Kingspal:I think you should try get SC rulings during last election verdicts. They made pronouncement that made it so difficult to upturn an election in Nigeria. Also, go through Agbakoba and Fálànà submissions too. During Buhari and Yar'adua case, the SC court even acknowledged that truly substantial rigging was proven, but it wasn't enough to upturn the election result. Aregbesola relied on video evidence mostly to defeat Oyinlola, then gubernatorial cases end at C of A, this led to some issues within the judiciary and law was amended to make the gubernatorial end at SC. During last election, SC court opined that a witness can only defend a video as he can't be at 2places at the same time, meaning you need a minimum of 1witness per PU, therefore, you can't assume that because 20 of 25PU in a ward was rigged, then the other 5 was also rigged and must therefore be discarded. A legal practitioner, Robert Clarke Clarke, says the vote President Muhammadu Buhari got from the northern part of the country cannot be challenged in court. He stated this on Sunday while appearing on Channels Television’s Politics Today. The Senior Advocate noted that Buhari enjoys the goodwill from the northern people because of what he described as the ‘President’s track records’. “Look at the presidential election, nobody can challenge the number of people who voted for President Buhari in the north because there is a track record. “In 2003, Buhari beat any other candidate in the north, in 2007 he beat any other candidate in the north, in 2011 he beat any other candidate in the north, (same in) 2015. So in 2019, if you look at his performance when you look at his performance, there is a footprint.” He stated. His comments come two weeks after the People Democratic Party (PDP) presidential candidate, inaugurated his legal team to challenge the result of the just concluded presidential election. READ ALSO: Ananaba Backs Electronic Voting As Solution To Ballot Box Snatching Prior to the setting up of the team headed by a Senior Advocate of Nigeria, Dr Livy Uzoukwu, Atiku had rejected the result, alleging several malpractices including the use of the military to perfect voters’ intimidation and suppression in PDP strongholds. He had also accused the All Progressives Congress (APC) of conniving with INEC officials and security agents to fabricate “bogus figures and outright falsification of the returns from the polling units”. The PDP candidate, thereafter, said he would use all available legitimate means to challenge the result of the election. But Clarke stressed that he would have advised Atiku against challenging the result if he was his (Atiku’s) lawyer. According to him, an aggrieved loser at an election should show that the election was riddled with malpractice before succeeding at the tribunal. “Let’s be honest. The criteria for challenging an election is three-fold. When you go to an election petition, you must first of all show that the election was riddled with malpractice. “After bringing out the malpractice, you must show that those malpractices affected the result declared by the Independent National Electoral Commission (INEC). “If I were Atiku’s lawyer, I would have told him that it not easy to challenge an election that has given someone four million votes because when we look at the five states of the southeast, the totality of all the states is not up to half, two million votes of what Buhari (got) not to talk of four million,” he stated 1 Like |

No tribunal can save you Atiku, you have lost this election already, there was rigging but it wasnt enough to sway the outcome of the elections. At the end, you will hear judgement like in national interest, the election remains valid, just like Buhari and Yar'adua. tuniski: The way you guys reason sometimes is really poor. We're talking about election petition tribunal, you're talking about INEC decision. This is a court for crying out loud. You guys are too emotional that's why you can never learn anything. So you think 400 witnesses will upturn a presidential result? Many governorship election petition cases have witnessed more than 1,000 testifiers without any success. Again, should a State collation officer step forward to recant results declared in a state as being doctored,that is beyond gathering the electorate of the state as witnesses. Case of widespread malpractice requires significant proportion of the electoral constituency while falssification/alteration of result in the first instance requires event/happenings at collation points which are very small. Again, the case might be targeted at specific states to wipe out opponent's victory margins. Just allow the case to roll no need to agitate. It is democracy and the rule of law. |
