@topic...as a safety officer the last thing one should be caught doing is violating the rules that it is his job to enforce. Wbere things work right...he would not only face charges...and lose his job... but also have his license suspended/revoked... has to go to hell and back to have it reinstated.... pay through the nose for car insurance and a big setback when applying for any job where he may have to drive. He needs to be taken off the road...who knows ...maybe he killed someone before reaching home.
You can't do anything by subjective evidence. What smells like alcohol to you might be from the stench of your hangover. There must be verifiable fact before the judge. Failure to do so would lead to unfounded allegations. Someone who does not just like your face can wake up and accuse you of anything. Read the post from the first page, you will notice where someone implied that this is a setup or some kind of retaliation.
In places were things work right, the picture you painted is extreme. He might be placed on leave and ordered to undergo some behavioral treatment/ counseling after which he could return to his job under some probationary period and conditions. The law in those places is just.

The problem with Nigeria system is that certain things are not in place to enforce the law. Video evidence alone is not enough to verify if he was drunk or not. Some medication could cause drowsiness.
Where things work right, an instant breath test for alcohol level would be done. He can't deny the result.


Even if he took a medication that made him drowsy he's still legally intoxicated. As for this road safety officer, he was drunk. People don't reek of alcohol when they take medicines that make them drowsy. Not even Codeine

There is difference between intentional and unintentional act (Tort). Consider the difference between murder and man slaughter case.
The punishments also varies. Most importantly, the reputational damage to his person as a result of this action would not be as bad if it's not alcohol.

Subjective evidence..... before the breathalyser.... weren't drivers charged for driving drunk? ...what verifiable fact was presented to the judge? ... or was nobody charged because of lack of verifiable facts? I guess you would ride in a a car with the driver wreaking of alcohol.... after all... no verifiable evidence to prove he is under the influence.
On being set up...did you watch the video? I guess not neither did the person you're referring to.
On being fired.... it is illegal to fire someone because of alcoholism... which is considered a disease... but what companies do is fire you for a different infraction of their rules. In this case... can be failing to wear a seat belt while driving in uniform.
This is one of our problems..... we have excuses and explanations for everything.... so we do what we want without consequences.

before breathalyzers there was blood test( Would check to know between automotive and blood alcohol test which was first discovered). Even if a driver smells of alcohol, you must confirm the level before punishing him. In places where things work, you cannot punish a driver just because he smells of or even drank alcohol. It must be above certain limit before the driver is considered legally drunk.
The only acceptable way to verify it is for them to summit to a test. People drink a glass of beer or wine and still drive without being impaired. It is only irresponsible to go above the limit.
Let me be clear. I am not making excuses for wrong doing but I feel obligated to bring our attention to failure in the system. We can improve our enforcement agencies to world class standard by learning from advanced societies.

The question is, how do you prove that he was intoxicated, in a country like Nigeria where most enforcement officers on the road do not have breathalyzers?

Op what do you think you're doing? Where is the bottle of alcohol? I can't perceive any alcohol in this picture Ooo. I bashed a senior ranked uniformed guy recently, you need to see how all the men under him begin form activity. I ignored them, went to their Oga, spoke to him, gave him my card, offered my 3rd party and went my way. When I started my car to leave his men started asking me "are you going just like that?"

Op this thing you have done is pure wickedness. The picture of the bashed car you no show us. The picture of the damage to the guy's own car you no show us. You are just setting this guy up for reasons best known to you. When the repercussions go come to you and your children you go start to blame village people.
