If you go back to my comment, I touched on the arbitrary use of power by the executive (Presidency).

My argument is about the judiciary protecting their own thief instead of condemning Onnoghen's action. This behaviour by the judiciary will only embolden the corrupt ones amongst them to continue to dare the potency of the laws of the land.

Truth is that the NJC will reverse the decision by Buhari but will recommend Onnoghen to step aside pending the investigation. This will also be equal to being suspended.

My opinion though.

First and foremost the NJC must remember that this meeting is not about whether Onnoghen is corrupt or not but to find out where Buhari got his imaginary powers from to claim to suspend the Head of the Judiciary and where he got another imaginary power from to dare to replace him without any input from the NJC and the National assembly as enshrined in our constitution.

The out come of this meeting must be to uphold the constitutional status quo and to fix another date to hear the trumped up corruption charges against Justice Onnoghen and to decide the punitive measure for the unbecoming behaviour of Justice Tanko.

Again, I will take you back to my comments and show to you in very bold text that my choice of word is 'wrongdoing' not crime. Also, I haven't mentioned that there's any conviction yet.

The bone of contention is that Onnoghen withheld information from the CCT of which he's admitted & he's yet to explain certain amounts found in his undeclared foreign accounts.

withheld information from the CCT? that's a new one.Where did you get this from? Has he been asked to explain the sum of the monies found in his account and he failed to do so?

FYI there is nothing like monies in UNDECLARED account. All his bank accounts were duly declared in 2016.He only didn't declare his assets in 2009 but did so in 2016 stating all his accounts.Again this is not a crime and is not punishable once he admitted in writing he forgot to declare it in 2009 but duly declared it in 2016.

So I ask again what PORTION OF THE CCB LAW DID THE CJN VIOLATE?

Mujtahida:
President Buhari is a fraud! In order to carry out the Cabal's preconceived plan to destroy the CJN, Buhari predicated his suspension of the CJN on the directives of the CCT but the CCT never directed the President to suspend the CJN. Even at that, the order is on the face of it highly irregular and violates known and settled principles of law.

fighting corruption with corruption-that is the Nigerian way, criminals fighting other criminals- that is the nigerian way of fighting corruption.(How apt that Danladi Umar who has corruption cases to answer is sitting down in judgment over another man_ God did it that way to expose the hypocrisy, the fraud, the charade that this whole anti-corruption fight is).

if you think Buhari is fighting corruption go and read George Orwell's ANIMAL FARM and understand whats going on.

The fact remains that if this CJN were Hausa/Fulani Muslim based on verifiable precedence of how Buhari reacted to Ganduje, Baru, Maina, Kyari, Buratai and others accused of graft, the CJN will go scot free. The Exec Secretary of NHIS, Prof. Usman Yusuf was suspended by the Minister of health, for corrupt practices. what did Buhari do? Buhari REINSTATED him! Subsequently Yusuf was again suspended by the NHIS Governing Council. what did Yusuf do? he went and barricaded the office with MOPOL. why would he do that?of course he was doing that because he knew he had the support of the president. Garba Shehu went on air on Channels Tv and in defence of yusuf uttered the following words "…did the Board follow due process in suspending this gentleman (Yusuf)?…No, they haven’t”. ehen, so there is such a thing as due process?

When we cry out in Onnoghen's case insisting that due process must be followed some fools say we are bringing in unwarranted technicalities. Selective justice is a great threat and so odious a thing that it should be resisted by all. if Salisu commits a crime, he is patted on the back, but if Solomon commits the same crime he is swiftly taken to the gallows. Buhari negotiates with Boko Haram but swiftly deals with IPOB.

call me IPOB, i dont care. I detest injustice. I detest Buhari's double standards and his obvious hypocrisy

lets see how the NJC will handle Tanko who has himself blundered big time.
so,u are now using ganduje,Abba kyari, etc(executives and politicians)as a yardstick to measure onnoghen right?u forgot dat onnoghen is like d next to God in terms of equity and justice who all of us should run to wen ganduje,Abba kyari, pmb ,amaechi trample on our rights cuz he's seen as our last hope of getting Justice.evn if all other arm of government is misbehaving, d judiciary shud be d last to join the fray hence, onnoghen isn't fit to hold such a holy and exalted office

Which tension? Tension created by Ibos carried out by the ibos. Most of the nonsense illogical statements are made by them. No tension in most part of Nigeria. The temple of justice is being destroyed with corruption. A man who is supposed to be a symbol of an incorruptible judge is being investigated they are citing Abia & Kwara cases. NJC will try to defend the integrity of Judiciary but not protect corruption.

If they end up suspending Tanko he will immediately cease to be recognized as a supreme court judge let alone a CJN by judicial workers. This one surely does not need the president's discretion or approval to happen.Even if they president refuses to sack Tanko as they directed,Tanko will be useless as he will remain a Judge only in title

[quote author=omooba969 post=75226870]Why hold any meeting in the face of blatant & brazen corruption?undecided

Our politicians fathers have now institutionalised corruption in Nigeria. Onnoghen's case shouldn't be contested as there's an admission of wrongdoing by the defendant (Onnoghen), therefore he should be facing prosecution with expectation of a custodial sentence.

In the same light, the executive arm has violated rules & flouted laws with regards to due process - arbitrary use of power.

The judiciary is twisted, the country is....grin

Phew!sad[/quot

what's the corruption here? is non asset declaration a corruption? What happened to your president who couldn't provide his waec cert and hired several SANs to defend him before faking his cert in a legal way? even if Onnighen is corrupt as you claimed then why didn't pmb table the matter befire the legislative arm of the government for a two-third majority to remove him? Do you know that Tanko who is in acting capacity included 10 judges in his 250 newly constituted members? Is that not corruption? Do you know also that pmb has appointed two dead people in this administration? He who without a sin should cast the first stone

How has the judiciary protected 'their thief'? This is about due process that everyone must follow in a democratic society. I do not think there is any judicial officer that has said Onnoghen should not answer for any offence alleged to have been committed. Rather, the problem is that the Executive has deliberately meddled and breached provisions of the Constitution and superior court judgements that a judicial officer must first be subjected to the NJC for disciplinary measures before he can be tried by any court.

It is a self-regulatory feature that is meant to allow for some level of independence and is also obtainable in the Executive and Legislature. That is why a committee was set up for the likes of Daura (DSS), Babachir, former DG, NIA and a host of others. It is then let for the same Executive to file an action before the courts and prosecute them for corrupt practices which led to their dismissal in the first place. This as you know, has not been done.

Bottom line is due process and rule of law. You would have made more sense if they had the AGF and F had first approached the NJC on Onnoghen's issues and the NJC refused to act. Garba Shehu is on record for the NHIS Secretary that was removed by the board saying that they had not followed due process to remove him. Why is that so hard to accept now for the CJN?

Re: NJC Holds Emergency Meeting Over Onnoghen’s Suspension - Channels Tv by Laid2001: 3:34pm On Jan 29, 2019
NJC of itself has no inherent power to even sanction or appoint any judge of the supreme court without recourse to the president.

For instance, it can not of itself sanction Tanko without recourse to PMB.!.

And it can not convict anyone since it is not a court of law. It can only recommend to the president (the executive) to sack and prosecute any judge it deems to have reasonable suspicion of crime. Of itself, NJC has no power other than recommending to the president who will then pass it to the senate, if agreed with the recommendations, to put effect to it with 2/3 vote.

I don't know why some of you cannot leave tribe and ethnic bias out of issues. If nothing else, the majority of the legal profession is against this illegality perpetrated by the President and the CCT; the Majority of the South has also kicked against it because he is of Southern extraction yet you must just single out Igbos, why? Who did this to you? Can you not see beyond your ethno-centric lenses?

Mr Onnoghen actually suspended the NJC meetings until further notice thereby preventing or frustrating due process - he's the chairman of NJC & he left the CCT with no options but to act on his flagrant behaviour.
