Senior Nigerian lawyer, Femi Falana, has called for withdrawal of President Muhammadu Buhari-led Federal Government to withdrawn its charge against the Chief Justice of Nigeria (CJN), Justice Walter Samuel Onnoghen.

The Federal Government will on Monday, January 14, 2019, arraign the CJN before the Justice Danladi Yakubu led-Code of Conduct Tribunal (CCT) in Abuja on charges of failures to declare his assets as required by law and for operating Bank Domiciliary Foreign Currency Accounts.

The charges against Justice Onnoghen were filed and served on him on Friday at his official residence in Abuja preparatory for his appearance at the tribunal.

Falana, speaking to Premium Times described the move against Justice Onnoghen as a “prosecutorial misadventure.”

He, therefore called on the justice minister, Abubakar Malami, to immediately withdraw the charge.

Falana said: “The charge against the Chief Justice of Nigeria, Justice Walter Onnoghen ought not to have been instituted at the Code of Conduct of Tribunal in view of the case of Nganjiwa v FRN (2017) LPELR 43391 wherein the Court of Appeal held that a judicial officer who has not been investigated by the National Judicial Council and sanctioned for misconduct cannot be arraigned in any criminal court in Nigeria.


“As all authorities are bound by the Court of Appeal verdict the case should be withdrawn by the Attorney-General of the Federation without any delay because it is likely to be a prosecutorial misadventure.”

The National Judicial council shouldn't have the power to investigate criminal cases. If this is about ethics alone, then it is understandable. If the Chief Justice commits murder or rape someone, will the police wait for the Judicial council to investigate and sanction him first?

If this is the law, then it must be discarded A.S.A.P

You are not a law court when EFCC charge that dishonourable Judge it was done under EFCC act, now CJN a self confess offender is being charged under the Code of Conduct Act which guides every public officer. The NJC and the courts are sneaking immunity that the constitution never gave them.

Done and dusted by Falana. The ones that Buhari is hoping on to be in his persecuting counsel have started withdrawing from the case even before the proposed arraignment!

The FGN should have this issue decided as a preliminary issue because there seems to be a judicial protectionism which is sneaking in Immunity that the constitution has not granted to judicial officers. The CJN has been arraigned, let us test the constitution and the powers it gives and where there is need for a reform in law, let us do so.

Before the sting operation on Judges, there were countless petitions against the Judges submitted to the NJC, yet those petitions were ignored by the NJC, hence the DSS took matters into their hands and choir boys started singing,
so are you saying a corrupt judge is free to preside over sensitive matters like the election tribunals till when ever the NJC feels the corrupt judge is due for investigation?
And come to think of it who is the chairman of the NJC,

This is why corruption thrives because democracy is easily manipulated in Nigeria.

Nigeria is not ripe for democracy.

Executive intimidation from criminal cases? This is not a case of the Chief justice having an affair with his secretary which the Judicial council may frown upon.

The FG cannot convict you if they cannot prove a case against you, why then is the CJ worried?

Isn't it funny, an administration with the largest number of lawyers in our nation's history with up to 3 SANs keeps making a mockery of our judicial process.

Of course the CJN is not without blame. As the nation's no 1 judicial officer shouldn't he know the implication of lying about his assets?

Are you testing what has already been decided at the appeal court at the CCT? The way it is now only the supreme court can adjudicate on this matter.

Charge him to court and get the case thrown out.It is not about charging him to court.it is about winning or securing a conviction.The case again supreme court justice Sylvester Ngwuta was thrown out for the same reason.

No! They want to hurriedly remove him so they can replace him with their puppet. The writing is on d wall n Buhari knowns it. Nigerians are tired of that failure in Abuja.
