Zamfara APC: Maintain Status Quo, No Candidate For Elections - Appeal Court by References: 5:38am On Feb 14, 2019
Contrary to widespread speculations, the Zamfara APC will not field candidates for the National Assembly, Gubernatorial and State House of Assembly elections. This is following as separate Appeal Court judgements failed to invalidate the judgment of Justice Ijeoma of the FHC, Abuja affirming INEC's stance that the primaries indeed did not take place......

The Court of Appeal,Sokoto:

The Court of Appeal in Sokoto has dismissed an appeal against the judgment of a Zamfara State High Court asking the Independent National Electoral Commission (INEC) to recognise candidates of the All Progressives Congress (APC) for various offices in Zamfara State.

The judgment returns the parties to the status quo before the appeal court’s decision.

The federal high court’s judgment which stopped the party from participating in the elections has not been set aside while the judgment of a Zamfara State High Court which asked INEC to recognize the party’s candidates for the election also subsists.

A three-member panel of judges unanimously dismissed the appeal following its withdrawal by the appellant, Aminu Jaji.
INEC has earlier insisted it would not recognise the Zamfara candidates who were produced after the stipulated time for the primaries.

The electoral body also maintained its position following conflicting judgments on the matter by a high court of Zamfara and federal high court on the same day.

Hear Senator Marafa:

"We are back to status quo, that is, no candidates for APC in Zamfara," said Marafa, Chairman of the Senate Committee on Petroleum (Downstream).
"Contrary to the erroneous information being peddled by some uninformed persons, the Court of Appeal in sokoto didn't clear APC candidates in Zamfara.
"In the sokoto division, the Court of Appeal refused to entertain the motion filled by Yari's counsel seeking the enforcement of the judgement of the Zamfara high court.

"The motion for the enforcement was rested on the appeal filled by Rep Sani Jaji and since the appeal was withdrawn the motion collapsed with it and was therefore dismissed.
"In the Abuja division, a similar motion seeking stay of execution filled by Yari counsel was withdrawn by the counsel himself, who also admitted in the open court that the motion ought not to have been filed because Justice Ijeoma Ojukwu did not give any order that can be stayed she simply commended INEC and maintain that it (INEC) acted within its powers and that APC failed to prove its case that it conducted primaries in zamfara.
She thereafter dismissed the case. Consequently, the Appeal court struck out the motion
"The motions, having failed in both divisions of the court in the same day, it is very clear that we are back to square one. There is no APC candidate in Zamfara state," Marafa insisted.

INEC is obviously threading the path of illegality in the Zamfara case. The Abuja high court did not give any order to INEC while the Zamfara high court gave a very clear order to INEC to recognize the candidates of the party. INEC cannot choose to deliberately disobey a valid order of the high court. All elections conducted in Zamfara will eventually be nullified if APC is excluded based in clear violation of a valid court judgement.

The NWC has rendered the primaries null,cancelled it and informed INEC of a fresh one. The NWC is the "engine-room" of a party. Why should Oshiomhole stop primaries when about 10 LGAs has been counted?
The NWC had dissolved the state EXCO, just like they did in Kwara,they conducted elections, and the Appeal Court upheld it. In this case, the State EXCO was dissolved, no elections,the Court will always recognize the legitimate EXCO as approved by NWC.
Oshiomhole and Yari is where the blame should be not INEC or anyone else.

INEC can avoid the unnecessary legal logjam by obeying the valid court judgement now.

but the national leadership and it's working committee says otherwise..
if INEC recognises yari's faction and another court judgement comes nullifying it don't you think the whole exercise will be a joke.
INEC will rather accept a final judgement from the Supreme court determining which of the factions should be fielded.

The Zamfara high court ruled that valid primaries were held and that judgement remains the lawful position until a superior court rules otherwise.

seunmsg, there was even a court order maintaining status quo,that means nobody should do anything.....perhaps we have forgotten....this should guide you and make you see that Oshiomhole and Yari are the issues..........

The Kwara state High Court don't forget upheld the Filani-faction of the APC.....so leave that High Court judgement concocted inside Gusau Government House......

Why continue with the argument with that seunmsg of a person (my dictionary brought out scumberg when typing that name shocked shocked)

He should go and put APC on the ballot in Zamfara since he is the "owner" of Nigeria.

My joy is that Marafa has indicated strongly that he can work against APC, I trust Atiku to have keyed into that. At least something go drop from zamfara unlike the previous elections
