Prior to doing business with anyone, especially as it has to do with moving goods from Lagos to other states, I state and emphasize the limits of my company's liability and would ensure not to over stress it if the client is not comfortable with the terms. This is because, we are not directly involved with moving the goods to your location, and should not be held liable should anything happen on transit. Many accept this and a few decline. Those that decline, I don't try to persuade them because I know in business, you win some, you lose some.

This is the typical message I send to potential and recurring clients, and you find it on the front page of my thread here on Nairaland (seen in my signature);
"Our rates;

N2,500 (South West locations)- Same day delivery by bus transit waybill. Duration is within 24hrs.

N3,000 (South East/South-South locations, Abuja/Lokoja)- We recommend Home delivery via Courier. Duration is 3-9 days.

N3,500 (North/Middle belt locations) - We recommend Home delivery via Courier. Duration is 3-9 days.

The above applies for normal items weighing 0-5kg.

N250 applies on every added kg.

Cargo goods shipped via normal/carton packed volume attract #1,000 extra per 5kg.

Now, the said phone was shipped to your location via Courier Master's which is the waybill section/handlers of Young Shall Grow and it was sent from their Jibowu Office. It was a registered Waybill, which till date I still have the Waybill invoice with me. However, the conveying vehicle was said to have had issues while on transit (I cant remember now if it was robbery or accident) but the company confirmed that to me and provided a follow up letter with a police report which I sent to you. The company representatives reached out to you as well.

Having outlined the issue at hand, at the time, I could only pursue a compensation for you from the company, which I was on to. I requested the invoice from you which you sent and I tendered to them. In all these, I kept you updated. But as days went by, you resorted to calling me a thief and threatening to pick me up with your soldiers; to that then, I told you I don't take threats slightly and you can charge the case to court and we address the matter from there.

In all that and while it was on, I expressed my regret on what happened, which is the right thing to do. It was a situation that was beyond me or my company. And of course, I know how it feels to lose such money. But that what happened happened doesn't paint IBL bad or that you were ripped off. I've had dealings with hundreds of people on Nairaland since the establishment of IBL Procurement and Logistics and I know they can bear me witness.

I'm still very much open to resolving the issue. I wish you were in Lagos, so we can take the issue up with the company. Should you have someone you can delegate for this also, it's fine by me. In the end, you're are aggrieved and it's understandable. Every issue can be resolved.

I've had similar experience (item worth 280k) whereby after clone's contact way billed my item from Lagos, item got burgled enroute PH.

It was quite painful and frustrating, but I had to cooperate with the sender, and with the help of a lawyer friend, influence of social media, etc, I was able to get a full refund for the exact market value of the missing item. It took almost four (4) months before this all played out though.

Guess it's one of the risks of this trade

I perfectly get your point, but IBL is trying to be smart with that clause he said is on the first page of his thread. This is just like picker/shippers telling us whatever happens to items shipped is none of their business. In as much as IBL didnt use his bus to convey the said item to Captain Harry's destination, its the duty of IBL to make sure the item arrived safely. Whatever happens on the road should always be between IBL and the transport company he used. I know one thing for sure about transport companies when you want to send an item, they will ask for the value of such item and this is always done so that when the item is lost, they will give you the value of what you've declared. So what is IBL talking about Capt Harry's cooperation?

And to answer your question, yes IBL is culpable

When we begin to think like this then there is a way forward. Just to give the young man some credence, I went as far as trying to do my background check on this to help him out since I believe I could have a little more access to certain people. The courier company had no incidence of robbery or accidents all through that month and packages came in from Courier masters that same day to the base. I can provide anyone with the chairman's number to make enquiries for yourself. I had humbled myself to give him feedback of my enquiries only for whoever from his so called couriers to call me and say that IBL sent him to call on his behalf and plead with me to just forget about the phone, my $800. I can still recall the look on my wife's face when I put it on speaker trying to explain why she hadn't gotten her anniversary gift. Till today she still thinks I never got any phone and still act so calmly?

That was within Lagos... The one quoted here, was the first to happen on transit from Lagos. The second one, still via same company; the client got a decent compensation as we both worked together. It however took months before it was fulfilled. It is one major factor with the trade, which is why the terms and conditions are there. I personally recommend home delivery via our partnership with KOS COURIER but the duration discourages most people, which I understand. I refrained from doing a follow up with the company due to how he was going about. That may not have been the right thing to do, I must admit, but I was pushed to do so at the time. Thanks.

Just learning new facts concerning this. I remember when I was going through similar experience, the sender (Iyke) who happened to be based in Lagos, really went out of his way to follow up the case.

I can only pray IBL to try as much as he can, even go the extra miles, to see how he follows this up. Trying to hide under your terms, no matter how "legally assuring" they may be, isn't the best move.

As I have just checked our chat conversation after that call, I had asked you why someone from courier masters was calling me, and accused you of telling me too many stories, which of course is telling lies! IBL you've given me options of:

1. Taking you to court.

2. Accepting only 20% as that's what your lawyer was told by YSG terms of agreement.

3. Totally forgetting about the $800 (asides fees of sending it to Nigeria, and courier fees within)
