Counter-claims are usually used to dodge responding to a petition.

You can use it to challenge the jurisdiction of a court to hear a case, or tell a court to strike out a case because it was it was filed outside the stipulated time.

In the case of APC, they are praying to the court to strike out Atiku's petitions since he is not even qualified to stand for the election. They are stupid not to realize that PDP is a co-petitioner.

So even if the court grants their prayer by disqualifying Atiku, they can't strike out the case and if that is their only prayer to the court, the court will start to consider PDP's petitions and since they don't have responses to them.

The court will go ahead and grant a kinda default judgment in favour of PDP.

You guys rigged election, SIMPLE.
You are still sounding more dumb like a broken record or a shatered robot.you even corroborated me ignorantly.even a kid knows that this is one of several apc prayers and counter claims.even a dropout law student knows that the case depends on what evidence atiku team presents plus arguments canvassed and not what apc or buhari is bringing forward.

By naturalization: 27. (1) Subject to the provisions of section 28 of this Constitution, any person who is qualified in accordance with the provisions of this section may apply to the President for the same of a certificate of naturalisation.

(2) No person shall be qualified to apply for the grant of a certificate or naturalisation, unless he satisfies the President that -
* (a) He is a person of full age and capacity;
* (b) He is a person of good character;
* (c) He has shown a clear intention of his desire to be domiciled in Nigeria;
* (d) He is, in the opinion of the Governor of the State where he is or he proposes to be resident, acceptable to the local community in which he is to live permanently, and has been assimilated into the way of life of Nigerians in that part of the Federation;
* (e) He is a person who has made or is capable of making useful contribution to the advancement; progress and well-being of Nigeria;
* (f) He has taken the Oath of Allegiance prescribed in the Seventh Schedule to this Constitution; and
* (g) He has, immediately preceding the date of his application, either-
(i) Resided in Nigeria for a continuous period of fifteen years; or

(ii) Resided in Nigeria continuously for a period of twelve months, and during the period of twenty years immediately preceding that period of twelve months has resided in Nigeria for periods amounting in the aggregate to not less than fifteen years.

28. (1) Subject to the other provisions of this section, a person shall forfeit forthwith his Nigerian citizenship if, not being a citizen of Nigeria by birth, he acquires or retains the citizenship or nationality of a country, other than Nigeria, of which he is not a citizen by birth.

29. (1) Any citizen of Nigeria of full age who wishes to renounce his Nigerian citizenship shall make a declaration in the prescribed manner for the renunciation.

(2) The President shall cause the declaration made under subsection (1) of this section to be registered and upon such registration, the person who made the declaration shall cease to be a citizen of Nigeria.

(3) The President may withhold the registration of any declaration made under subsection (1) of this section if-

(a) The declaration is made during any war in which Nigeria is physically involved; or

(b) In his opinion, it is otherwise contrary to public policy.

(4) For the purposes of subsection (1) of this section.

(a) "full age" means the age of eighteen years and above;

(b) Any woman who is married shall be deemed to be of full age.

have any of you even consulted the constitution to know what makes you a Nigerian.
The simple fact is that prior to the 1960 independence declaration there were parts which were know as regions ,The North,West and Eastern Part made up Nigeria.
the key question is at "Birth". at Birth Was Atiku a Nigerian or the Cameroonian ?.We need to settle this question. raising to the position of a VP is totally different from what is required for the position of president. Have you all forgotten the issue of the birther movement with Obama and Trump?.
The issue was not that Obama was not an American but rather .if he was born on american soil cause that is what it stipulates.

The question is was Atiku born on Nigerian soil or not.
Remember a part of his was known as the Cameroons. which move over from the Cameroonians to Nigeria after independence while a part of Nigeria moved to the other side (Amazonian)
So you guys need to go back to your history classes and learn.

The All Progressive Congress (APC) and the winner of the February 23, 2019 Presidential Election, has filed a motion at the Presidential Election Petition Tribunal in Abuja that the candidate of the People’s Democratic Party in the poll, Alhaji Atiku Abubakar, is not a Nigerian and therefore not qualified to have stood for the election.

The Party claimed that the former Vice President is a Cameroonian and not a Nigerian citizen and his petition against President Muhammadu Buhari, its own candidate, should be dismissed for lacking in merit.

In a reply to the petition of Atiku and the PDP praying for their declaration as the lawful winner of the presidential poll, the APC said that the 11.1 million votes recorded in favor of the two petitioners should be voided and considered a waste by the Presidential Election Petition Tribunal.

The APC’s reply to the petition, filed by its lead counsel, Lateef Fagbemi faulted the candidacy of Atiku in the election insisting that as a Cameroonian, he ought not to have taken part in the presidential poll of Nigeria in the first instance.

The Party averred that Atiku was born on November 25, 1946, in Jada, Adamawa, in Northern Cameroon and is, therefore, a citizen of Cameroon and not a Nigerian by birth.

However, if it is true that such a words (reply) ever came out from the party, then the dooms day for the Country has just arrived. What a sick joke taken too far. Where was the APC when Atiku was a chieftain in their party, didn't they know he wasn't a Nigeria then? I mean, a former VP President, a former Governor elect, a retired DCG of NCS? Atiku started it by turning his petition into a comedy circus by asking the tribunal to cancel the whole election because Buhari does not have a certificate because his school wasn't existing in 1949, so the APC are playing along. When atiku gets serious with his petition, I am sure APC will also get serious with its defence.

I don't call you illiterate for nothing. I have explained what a counter-claim is, why it is used and when. I won't educate you on that again.

Mumu, you file a petition, the respondent files a response and then evidence are called to prove both claims. It is based on the petition and responses that a court grants prayers.

The case depends on the evidence PDP presents to back their petitions and evidence APC presents to back their responses. Not just on the evidence of PDP.
