Another difference is that you get to fill the DS-160 form as a K1 applicant unlike the other visas where you fill the DS-260. This is interesting as the DS-160 form is for non-immigrant so I wonder why it is the form to be filled by K1 Visa applicants.

These are the ones I can remember for now. Will post others when I remember them.

Oh one more thing, only a US citizen can fill a petition for K1 Visa. A permanent resident can't. But a permanent resident can file for Spouse Visa. A US citizen can also file Spouse visa.

Am glad i found this thread,but have been denied US Visa twice,can i still go ahead with the K1. And please send your mail or Mail i need to discuss explain certain things.

Yes you can go ahead with the K1 Visa. I'm guessing those Visas were non-immigrant visas. You were probably denied the US visa's because you couldn't prove non-immigrant intent. But in K1 Visa, all you need to prove is that you truly love your fiancee and that you will both get married within 90 days on entry into the States. Also they need prove that your fiancee can take care of you financially in the States till you find your feet.

I prefer you ask your questions here as that was why this thread was created. You can edit out anything that's personal.

OK,noted. But i was told your fiance has to come to Nigeria because you would need pictures to proof,but what if the person is not coming home anytime soon. But you only had introduction?

The outcome of a US non immigrant visa does not affect your chances of getting a K1 visa if you qualify.

However, if you lied in your past visa applications, it may count against you and can lead to a denial.

True you would need to meet in person and take pictures to prove your relationship. However it is not a must that your fiancee comes to Nigeria. You guys can meet any other place. It can be Dubai, UK, France, India, etc. It is not compulsory you guys meet in Nigeria or the US. The most important thing is that there must be a meeting. It can be in Sambisa forest, Lagos, Sokoto, Ghana, America, Asia, Africa, etc. The place is irrelevant wink.

The requirement is to meet at least once within two years prior to filing the petition by the USC fiance(e).

The time together can hold anywhere but it's important to document with pictures and receipts of places visited together. Flight tickets and boarding passes is also good evidence.

Be careful with having a formal introduction though as that may be considered as being married which will disqualify the applicant from getting the K1 visa.

Taking pictures together is the strongest evidence though. That shows there is an ongoing relationship and the visit was to meet the fiance(e). As many pictures as possible at different locations. It can't be too much.

Yes, he or she will need to provide that. But I think it's not a problem if the account has little money in it. This is because the financial records of the US citizen would suffice as a proof that the Nigerian fiancee will not be a public charge when he or she migrates.

So I advice the Nigerian fiancee not to bother transferring bulk sums into his or her account. If anything, it will count against him or her as it suggests misrepresentation. He or she should just present his or her account the way it is.

For medicals, it's done after an interview date has been scheduled.

For my own instance I have a Fiancée coming down to Nigeria within couple of months and our plan is to go to registry at Ikoyi to do our wedding so as to file for me when she get back to US... Can you please enlighten me more about stuff that will be ask in the interview

My dear it varies. It could be as short as 6 months and as long as a year on the average. However I know fiancee visa takes a shorter time compared to Spousal Visa.

This thread is for Fiancee Visa application which does not apply in your case. What you should be applying for is Spousal Visa.

As regards the questions asked during spousal visa application, it's the same kind of question they ask the fiancee visa applicant. These are questions that seek to ascertain if you truly love each other. For example, questions like your wife's date of birth, her place of work, her joint statement of account, her parents name, the list is endless. They can also ask questions on your marriage.

Additional info on the K1 Visa.

'A K-1 visa is a visa issued to the fiancé or fiancée of a United States citizen to enter the United States.

A K-1 visa requires a foreigner to marry his or her U.S. citizen petitioner within 90 days of entry, or depart the United States. Once the couple marries, the foreign citizen can adjust status to become a lawful permanent resident of the United States (Green Card holder).

Although a K-1 visa is legally classified as a non-immigrant visa, it usually leads to important immigration benefits and is therefore often processed by the Immigrant Visa section of United States embassies and consulates worldwide.' (Wikipedia)

'K1 Visa Process

1. USCIS Filing: The United States citizen sponsor files the K1 visa petition with the USCIS by mailing the completed I-129F petition package along with a check to the Department of Homeland Security.

2. Notice of Action 1 (NOA1): Two to three weeks after mailing your petition, you will receive a notice of action (NOA1) indicating the USCIS has received your petition.

3. Notice of Action 2 (NOA2): Usually (currently), between 5 and 7 months after mailing your petition, you will receive a notice of action (NOA2) indicating the USCIS has approved, denied or requests additional evidence for your petition. If approved, you do nothing at this step. If you are denied, (end of story, marry your partner and file for a spousal visa). If you receive an RFE, you need to respond to it with the evidence requested.

4. NVC Phase: The service center that handled your petition forwards your case to the State Department’s NVC (National Visa Center). This will happen within two weeks of your approval. The NVC will run a security check on your fiance.

5. NVC to Embassy: If your fiance’s security check comes back clean, your approved K1 visa petition will be routed to the Bureau of Consular Affairs. The Bureau of Consular Affairs will send your file to the U.S. Embassy in your fiance’s country via DHL.

6. Embassy Letter: After receiving your visa petition, the U.S. Embassy (usually in the country of origin) sends the fiance a letter with instructions for scheduling the medical exam and interview.

7. Gather Embassy Documents: The U.S. Embassy will instruct the fiance to return some of the documents immediately. Other documents will be kept until the interview.

8. Medical Exam: The fiance must have a medical exam. The package sent to the fiance by the U.S. Embassy will explain how to schedule the medical exam.

9. Embassy Interview: The fiance must attend an interview at the U.S. Embassy. All applicants must bring their passport, including children of all ages. If children are joining on a K-2 visa, they must also attend the interview.

10. Visa Issued: If approved, there will usually be a wait of up to one week. The visa will be delivered via courier.

11. Travel to U.S.: The fiance has 6 months to use the visa to enter the United States. He or she will be given a package of documents by the U.S. Embassy which he or she will surrender at the Point of Entry (POE) into the United States.

12. Wedding: The petitioner must marry the alien fiance within 90 days of entry into the United States. If a wedding doesn’t take place within this time, the fiance must leave the United States. The 90 day clock starts on the date you enter the United States, which is normally stamped in your passport. The K1 visa beneficiary can only marry the person who submitted the petition. Eventually the alien must file an adjustment of status petition to receive the green card.' (RapidVisa)

That is not correct. They can meet anywhere as long as they don't get married before processing the K1 visa and they can prove that the relationship is genuine that will lead to eventual marriage once they get together in the US.

If you register your marriage at ikoyi it's no more a K1 intent but a K3 visa would be needed. Cause you guys have proof of marriage

You just reemphasized what I said. Perhaps you didn't read what I wrote. I said they can meet anywhere. It mustn't be in Nigeria. The most important thing is that they meet and are in love with each other and are ready to get married in the US within 90days after getting the visa.
