Did you read the thingy? You can't use self-employment to claim migration points under CEC. He said he was an employee, but they found out he is the director, the owner. Unless to move it to personal history and bring in his Mexican work experience earned within the last 10 years. If he had a qualifying NOC, his agent would have asked for it.

The old one was going to expire in MAY. I made a new one that same day o. I just went with the ADR letter and pleased with the immigration people.....it was just the Grace of God, cos I didn't expect to get it the same day.

U are right about the 6 months validity before renewing....for u that urs is expiring in June, u can renew from Dec.

PS. A friend said I would have done the passport earlier in Nov and sent it to them before they asked....what do I know....lol....Na God hand I dey.

Generally, you cannot use self employment for CEC but there are exceptions and each case is considered on its own merit. There are 7 qualifying factors which CIC uses to determine if your self employment actually qualifies as an employer-employee relationship. This is because some companies try to circumvent the law in a bid to avoid paying some taxes and CPP and label you a contractor when you are actually an employee. The onus is on the applicant to prove how they meet those qualifying factors. To support their application, applicants can also petition the CRA for a ruling on their status which they will submit to CIC. However, this ruling is only persuasive. The family in this case took the second step but did not take the first step of letting the officer know how they meet the qualifying criteria. In this case, they relied fully on the CRA ruling forgetting that it's only persuasive.

So no...they were not trying to be sharp...they followed the rules and took a gamble. The same case before a different officer might have turned out favourably.
There are people who have applied as self-employed and gotten PR under CEC. Again, each case is considered on its own merit.
Finally, CIC did not 'find out' he is a director in the company. When you are submitting self employment documents, you will be submitting your articles of incorporation which will show how many shares you hold in the company. If he had indeed misrepresented, the article would have mentioned A40 proceedings and not an attempt to renew their work permit.

Wow... bless your heart for this. My application just reverted to 1P1 yesterday after being on default 1P2 since AOR 8th OCT. Been waiting to start the passport waka next month but at the same time believing God for an early PPR in December too But if yours was expiring in May and you were asked for a new one in November, then for mine which is June, hmmmm... I'd go try my luck with the renewal thing asap. hearty congrats once more, and thanks for the timely response too. Meanwhile, I just got off the phone with an immigration Officer who's saying I can't initiate the process of getting a new passport till January as that is what the Law stipulates. All my efforts to persuade him for me to start by next month proved abortive. Have you got any contact that can turn things around for me or do I just wait it out till January and pray I don't get an ADR for that?

IELTS test date was 13th October BC
Results ready by 26th Oct -LRSW: 8.5 7 7.5 6
I was so sad especially because I fell ill about a month before the test so my practice reduced and the last week was meant to focus on writing. I was out of work for about a week and just resumed that week still not in the best of health and was required to rest, butI listened to tips from Liz and Jay, but could not practice, I read some books on writing as well.
So I decided to go for a remark and asked God for mercy and speed, willing to stick to my faith on this....
EOR form was filled and submitted on the 30th October
Received an email on the 7th that my EOR has been sent to the EOR Team on the 6th Nov and should expect feedback in 2-4 weeks from that date
Received an email 16th Nov that result is ready,
Writing was upgraded from 6 to 7!
Praise the Lord for me please, my joy knows no bounds!
Note that there was no change online,someone asked a few days back if it meant there was no upgrade, please pick up your new TRF to know your score, no assumptions, I nearly got scared when I read a certain response saying most likely not.
I am really grateful to God

please any ideas how long withheld results are released with BC? Hubby’s results for today were withheld for review as I wanted to pick my EOR and his TRF, don’t know why it’s withheld..

would pm u.....it is about writing a letter to the PCO stating Ur case and attaching a document.... alternatively get the process for renewal started online, pay online and register ...so once it's Dec/when and if u get ADR..u can apply and do express.

In all...i don't think they won't even stamp a passport with less that 6months validity. So just prepare for the inevitable....I wish u a speedy and hitch free ppr
