Atiku's Place Of Birth: Election Tribunal Lacks Jurisdiction to decide. APC's Reply Defective.

The Electoral Act gives INEC and the Courts the power to decide the eligibility of any contestant for an elective position in Nigeria. Whereas the Election Tribunal is saddled with issues bothering on petitions relating to an already conducted election and therefore lacks the power to decide issues such as eligibility based on place of Birth of any particular candidate that was not disqualified by INEC or any Court of Competent jurisdiction.


APC should have called for the disqualification of Atiku based on POB if they felt he wasn't qualified enough to aspire for the office of the President of Nigeria prior to the election and that would have been at the regular courts not Election Tribunal.

Since APC is not challenging the fact that Atiku's hometown is currently within the geographical location of the present day Nigeria, then it goes without saying that they are simply discriminating against a certain section, tribe or people of Nigeria.

Recently, an Igbo man contested, won and occupied an elective seat in Lagos state without discrimination. Currently some Nigeians are even occupying parliamentary seat in Europe etc.


The Nigerian Constitution gives even a non indigen of a State the right to vote and be voted for in that state as long as he had lived in that state for a considerable number of years (20years).

Was Atiku's petition only about Buhari's certificate?
Atiku presented evidential proof that he clearly won the election and APC/Buhari were also expected to present their evidential proof as well that they won clearly rather than diverting attention and deviating from the core of the matter.

Apc have also replied to those petitions but the newspapers left those ones because it wont make headlines.they focused on the one that will be sensational.in the coming weeks,they will publish all the prayers

He MAY be contesting it cos Buhari still used same excuse as 'certificate with the NA' on the 2019 Election forms.
