A friends wife just arrived at my place from Nigeria to give birth here in the US. She’s not due not until mid January but she was surprisingly given only 30 days to be in the country at the airport after she was asked what is her purpose here which she told them she came to have proper medical care to give birth. She had earlier been here about 2 months ago with her husband Which they stamped them 6 months stay. They 30 days stay is not even enough time for her to put to bed. She didn’t notice this on her passport not until when she got to my place so she went back to the airport and the immigration officials said there’s nothing they can do about it. Please, any advice of what she can do in this situation. Thanks |

pipz: Huh, this is not looking good. If she ends up overstaying her legal presence in the US it might cause her serious challenges with renewing her visa or returning back to the US with future trips. Which airport was this? Did she declare childbirth during the visa interview at the US embassy? |

Tahtianah: I just paid $180 for my LO visa on arrival with my Firstbank VISA Dollar card but the form has something like, 'you are to pay $90 at point of entry'. What's the experience in the house just to be sure? |

Just to add my 2 cents to this visa for intending travellers to the US for child birth issue. My wife had our baby in the US earlier in the year and we paid all bills. Fast forward to December, I was applying for a work visa to go to the US with wifey from the US consulate in Melbourne. I have read the stories here about the increased scrutiny for people who birthed their babies in the US, so me and wifey decided to go fully prepared and not take any chances even though we interviewed outside Nigeria and thought our chances were brighter. Transcript as follows; VO: Why are you going to the US Me: Company is transferring me to our related company there for XYZ period VO: Are you going with your wife and any other family; Me. Yes, my wife and 10 months old baby VO: But your baby's passport is not here Me: We had him in the US earlier this year so he has a US passport VO; When was the last time you were in the US on your work visa Me: April 2017. I travelled again for child birthing early this year on a B1/B2 VO became stern at this point and was typing furiously on his monitor. He faces my wife; VO: Did you take advantage of any medical benefits in the US, what hospital did you use and how much did you pay. What visa were you on when you had your baby. Wife: We paid all our bills and have a zero balance letter from all the services used. I used XYZ hospital in Texas and had a C section and my best estimate of total bill incurred is around $13k (slips all payment receipts and zero balance letters to him.) I was on a B1/B2 visa which I obtained prior to getting married but notified the Lagos consulate of change in intention prior to travel (slips letter of change in intention and consulate's response to VO). VO: (After taking his time to peruse through the well labelled documents) I will be approving your visas. You will receive your passport in the mail box within 10 working days from today. My observation The Visa officers across all the locations have become more thorough with people that have had babies in the US in the recent past. This is irrespective of your rich travel history. if anything, that puts you under more scrutiny, Between my wife and I, we have been to the US more than 10 times in the last 3 years. Our itemized bill had a little bit of adjustment on it for self pay patient. We decided not to brandish this unless we were asked. Thankfully, the VO did not request for it. We might have had the luck of not interviewing in Nigeria. An itemized bill may have been compulsorily requested leading to a fresh round of Q&A. This was avoided. Success rate for visa applicants are very high at the Melbourne consulate and the VOs and other admin officers were more courteous. Completely opposite to what I have witnessed at the Lagos consulate on my two past visits. There were 3 interview windows with a barrier to conceal the interviewee from the other people waiting in line. I thought that was more dignifying. The visa interview was not a breeze and I ended up answering more questions than I initially anticipated. It was clear to me that the tone at the top has cascaded to every rank and file in the US consulates across the world. Note that I went in for a work visa interview but the interview was less about my work and nature of what I do but more about my wife that had a baby earlier in the year. We anticipated the worst even though we had a good case for a visa and also a good location. All the questions we dreaded were asked. You just cannot be over prepared. Most importantly, I was at peace with myself knowing that if the visa was not approved, I was going to stay back in Australia which I was quite hesitant of leaving for the US. Good day folk, just to give back to this forum. My family and I landed in Houston Texas yesterday at precisely 4.05pm(11.05pm Nigerian time) on Emirates Airlines. Firstly, for those that need 'fit to fly' to travel to the US ensure you insist that your Dr states clearly your EDD on the letter as some Airlines(including Emirates) have some unwritten rules pertaining the letter now.If the EDD is not reflected on your 'fit to fly', make sure you have a very recent ultrasound scan to back the letter or have your Dr's mobile number handy to avoid being disallowed from embarking the aircraft. Again, get to the airport early to avoid unnecessary pressure and to create enough time for scrutiny by the airliners. On getting to IAH Houston POE, the following ensued: Me: Good day CBP Officer: Passport Me: Forwarded my family passports CBP Officer: How many of you? Me: 5 CBP Officer: Ok CBP Officer: Why are you here? Me: For vacation and childbirth CBP Officer: Looks at my wife, your wife is pregnant right? Me: Yes CBP Officer: You have family here right? Me: No CBP Officer: How much do you have with you? Me: XYZ Dollars cash, ABC Dollars in card CBP Officer: Where do you work? Me: DEF company in Nigeria CBP Officer: How long have you been there? Me: 13 years CBP Officer: What's the company into? Me: It's into ..... CBP Officer: You have been here before? Is this their first time(pointing to my family)? Me:Yes I have been here over 10 times,was here in August. No my wife and first two children were here before, the last is coming for the first time CBP Officer: Are you coming to live here? Me: No CBP Officer: How long will you be here? Me: 5 weeks CBP Officer: Ok, four fingers on the scanner. My passport alongside my children's were stamped in for 6months after matching their passports with them one after the other. He then called my wife to fourprint her fingers. Afterwards, he gave me my children'spassports and my passport to me and told my wife to step aside while we should go and wait for her. We waited for 2 hours downstairs before she appeared. She was taken for secondary scrutiny. She said her interview was not more 5 minutes but people were many in the room. From her experience there, it's very important to have a believable story. One woman was about to be returned to Nigeria because her story was somehow awkward and easily faultable. The woman agreed that she is pregnant when asked but her return ticket is 25th December meanwhile she has about 12 weeks before her EDD. When asked if she intends to deliver in USA, she said she may if she enters labour before leaving. Another woman came with 3 children, one of them a US Citizen. She forgot her Zero balance and Itemized bills in Nigeria. Though they eventually stamped her in , but they warned her to never forget to travel with it next time. Another Permanent Resident was also taken for secondary interview because he has gone out of America for long. It's obvious that the Officers have stiffened up than before due to the Top Stance to Birth Tourism. I wish everyone preparing to come or preparing for Visa Interview all the very best but preparation and overpreparation is extremely imperative. 3 Likes |

Good day house. Please I’m confused with this whole visa in arrival thing. Thought we are just meant to send an email with baby’s details and a confirmation wil be sent back. Then we pay in Nigeria upon arrival. Is there another way someone is meant to do it? |

sucre26: you are right but you can also pay online which I advise since it is working now. I have heard of people that had it rough because their cards did not work at POE. You may want to have a US based card to be sure. |

I submitted a visa application for Renewal under drop box but got a 212G form when I went to pick up my passport. I was required to reschedule a visa appointment which was supposed to be in February 2019. But all of a sudden I was moved to a weekend in October 2018. I attended the interview and was accused of lying about reasons for procuring my original US visa. No documentation was requested from me by the interviewing officer. He just said he didn’t believe me and then he gave me the blue 214b slip and the 212(a)(6)(C)(i) Material Misrepresentation. I have read about the 212 Material Misrepresentation and it carries a lifetime ban. I have approached an immigration lawyer to write to the consulate and this has been done… but the US consulate has not responded. I am a law abiding citizen who notified the US consulate in writing well beforehand that I would be traveling to the US to have a baby and I paid all my bills. Does anyone know what I can do to get a solution as I believe I am the victim of discrimination, erroneous and arbitrary determination that I have made a material misrepresentation to the US government. |

I've been trying to pay with my Bank of America card online and it's not going through. Apparently BOA doesn't allow transactions from Nigeria. Only option left now is my Naira card, just waiting for it to be registered. Has anyone ever used a Naira card for voa? Leomichael: |
