…Ex-Kano DPP is the prosecutor

Ade Adesomoju, Abu

A team of lawyers led by Chief Wole Olanipekun (SAN), has arrived the Code Conduct Tribunal in Abuja to defend the Chief Justice of Nigeria, Justice Walter Onnoghen, who is scheduled for arraignment before the tribunal in the Monday’s proceedings.

As of the time of filing this report at about 9.17am on Monday, the CJN has not been seen on the tribunal’s premises for the proceedings scheduled to start by 10am.

Some Senior Advocates of Nigeria in his defence team who were already seated before 9am awaiting the commencement of the proceedings included, Olanipekun, Chief Chris Uche, Chief Adegboyega Awomolo, Sebastine Hon, Chukwuma-Machukwu Ume, Kehinde Ogunwumiju, and A.T Kehinde.

‎All the senior lawyers are in court with their teeming juniors.

But the team of lawyers comprising a handful of senior lawyers and other junior ones has been technically disbanded.

Meanwhile, a former Director of Public Prosecution in Kano State, Aliyu Umar (SAN), is going to lead the government prosecution’s ‎team.

Umar arrived the CCT at about 9.10am.

He was one of the senior lawyers appointed by the Attorney-General of the Federation and Minister of Justice, Mr. Abubakar Malami (SAN), as part of what was meant to be the government’s prosecution team in 2016.

Umar led the government’s prosecution team that was to prosecute the Senate President Bukola Saraki and his deputy, Ike Ekweremadu for alleged forgery of Senate rules.

The charges were later withdrawn from court by the Umar-led legal team.

His lordship will not come. His lawyer will file a Preliminary Objection today to challenge the jurisdiction of the tribunal. They will make it orally but the tribunal will ask them to formally file it. Matter will be adjourned for them to regularise and will continue like that until the election is over.

If he doesn't show up, the FG will officially notify the NJC, and cite lack of confidence in him as the Chief Justice Of Nigeria....while instituting another suit compelling him to step aside, as he cannot be a Judge in his own case...

While the above is going, The pressure would mount for him to step down....

PDP showed their hands too early....So as it is now the ruling party, FG, and the masses no longer trust Onnoghen as the CJN...

Advice: He should quietly step aside before he ruined the remaining grain of honor in him.

We all know how it will end. If Buhari has done his job very well as the president he won't be bothered about CJN. Daura is now very close.

That is exactly what the FG wanted! His image will keep deteriorating....The pressure will mount for him to resign...The FG will notify the NJC....He will be relegated and excommunicated....and finally he will throw in the towel..

Anything to get Nigeria Working again is OK by me. The rule of law must prevail and adherence to our constitution must be strictly followed.

I support the FG on this one with no ethnic or religious coloration.

Keep up the updates please.....

Justice must take it's full course.....

No more impunity in our land.

CCT is not trying him for professional negligence but for criminal acts . Governors grow up. Gone are the days of cabals. If you do the crime do the time. This is the big change we voted for.
CJN Salary/Annum = N9,012,000 CJN savings in Foreign Accounts alone = N250,500,000. Does he trade in Judgements?

PT: During his maiden media chat, President Muhammadu Buhari had said you have the power to release his asset declaration document to us in PREMIUM TIMES. Would you be willing now to release the documents to us, just as the president said on live television?

I will give you a very simple answer. He said you are free but who is free? Is the CCB free? The law does not say I should release anybody’s asset declaration. The document does not become public document after declaration, it is only the CCB that is allowed by the constitution to retain custody of such documents. That is what the CCB Act says.

Besides, Schedule 3, Paragraph 3 (c) of the 1999 Constitution as amended says the bureau shall have power to retain custody of such declarations and make them available for inspection by any citizen of Nigeria on such terms and conditions as the National Assembly may prescribe.

PT: But if you encourage it and President Buhari said on national television that you have powers to release his own document, don’t you think you would be standing on the way of probity and transparency you are talking about?

Did the president say he has written to CCB and said ‘go and make my declarations public?’...
https://www.premiumtimesng.com/news/headlines/208976-interview-why-we-ignored-buharis-instruction-to-release-his-assets-declaration-to-nigerians-code-of-conduct.html
Going by the afore precedence, the curious questions for this APC government, CCB and the petitioners are:

-1).How did the petitioner accessed the CJN's asset declaration forms @ the CCB since only the declearer is allowed by law to order the CCB to allow public access to such info contain therein?

Just as Cambridge Syndicate replied that only Buhari have the right to authorized the release of his alleged certificate who conducted the then exam on behalf of WAEC.

-2).Is it no clear & certain that the CCB & petitioner committed a grave criminal breach of trust & thereby violate the right of privacy of the CJN by this malicious act?

-3).Why did the FG/presidency via the morally corrupt AGF bypassed the NJC protocol, does the CCT have any juridiction to trial a judicial officer without the NJC's approval? Why did the FG asked the CJN to vacate office when he have not been tried or found wanting?

Why wait till the eve of a crucial election wherein the president Is a stakeholder before this "prosecutorial misadventure" according to Mr.Femi Falana? Is the govt not obviously up to sometime sinister?

-4).Why did the corrupt & morally depraved APC-govt hasten up this show of shame with supersonic speed while the same regime have annoying footdraggged on the numerous corrupt indictment of many top & low members of it fold up till date?

The most sensational is the bias failure of the EFCC to investigate the Gov.Ganduje dollar bribe scandal? The government have simply took on more than it can contain.
