The suspension of Walter Onnoghen as the chief justice of Nigeria (CJN) by President Muhammadu Buhari has predictably generated furore within and outside the country, a situation that is less desirable a few weeks to the 2019 general election.

The process leading to Onnoghen’s suspension, beginning with the petition by a civil society group against him over an alleged non-declaration of assets, has been assailed by many commentators, lawyers and activists who argue that due process has not been followed.

In the avalanche of judicial pronouncements and interpretations of the laws, however, there seems to be an emerging consensus that the government could have handled the Onnoghen case better and within the confines of the statutes.

As a public officer, the CJN has already indicted himself by admitting that he forgot to declare certain assets, and there is no protection in law for this. There is also suspicion that he cannot reasonably account for the value of the transactions that have been carried out on some of his bank accounts. This inevitably points to the fact that he might have a case to answer, and this is definitely not good for a custodian of public trust in the temple of justice.

Nevertheless, the rule of law and legal procedures need to be followed in order not to create the impression that democratic principles are being willfully bypassed in the Onnoghen case. The government can still achieve the same end result by following the procedural path.

While TheCable is fully persuaded that there has been no fidelity to laid-down procedures in the treatment of the Onnoghen case, there is no doubt that the CJN himself is not smelling of roses in the whole affair.

To break the logjam, therefore, we call on Buhari to immediately recall Onnoghen from suspension. This will save his government from further accusation of dictatorship.

In the meantime, Onnoghen can save the entire country the whole trouble by stepping aside as CJN as soon as he is reinstated by Buhari. This will allow him to clear his name. It is only fair that he cannot be expected to head the judicial arm of government while he is being investigated.

We also call on the National Judicial Council (NJC) to step into the impasse and do the right thing by subjecting Onnoghen to a transparent investigation. He should be put on administrative leave while investigation lasts as he cannot be a judge in his own case.

If Onnoghen is found to have committed an infringement, he should be appropriately disciplined so that the Code of Conduct Tribunal (CCT) can proceed with his trial within the confines of the law. For now, his innocence has to be presumed until guilt is established.

The CCT, on the other hand, has to come under a new leadership because of the ongoing corruption case against the chairman, Danladi Umar. He has also conducted himself less creditably in the Onnoghen case. He who comes to equity must come with clean hands.

TheCable calls on all sides of the divide to put the nation’s interest first. The allegations against the CJN are grave and no matter the temptation to play politics, the interest of the country must never be downplayed.

It is in the interest of Nigeria for state institutions to be allowed to do their jobs unimpeded and it is the responsibility of our leaders to make sure processes and procedures are not subverted no matter the political atmosphere.

However, Onnoghen brought all these shame to himself. It can never happen in saner clime. Immediately you are accused of crime by the government of your country, nobody should advise you to step aside, and allow unfettered access to full investigation.

Unrepentant thieves like him will not choose to bow out.
He will rather choose to start playing political and judicial games.

Besides, his pdp party won't let him back out.

He will choose to be disgraced out of office

Even if he would be recalled, he should be made to write post dated resignation letter before any action.

Apt. All this furore would've been unnecessary if the CJN had done the right thing which was to resign but he was rather playing smart, shopping for injunctions and postponing NJC's meeting. Another thing is that right now, we have effevtively ignored the man's guilt and though Buhari's action is not apt, someone had to take d bull by the horn rather than allow an individual play around d law..... Now, to ya'll shouting tyrant and all such, I ask these questions: Did d CJN admit that he 'forgot' to list some of his assets? Should we have allowed him continue seeking for injunctions and postponing NJC's meetings cause he feels they might have asked him to step aside? (Something he should've done without prompting)...... The Muhammadu Buhari I saw in action on Friday is the Buhari i campaigned and voted for in 2015 and I hope he'll continue to do the right thing irrespective of people's opinion

Apt

My problem with all these Editorials now is: Why didn't they do all these Editorials last week to put pressure on the man to resign? Rather they were sniffing PDP panties of propaganda?

The CJN does not need and should not step aside( if that means he should resign) cos that would mean that the people who wanted him out for clearly political reasons would have won.

He should RECLUSE himself on matters relating to the investigation once a petition gets to the NJC ( by the way, am still not aware of any petition to the NJC on this matter which speaks volumes).

What of if he resigns and he is later found out to be innocent, does he get back his position as CJN?

Did Buhari step aside when he was accused of certificate forgery? Did Gandollar step aside? Did the CCT chairman himself step aside as he is still facing N10m bribery charge?

By tomorrow you will know between your impostor and Onnoggen who really is in charge.

Nonsense !!!! asking Buhari to recall Onnoghen is like asking a man to recall a woman he never married yet alone divorce, Let it be clear for the umpteenth time that Buhari has no power to suspend the CJN , just a suspension that never happened and can never happen except as a figment of Buharis demented Imagination!!!! .. Can the CEO of MTN suspend CEO OF Airtel? Can the the CEO of NAIRABET suspend the CEO of BET9JA? HELL NO!!!

You dey mind them.

They have been totally isolated on this matter like I said they would.

Let them play with the core of the Law profession and see if they will survive. And like I said yesterday, no lawyer even those in Buhari Govt would ever openly support what he did. To remove a CJN the way it was done is akin to sticking a knife in the heart of every lawyer.

They will start to get a feeling of their misguided ways tomorrow after NBA Emergency meeting

Lol How will be charged when the people who were supposed to charge him to court work for him? What brand of goof are you smoking BTW
Certificate forgery is a grave criminal offence and far more serious than non-declaration of assets.

No matter how good your intentions are, if your actions are executed illegally, then your good intention is rubbish.

The same set of people defending Buhari's action now will be condemning jungle justice o, how is this different from jungle justice abeg?

That was the very option given to Walter Onnoghen - to step aside and clear his name. He did take it.

Even the case went to CCT, instead of the judge to respond to his case, he hired team of lawyers and was running from court to the other looking for loophole to frustrate the case.

The fact the fact remains that Walter Onnoghen is hoping for few months to execute the job he has already been paid for - that is use the court to bring in Atiku if he fail to win on the 19th of February.

Someone like that cannot be allowed to head the judiciary. When he is done wailing, he should go and answer his case at CCT. For most Nigerians his case is a done deal.

BMC has recalled Cleverly to come do damage control grin

I see you guys have been super busy since this CJN's issue popped up, defending a lifeless brainless bigot like Buhari is really not easy considering how he's used to churning out weekly gaffes and scoring hourly own-goals. Truth is, if it was left to Nigeria's learned-class, PMB would never win an election against ordinary Donald Duke but what we have here is a situation whereby the voting majority are so neck-deep in poverty, they don't even have any source of information except roadside gossips and propaganda (which is a tactic the APC have perfectly used to their favour. God bless Nigeria.
