I might agree that they don't a mutual political relationship in the past, but what about now? the tide might have change because technically he is never suppose to be CJN(retirement factor) but the card is being played in his favor(political manoveuring- displacing two to favor one)... In my opinion, NJC will avoid further dragging the Judiciary into the mud by ratifying Onnoghens suspension and recommending Mohammed's appointment.

Yes, PDP and their cohorts will shout but there is a way out.

In the case of Abia state, which is used as precedence, the CJ was removed and the new CJ's was appointed without NJC, story ends. The vacuum was without the complication of an exparte order we are seeing in this CJN case.

In this case, it is a suspension and there is a vacuum, while there are cases in both the Appeal court and the CCT where the determination is the one creating the vacuum of CJN.

The NJC in this case would have to first of all declare if the CCT has jurisdiction over Onnoghen's case or not before they can decide if Mohammed was right or wrong. If CCT acted right, then Mohammed acted right, if CCT acted wrong the Mohammed was wrong. Either way Mohammed couldn't have known which way the NJC prefered so he had to fill the vacuum created until when all parties resolve their issues. I was his responsibility to do so and if the next judge was in his shoes, would have done same.

Mohammed can also claim to be under the CCT's exparte order just like the president is also claiming. The order had the part where the president should act and he as the most senior judge will also act. If the NJC doesnot agree, then the CCT is the one responsible not the President nor Mohammed.

If the NJC wishes to put an end to the whole issue, they would obviously recommend what the president could accept. I also think they would after considering Onnoghen's reply, forward the petition against him to the CCT as the appropriate body to deal with his case. If they do that, it means they have ratified the earlier suspension and killed whatever case is in the appeal court.

This is my opinion, am not a lawyer.

I know this tanko is not corrupt at all so the njc wants to sacrifice onnoghen and him to go so that they want to continue their corruption in the judiciary. they already know who tanko is.

NJC can recommend the two justices of the supreme court for removal to the President and the president may reject the recommendation.

However, if Onnoghen resigns, PMB will accept his resignation and in line with NJC's rule, It will have no choice than to recommend the next most senior judge for elevation to the post of the CJN. and that will be Tanko.

And if PMB accepts the recommendation for both judges to proceed on early retirement, the next most senior judge is a Yoruba man and may be politically acceptable to all. The NJC will then have to ask the President to appoint new judges to the supreme court.

That is if the president wants Onnoghen out more than he wanted Tanko as CJN. Either way PMB holds the ace on this.

Bros Justice Rhodes is a man of honour and not a stooge.It may also interest you to know that it was Justice Rhodes who led the supreme court panel that ratified the Makarfi led executive as the authentic PDP exco.The supreme court has never fallen to the manipulations of any government in power.

NJC to sacked Tanko in dreams. The federal government have settled for Justice Tanko Muhammad, if NJC does not want to be ridiculed let them not accept Tanko, when the constitution also gives the president the right to accept or reject NJC recommendation.

Just like Magu's case senate rejected his confirmation and is still their as acting for almost 4yrs.

NJC recommend any other person apart from Tanko and see how Tanko will be acting CJN until 2023 he reaches 70yrs of retirement.

Didn't you just read that any CJN appointed by the president without Senate confirmation can only serve a maximum of 3 months, after which he cannot be reappointed? Tanko cannot even saty there more than one month.The supreme court will sack him long before then.Furthermore Tanko will be suspended by the NJC and thus will no longer bbe regarded in the hierarchy of SC judges

lol and you think Onnogen will resign?.The SC factor is there.It will deliver a ruling on the suit filed by the senate and either nullify or affirm the president's actions.Furthermore If Justice Tanko is recommended for dismissal by the NJC he will no longer be the next in line to the CJN

Exactly. D article is clear demonstration of separation of powers and d independence of d Judiciary. They don't need d president 2 tell them what they should do. Its what many Nigerians have been saying. D president can't just wake up& decide that d CJN is corrupt & apportion punishment as he feels. Let d process take its full course

He is a sharia man. The most likely reason Buhari quickly dispatched Onnoghen knowing that the next in line is a man of the same breed with himself. If NJC sacks the man, Buhari like in the case of Magun, the EFCC chairman will still want to keep him. Itsey Sagay by then will give him the legal reason why he shouldn't listen to NJC because corruption is in all of its members. The man Buhari and his co-travellers do not understand how civilized society functions, they belong to the sharia bush.

NJC cannot sack anybody yet it is the body responsible for taking disciplinary action against any judicial officer found wanting in the course of discharging his/her duty. Do you even understand what the word "discipline" means?

Is there anywhere i implied or insinuated Mohammed should claim ignorance? Mohammed himself would be dumb if he claims ignorance neither am i dumb to say he should claim ignorance.

What he did was a result of an exparte order right or wrong, the responsibility is not his to
bear. That is not feigning ignorance. As a Judicial officer he abided by an order to avail himself as the most senior.

NJC should fault the exparte order if they like, squash it or do whatever, he obeyed the law. If he had refused, Buhari will also petition him for refusing to obey an order of a lawful court.

We are all partisan in one way or the other but we try to find a balance between our allegiance and the common sense. I suggest you try to leave you partisanship out of National issues.

With the past ruling of Justice Rhodes he will be another Onnoggen.I have been looking at some of his past judgements and it makes me happy we will have another formidable judge with the strength of character to take over the judiciary when Onnoggen finally retires.

God used this crisis to expose and remove the demon Tanko who would have taken over from Onnoggen.Now I know why they say God works in mysterious ways
