There are 3 recommendations by which CJN could be retired according to Constitution 1 If he/she attends the retirement age/or death 2 Or by approval by National Assembly through 2/3 members 3 By recommendations from the Nigeria Judiciary council. comos: Though i don't know much about the judiciary system.... both should step aside or retire both. The Acting CJN Mohammed shouldn't be the CJN.. he came in through the back door.. he should be sent backing the next after him should take over... It will be wrong to ask him to retire based on mere allegations. There is already a case instituted against him. He should step aside while the matter is judged so he doesn’t influence the case. If found guilty, he is dismissed. If innocent, he is reinstated. Either way, Muhammad should be penalized for presenting himself to be sworn in. By the way, I bother less about Innoghen as a person. 1 Like |

My concern is that one lunatic in The APC or the PDP will now seize on this precedence to attack and bully the judiciary into submission in the foreseeable future. Does it not concern you that a man like Buhari that surrounds himself with known criminals, cherry picks on which court judgement to obey or disregard is now the same person claiming to sanitize the judiciary? rusher14: Even if he did that he is only postponing his doomsday. The NJC has procedures to handle such issues. That is why the law is an ass but must be obeyed. Under no circumstances must the executive have the powers to remove a chief justice. If not our democracy becomes a dictatorial one and this will not end up well for both APC and PDP cos you don't know who will be in power tomorrow. |
