Fellow NL, as you may have heard, Nigeria ruling party APC claimed that His Excellency Alh. Atiku Abuakar GCON, GCFR former Vice President of Nigeria (1999 - 2007). Waziri Adanawa, a former chieftain of same APC snd recently presidential candidate of PDP is not a Nigerisn, but a Camerounian.

Of note is the fact that Atiku holds a Nigerian Passport, Nigerian National ID card. His town which is in Adamawa in NE Nigeria is in Nigerian territory. He was Comptroller General of Nigeria customs. Former Governor-elect of Adamawa State, whose business interest, family, etc. are well known in Nigeria.

For me, for such a person to be labelled a foreigner is not only STUPID but highly libellous and subject to litigation and stupendous reparation from the APC. This claim just proves that APC leadership is full of BLOCK HEADS.

I can describe such claim by APC as LUDICROUS!

Do you even realise how stupid APC petition is? Lets assume howbeit "foolishly" that Atiku was a Camerounian. Those votes belong to PDP, suppose APC loses at the tribunal and PDP is adjudged winner of the election, the votes reverts to PDP vice presidential candidate ìf Atiku was to be a Camerounian. You can see the stupidity in this oetition. I now know that Keyamo guy actually got his SAN from the backdoor. APC is a monumental disaster, honestly!

Atiku's citizenship is not the issue here, everybody knows he is a Nigerian citizen. The issue is what the law says about running for president. The law says that in order to run for the office president, one must be a Nigerian citizen "by birth". Atiku was initially born a Cameroonian and only became a Nigerian in 1961 when the area of Adamawa joined Nigeria after a referendum

Ultimately, it will be the courts that will decide if Atiku is/was eligible to run for president

So how does Buhari whose birth predates Nigeria become eligible for same office? Was the present grograohical entity in existebce when Buhari was born?

Stop disgracing yourself.

The election was conducted based on the 1999 constitution and Section 36 of the Nigerian constitution confers retrospective jurisdiction on all Nigerian laws.

So APC's counter-claim is null and void. It will only apply to people that were born after the enactment of that act.

The same set of people who think it is cool to question the president’s secondary school qualification despite the public presentation of his result attestation by the head of WAEC council are the same people crying over APC’s decision to question Atiku’s citizenship.

They even believed Buhari is Jubril from Sudan but can’t stomach the fact that Atiku is an illegal immigrant in Nigeria.

See guys, nobody has monopoly over being stupid and ridiculous. PDP cretins have been flying the kite of silliness all over the place since 2015. There is no big deal if APC indelges in similar silliness that PDP has mastered over the years.

Oga, legal proceeding is procedural. It is not an agbero park where arguments are not moderated. APC have filed their response and nothing again, unless they apply for leave to amend which PDP can argue against and that leave is at the discretion of the court to grant.

There is nothing like mindboggling again.

Again, APC claim against Atiku is faulty because they drew its strength on the present constitution which was enacted in 1999 and the section 36 of the same constitution grant retrospective jurisdiction on all Nigerian laws.

This means you can't be tried with a law that was passed before the crime was committed.

If Mr A commits terrorism in 2009, he can't be tried with an Anti-terrorism Act that was passed in 2011. You have to try him with the extant law during the time of the crime.

Unfortunately for APC, the election was conducted based on the 4th republic constitution.

Simple case to win.

Wrong. The Supreme Court judgement in the case of Faleke vs Yahaya Bello only applies when the victorious party had a valid candidate. If APC can prove that Atiku is an alien and not eligible to stand for election, PDP’s participation in the last presidential election will be null and void in the face of the law. By implication, PDP did not participate at all in the election not to talk about winning.

I'm no Lawyer, but my understanding of the geographical make up of Nigeria is the boundary it had as at October 1st 1960. Atiku became a Nigerian after independence in 1961. Since the present constitution says that the president must be Nigerian "by birth", it means that Atiku may be eligible to seek the office of president since he comes from a territory that was not part of Nigeria as at 1st October 1960.

Something a bit similar happend some years ago when there was debate if Obama could run for president of America because the law is that an American president must be born inside America. Obama was born in Hawaii which is outside mainland America but it was later determined that Obama could run because Hawaii was already become a territory of America as at the time Obama was born and the law was enacted

So Atiku could argue that while he was not born a Nigerian, the territory of Adamawa had become part of Nigeria long before the 1999 constitution was enacted

The case has merits and demerits. It is constitutional Lawyers who know better

Birther's Theory

Atiku was born on November 25, 1946, a Cameroonian citizen with a birth certificate issued by the Cameroonian government.; Northern Cameroon amalgamated with Nigeria through votes cast in 1959. Only people born on or after 1959 union could claim Nigeria's birthright and birth certificates; those before ( like Atiku) became Nigeria citizens as a result of the amalgamation BUT with a birth certificate of Cameroon.

Nigeria Constitution is explicit enough on who can contest the position of the President of the Federal Republic of Nigeria. Those who were born as Nigerians ( not those who benefited from amalgamation, nationalization or honorary citizenship).

No nation re-issues a birth certificate previously issued by another country of birth to accommodate privileges derived as a result of amalgamation, nationalization, etc to a person.

Atiku has a birth certificate that pre-dated Northern Cameroon- Nigeria amalgamation of 1959. Nothing can change that fact.

However, from 1959 onwards Atiku enjoys the citizenship of a Nigerian.but his birthright and birth certificate remain that of a Cameroonian. Nobody is entitled to two birth certificates including Abubakar Atiku. This is his birther theory.

The way you guys interprets the constitution is funny.

The votes are not to Atiku but to PDP. The Supreme Court has already established that precedent and ruled on that multiple times.
