Thanks for the response, its actually a rented apartment.

I'm not sure there is any justification to go the Legal route, if the agency thinks its illegal, i expect them not to rent upper flats out to people with kids. Will try and push my luck to see if i could use the threats in her email against her...Will also ask her for a worst case scenario and see what her response would be...

You have got to be careful, I’ve seen many cases like this and noise is noise no matter who is making it. Your neighbour is entitled to enjoy the comfort of their home without noise from the neighbours etc. Worse case senario your lease will be terminated if you are renting and you may have to find somewhere else to live. You might also end up with a large legal bill since you are the offending party.

Secondly, even if you own the property your neighbour and management company may issue you with a section 126 notice. This is a notice to repair and it forces you to make adjustments to your whole floor area. You will be required to install padding in the floor up to a certain (stated in your lease) standard before installing floor boards or tiling. In some cases, if the lease forbids floor boards on top floors you may have to rip out the floor fittings and install carpets, also to the standard stated in your lease.

For those of you who have very young kids and you are buying a property e.g.flat depending on the area. Please read your lease very well, especially in the noise and flooring part. These days people tend be very selfish and are less tolerant of kids. Looking at the other side of the coin when you work very hard and come home to relax any kind of noise is frustrating.

Sorry you have to deal with this.
Unfortunately, i agree with others that you have to move.

I lived on a first floor flat many years ago with first child,i had the neigbour under us hitting the ceiling with a broom or a hard object when he felt we were disturbing,we even got an angry knock on the door.

We were usually very apologetic but understood that they also wanted peace as well not a noisy child running round constantly.

We started avoiding flats since then.

If you ever move to a flat,get a ground floor one , or just go for a nice sound proof semi and have peace of mind.

It would be such a huge hassle to move but it will be worth it in the end if you don't have a hostile environment to live in even though their anger is justified..

You can tell the agents you will move,ask them if they have other property in their portfolio, this would cut charges for you i believe.

Forgot to add that you'll need reference from your agency if moving on so no need to antagonise them...

I never said renting out top flats to families is illegal. The word I’m trying to use here is breach of the lease by the landlord. He may have changed the flooring and not followed the lease specifications that’s why there is so much noise.

This explains par of the problem, If you really want to stay there maybe you can ask the landlord if he followed the lease specifications when laying down the flooring, cos this is causing problems for you.

I have never been outside the shores on Naija and would want to make a trip this year.

Learnt that there are lots of bottle necks with the US Visa waka.

I would like to visit the UK, my cousins and extended family stays at Birhimgham City.

I am the sole sponsor of my trip...

What are my chances, i currently earn a little above 150, with savings in Mutual funds (1.5M).

It's an important questions. Cities with 2-3 bedroom around 500-600 pounds would be considered affordable to me and my lovely wife. We can pay those 1000 pound a month flats. Kindly get back to me, so I can make an informed decision on what city to settle in, in the UK.

NB: All agents I meet always ask, what city do u prefer?, and obviously, I don't know which city to tell them.

When you talk of affordability, that is a misnomer. Would you want to reside in far flung places, where jobs are non - existent, then having to pay £600 pcm on cost of transportation (from work - home)?

Did you say fair weather ? What exactly does this even mean ? You have Summer, winter and autumn.............. If you stay in the UK for a year, you are bound to experience, the good, the bad and the ugly .............

Friendly Indigenes ? The UK is a multicultural country, albeit certain areas might have minority concentration. But does not mean fully occupied by them .......

The average monthly rent is usually between £700 - £1300 pcm ...... A big figure for you and your very lovely wife to chew on ........ (not unless you or your lovely wife is a keyworker, and might receive certain rental benefits)........

Can i decide for you what areas to live in the UK ? NO...... UK is wide enough, from London to Glasgow (that are between 10 hours apart driving) .... You see, this issue is much bigger than Bombay ........
